Not trying to start a photography business, however I take some decent photos and some people have asked me to do some work for them. I am a nurse and my wife has a good job, I have no plans of starting some photography business as I work and have 3 kids. I really enjoy utilizing my camera and have fun with my kids, I could see myself freelancing for some friends or friends of friends. This is more of a side gig, at this point compensation is pretty minimal bordering on bartering, but in the world we live in I have a question on liability. Since this is only an occasional thing I had no plans on getting any sort of insurance or anything, so is it wrong to have people sign a liability waiver just in case something were to happen? I mainly shoot outside, we have a nice rural yard with a barn and I could hardly see anything happening, but I am sure many have thought that and somehow someway someone was trying to sue for something? Just curious, I guess I am laying out 3 options; get insurance (was not wanting to go this route as its a pain for the small amount of work I plan on doing), sign a liability waiver stating I am not liable if something were to happen, or neither and assume that it is a simple photo shoot in a yard and that unless some act of God comes and blows a tree on us or a barn down that I should stop worrying? hi Johnny, I think even though if they sign the liability waiver there is still certain liability on your part when it comes to operating a business (even though its not as big etc) and bringing people to your property. Anything can happen, and then people nowadays wont think twice before they go ahead and start legal actions against you (sadly this is the world we are living in right now) so Id look into some sort of insurance in this case.
Also, do you have them sign the waiver for you to use the photos of them? Just in case if those photos show up somewhere else if they see them online etc. :) I didn't mean to add more headache but ... :)
