WHOIS lookup can be very useful for those who are looking to find domain owner’s for business purposes. www.opinionstage.com/singh91/what-is-whois-lookup-and-why...

One of my contacts, Rebekka, had a picture up with comments about a copyright infringement problem she was having with a UK company (which resulted in over 400 comments and more than 100,000 views of this one image/comment stream) [Cached version no longer available].

A handful of commenters (myself included) posted publicly available address information from whois lookups on the domain. When requested to remove that information by the company, I did so.

Unfortunately, a small number of commenters suggested criminal acts against this company.

While we do not know their exact reasons, Flickr removed the picture from Rebekka's photostream and all the comments that had been associated with it, including useful information for her with regard to UK Copyright and Company Law and the litigation process here. I can't see why they could not have just removed offending comments, and if any of the text under the picture was a problem, advised her to remove it, before taking such a drastic measure.

I for one am now considering whether to remain part of the Flickr community. I love the people and some of the spectacular pictures here, but I am not happy at the actions of the Flickr staff...

More information regarding this can be found on this picture, and her blog.

UPDATE (20/05/2007):

See Flickr's Official Response, explanation, and apology. This seems to me to be a genuine expression of regret and and Rebekka, from her blog, seems to be happy with this outcome as well. Due to this, I personally feel much happier now about this situation, and I hope the initial copyright issue will be resolved too...

Do you want to install and setup Wordfence security plugin on your website? Wordfence is a popular WordPress plugin that helps you tighten the security of your WordPress site and protects it from hacking attempts. In this article, we will show you how to easily install and setup Wordfence security plugin in WordPress.

What is Wordfence? How it Protects Your WordPress Site?

Wordfence is a WordPress security plugin that helps you protect your website against security threats like hacking, malware, DDOS and brute force attacks.

It comes with a website application firewall, which filters all traffic to your website and blocks suspicious requests.

It has a malware scanner that scans all your WordPress core files, themes, plugins, and upload folders for changes and suspicious code. This helps you clean a hacked WordPress site.

The basic Wordfence plugin is free, but it also comes with a premium version that gives you access to more advanced features such as country blocking, firewall rules updated in real time, scheduled scanning, etc.

Having said that, let’s see how to install and easily setup Wordfence for maximum security.

How to Install and Setup Wordfence in WordPress

First thing you need to do is install and activate the Wordfence Security plugin. For more details, see our step by step guide on how to install a WordPress plugin.

Upon activation, the plugin will add a new menu item labeled Wordfence to your WordPress admin bar. Clicking on it will take you to the plugin’s settings dashboard.

This page shows an overview of the plugin’s security settings on your website. You will also see security notifications and stats like recent IP blocking, failed login attempts, total attacks blocked, etc.

Wordfence settings are divided into different sections. The default settings will work for most websites, but you still need to review and change them if needed.

Let’s start by running a scan first.

Scanning Your WordPress Site Using Wordfence

Head over to Wordfence » Scan page and then click on ‘Start a Wordfence Scan’ button.

Wordfence will now start scanning your WordPress files.

The scan will look for changes in file sizes in the official WordPress core and plugin files.

It will also look inside the files to check for suspicious code, backdoors, malicious URLs, and known patterns of infections.

Typically these scans need a lot of server resources to run. Wordfence does an excellent job of running the scans as efficiently as possible. The time it takes to complete a scan will depend on how much data you have, and the server resources available.

You will be able to see the progress of the scan in the yellow boxes on the scan page. Most of this information will be technical. However, you don’t need to worry about the technical stuff.

Once the scan is finished, Wordfence will show you the results.

It will notify you if it found any suspicious code, infections, malware, or corrupted files on your website. It will also recommend actions you can take to fix those issues.

Free Wordfence plugin automatically runs full scans on your WordPress site once every 24 hours. Premium version of the plugin allows you to set up your own scan schedules.

Setting up Wordfence Firewall

Wordfence comes with a website application firewall. This is a PHP based application level firewall.

The Wordfence firewall offers two levels of protection. The basic level which is enabled by default allows the Wordfence firewall to run as a WordPress plugin.

This means, that the firewall will load with rest of your WordPress plugins. This can protect you from several threats, but it will miss out on threats that are designed to trigger before WordPress themes and plugins are loaded.

The second level of protection is called extended protection. It allows Wordfence to run before WordPress core, plugins, and themes. This offers a much better protection against more advanced security threats.

Here is how you would set up the extended protection.

Visit Wordfence » Firewall page and click on the Optimize Firewall button.

Wordfence will now run some tests in the background to detect your server configuration. If you know that your server configuration is different from what Wordfence has selected, then you can select a different one.

Click on the continue button.

Next, Wordfence will ask you to download your current .htaccess file as a backup. Click on the ‘Download .htaccess’ button and after downloading the backup file click on the continue button.

Wordfence will now update your .htaccess file which will allow it to run before WordPress. You will be redirected to the firewall page where you will now see your protection level as ‘Extended protection’.

You will also notice a ‘Learning Mode’ button. When you first install Wordfence, it attempts to learn how you and your users interact with the website to make sure that it doesn’t block legitimate visitors. After a week it will automatically switch to ‘Enabled and Protecting’ mode.

Monitoring and Blocking Suspicious Activity Using Wordfence

Wordfence shows a very useful log of all requests made to your website. You can view it by visiting Wordfence » Live Traffic page.

Here you can see the list of IPs requesting different pages on your website.

You can block individual IPs and even full networks on this page.

You can also block suspicious IPs manually by visiting the Wordfence » Blocking page.

Advanced Settings and Tools in Wordfence

Wordfence is a powerful plugin with lots of useful options. You can visit Wordfence » Options page to review them.

Here you can selectively turn features on and off. You can also enable or disable email notifications, scans, and other advanced settings.

On Wordfence » Tools page, you can run password audit to ensure that all users on your website are using strong passwords. You can run whois-lookup for suspicious IP addresses and view diagnostics information to help debug issues with the plugin or your WordPress site.

Premium version users can also setup two-factor login to strengthen login security on their websites.

Wordfence vs Sucuri – Which One is Better?

Now some of you will probably be thinking how Wordfence stacks against Sucuri?

Sucuri is another popular website security suite that comes with a website application firewall, malware scanner and removal.

At WPBeginner, we use Sucuri. Check out our Sucuri review to see how it helped us block more than 450,000 WordPress attacks in 3 months.

Both Wordfence and Sucuri are great choices to improve your WordPress security. However, we believe that Sucuri has some features that give it a slight edge over Wordfence.

One of them is website application firewall. Wordfence WAF is an application level firewall, which means it is initiated on your server.

On the other hand, Sucuri website firewall is a DNS level firewall. This means all traffic to your website goes to their cloud proxy before reaching your website. This helps Sucuri block DDOS attacks more efficiently and also reduces server load on your website.

We hope this article helped you learn how to install and properly setup Wordfence on your website. For more security tips, you should also check out our ultimate WordPress security guide for beginners.

This blog post indicates that some of the malicious code used to hack twitter with the #mikeyy worm is hosted at ireel.com. This screenshot shows the details of the company to who ireel.com is registered.

The Fox at work. One of the first things I did when I began my new job was install Firefox. I do have Multiple IEs running, an app that allows me to view pages in IE5 to 7.

I never modded this one as I used to do at home, but I did go for the Winestripe theme add-on to make 2.0 look like 1.5. Site showing is our video tutorial site Teach-me, which is to launch 1 December.

And now Google P O Box 99800 EmeryVille phishing. That P O Box seems to belong to an awful lot of dubious businesses.

www.fiadservices.com/how-online-money-scams-work/

How Online Money Scams WorkNow scammers dont even have to leave their homes, and can sweet talk thousands of people at a time scamming has become incredibly easy to do. There are many people internationally scamming, some are even protected by the better business burea in the United States, even though they target young emotional teens and the elderly like in the poetry.com scam where everyone is called a "semifinalist" in their international poetry competition. If you find a site that's questionable please use RipOffReport Search.SignsMost all scams we've seen require a registration free but promises to get you back the money within the first few days. Many scams don't actually offer a service, but a package, or trivial product to help you get started. Make sure you read their full terms of service.Been Scammed? If it was initiated by a telemarketer or letter contact your local police department. For all online scams: Use the whois search to get more information about the domain required for filing complaints. File a complaint with the FTC the file a complain with the IC3, file a complain with state security commission, file a report in the security exchange commission submit the scam to Ripoff Report, use DNS lookup to find their IP, and dshield for possibly even their bandwidth provider. Complain to both. Finally try the better business beauro online which will do nothing. If you paid with check or cash you're screwed. You can ask your bank or credit card companies to reverse the charges if you explain your situation but try to report as soon as possible or at least less than 2months after scam occurred. File a small claims report at your local court house if they wont let you.Pyramid ScamsBy far the most dangerous scams are pyramid scams. You are asked for an initial investment, sometimes as little as $6 and they say you get a high return of investment within a first assignment, or few days or weeks. The explanation and legality of the operation seems very logical, although a little sketchy on details. It instead talks more about all the things you could do with the extra money, giving random testimonials. Here's the dangerous part, you do earn money. Like in the case of the late 12dailypro, they did give a return on your investments initially. This is done so you tell more people about the operation and actually invest more money. People get extremely excited when they make money doing nothing. Being happy they ignored common sense for a chance of hope, like in lottery tickets, they feel like their intuition paid off, and invest even more money.Example of Pyramid Scams FailingA great example is Charles Ponzi from the notoriously dubbed "ponzi scheme". He found that he could make a profit trading European stamps for American Stamps at 6 times the profit per stamp, taken they were only a cent. The concept was logical and encouraging, but illegal. He got a few friends to invest, and he returned their money just as he said. He setup a company. He got more and more people to invest. Pretty soon he was no longer buying stamps at all but just paying off the older investors with the money from new investors. As soon as the money from new investors wasnt enough to pay the older investors, the scam crumbled.Get paid to Fill Surveys, Read Emails, Review sitesThese are about the same thing. They pay you a pathetic cents for your efforts. Sometimes they ask you to pay first, for example, a $30 fee/month, and then only offer $2 worth of surveys, each taking a considerable amount of time. This disgusting company called web-mystery shoppers was advertised on the news, paying $15 per website you review. Basically it works by asking you to do an initial review of the website then never contacting you again, letting all new members earn them money from mortgage and credit card companies by free initial reviews. They only needed to pay out initially for publicity.AutoSurf, surf the webAutoSurf programs are increasingly popular. There's the scam type, which asks you to pay a registration fee like 12dailypro which recently had its assets frozen. There's the type where you view sites, in exchange for people viewing your site. Usually these programs offer little traffic and wasted bandwidth because the views aren't targeted and people rarely pay attention to the sites, some people even make bots to switch sites automatically. The bottom line here is you may get 30 people worth of work an hour, when you could have been making more content for your site, or working a regular job for money to be used on legitimate, targetted advertising.MLMMLM is a business model running off franchising. You sell products or services that the company offers and you get a percent of the revenues generated. Other signs including paying for over inflated merchandise or forms then relying on you telling other people to do the same for cash. Legit MLM companies do not require a sign up fee!Data Entry, Virtual Assistants, TypistsMany offer these as a way to earn hundreds of dollars a day, just typing from home. While I was working on this page I got a telemarketing call asking me to pay $398 for a package to tell me how to do it from ameriXperts.com. They claimed to be registered with the better business beauro and located in illinois, when the domain was registered in India, to an Indian, who was calling me in Texas. They actually sell information on how to get these type of jobs advertising the max salaries of people who do it. Typists and data entry jobs are not in very high demand. You have to be able to type fast and accurately with at least a GED. The work varies and can be done in Mortgage companies, law firms, or medical organizations among others. It earns like 8 to 12 bucks an hour doing boring repetitive tasks in a company, which is not a big pay upgrade from saying hi to people in walmarts. Virtual assistants help users in websites that have questions, such as in hosting companies or with credit cards. Again, the demand isnt amazingly high and the pay isn't as advertised.I've made money on X and it's not a scamThere's plenty of testimonials of people who have gotten money. For example searching "12dailypro not a scam", the company that recently had all 300,000 members assets frozen on google has plenty of people offering "I've made x0,000 dollars on this program", adding their referral id at the bottom hoping to scam someone else into the program they ignorantly joined and now need their investment back. People can be very enthusiastic after making money with these type of programs, but remember even if you're of the lucky few that profits from them, you're still making the company much richer and the majority who sign under you, will have a net loss. They were sweet talked, they convinced themselves, and now they're trying to get you to validate their ignorance by signing you up and having you agree with them.Stuff Envelopes/ShopWe provide stamped envelopes that you simply fill and send to us!... Not quite... Full refund if you're unhappy of that pitiful processing fee!!... but you're only eligible to get the refund if you stuff 100 envelopes. You pay $x bucks. You get a package containing nothing but a letter. Basically they ask you to make your own paper advertisements based on the list of sponsors they have. You send them your advertisements for approval(if they bother responding), then ask you to flood all possible locations that you can, legally with ads like malls, parks, craft shows. If someone sends you a letter back, containing a self addressed envelope and asking for more information, you send it to the company and they send you back $x. They have the right to deny payment for any reason. Always read the terms and services, for example:The following is part of a terms and services agreement from a envelope stuffing site, in tiny text:"Interested people will respond to your ad or flier. They will send you a SASE, (therefore, you will be supplied with the already stamped and addressed envelope as promised). Insert our advertisements into the SASE, fold neatly and leave envelope flaps unsealed. Send these to us every week, along with the envelope each SASE was sent in, and your payment will be in the mail within 24 hours from the time we receive your secured envelopes. *Please remember that you must stuff one of each circular into each SASE you receive*. Your payment will include $12 for every envelope we received from you, whether the potential customer ever buys anything or not! Notice: Failure to follow these guidelines will void all payments and future participation in this opportunity. If we find envelopes to be forged or fraudulent in any way, you will not receive payment. We reserve the right to reject any flier or ad."From Envelopesathome: Terms of Service: www.envelopesathome.com/terms.phpAlthought it says we may not link this site in their terms(you'd wonder why), this section is protected by Title 107 of United States CopyrightLaws.http://www.copyright.gov/title17/92chap1.html#107Nigerian SpamYou're contacted though email by a very rich and important person in trouble. There are many people internationally scamming, some are even protected by the better business bureau in the United States, even though they target young emotional teens and the elderly like in the poetry.com scam where everyone is called a "semifinalist" in their international poetry competition. If you find a site that's questionable please use RipOffReport Search.Fortune Learning Systems FTC, Business Development Division, Max Elite Consulting These companies include, but are not limited toFortune Learning SystemsFLSACORN CORPORATE SERVICESOXFORD FINANCIAL, LLCBusiness Funding Division LLCICI SuccessICI ChargeICICHARGEE CoachOnline Success INCIVY CapitalIVY Capital IncETrainingCapitalGlobal Wealth BuildersNevada Corporate DivisionCorporate Credit DivisionBusiness Development DivisionWholesalematch.comThe Shipper, LLCIVY VianetMax Elite ConsultingMax-Elite ConsultingMy Essential PlansEnrich Wealth GroupMedia Learner, LLCTafiti Consulting, LLCEbiz Teacher, LLCDonkey Host, LLCWholesalematch.com SignsMost all scams we've seen require a registration free but promises to get you back the money within the first few days. File a small claims report at your local court house if they won’t let you.Pyramid ScamsBy far the most dangerous scams are pyramid scams. As soon as the money from new investors wasn’t enough to pay the older investors, the scam crumbled.Get paid to Fill Surveys, Read Emails, Review sitesThese are about the same thing. They only needed to pay out initially for publicity.Auto Surf, surf the webAuto Surf programs are increasingly popular. The bottom line here is you may get 30 people worth of work an hour, when you could have been making more content for your site, or working a regular job for money to be used on legitimate, targeted advertising.MLMMLM is a business model running off franchising. They claimed to be registered with the better business bureau and located in Illinois, when the domain was registered in India, to an Indian, who was calling me in Texas. They actually sell information on how to get these type of jobs advertising the max salaries of people who do it. Typists and data entry jobs are not in very high demand. You have to be able to type fast and accurately with at least a GED. The work varies and can be done in Mortgage companies, law firms, or medical organizations among others. It earns like 8 to 12 bucks an hour doing boring repetitive tasks in a company, which is not a big pay upgrade from saying hi to people in Wal-Mart’s. Virtual assistants help users in websites that have questions, such as in hosting companies or with credit cards. Again, the demand isnt amazingly high and the pay isn't as advertised. These companies include, but are not limited toFortune Learning SystemsFLSACORN CORPORATE SERVICESOXFORD FINANCIAL, LLCBusiness Funding Division LLCICI SuccessICI ChargeICICHARGEE CoachOnline Success INCIVY CapitalIVY Capital IncETrainingCapitalGlobal Wealth BuildersNevada Corporate DivisionCorporate Credit DivisionBusiness Development DivisionWholesalematch.comThe Shipper, LLCIVY VianetMax Elite ConsultingMax-Elite ConsultingMy Essential PlansEnrich Wealth GroupMedia Learner, LLCTafiti Consulting, LLCEbiz Teacher, LLCDonkey Host, LLCWholesalematch.com I've made money on X and it's not a scamThere's plenty of testimonials of people who have gotten money. If someone sends you a letter back, containing a self-addressed envelope and asking for more information, you send it to the company and they send you back $x. There are many people internationally scamming, some are even protected by the better business bureau in the United States, even though they target young emotional teens and the elderly like in the poetry.com scam where everyone is called a "semifinalist" in their international poetry competition. If you find a site that's questionable please use RipOffReport Search.Fortune Learning Systems FTC, Business Development Division, Max Elite Consulting These companies include, but are not limited toFortune Learning SystemsFLSACORN CORPORATE SERVICESOXFORD FINANCIAL, LLCBusiness Funding Division LLCICI SuccessICI ChargeICICHARGEE CoachOnline Success INCIVY CapitalIVY Capital IncETrainingCapitalGlobal Wealth BuildersNevada Corporate DivisionCorporate Credit DivisionBusiness Development DivisionWholesalematch.comThe Shipper, LLCIVY VianetMax Elite ConsultingMax-Elite ConsultingMy Essential PlansEnrich Wealth GroupMedia Learner, LLCTafiti Consulting, LLCEbiz Teacher, LLCDonkey Host, LLCWholesalematch.comSignsMost all scams we've seen require a registration free but promises to get you back the money within the first few days. They only needed to pay out initially for publicity.Auto Surf, surf the webAuto Surf programs are increasingly popular. The bottom line here is you may get 30 people worth of work an hour, when you could have been making more content for your site, or working a regular job for money to be used on legitimate, targeted advertising.MLMMLM is a business model running off franchising. It earns like 8 to 12 bucks an hour doing boring repetitive tasks in a company, which is not a big pay upgrade from saying hi to people in Wal-Marts. Virtual assistants help users in websites that have questions, such as in hosting companies or with credit cards. Again, the demand isnt amazingly high and the pay isn't as advertised. These companies include, but are not limited toFortune Learning SystemsFLSACORN CORPORATE SERVICESOXFORD FINANCIAL, LLCBusiness Funding Division LLCICI SuccessICI ChargeICICHARGEE CoachOnline Success INCIVY CapitalIVY Capital IncETrainingCapitalGlobal Wealth BuildersNevada Corporate DivisionCorporate Credit DivisionBusiness Development DivisionWholesalematch.comThe Shipper, LLCIVY VianetMax Elite ConsultingMax-Elite ConsultingMy Essential PlansEnrich Wealth GroupMedia Learner, LLCTafiti Consulting, LLCEbiz Teacher, LLCDonkey Host, LLCWholesalematch.comI've made money on X and it's not a scamThere's plenty of testimonials of people who have gotten money. If someone sends you a letter back, containing a self-addressed envelope and asking for more information, you send it to the company and they send you back $x. They only needed to pay out initially for publicity.Auto Surf, surf the webAuto Surf programs are increasingly popular. The bottom line here is you may get 30 people worth of work an hour, when you could have been making more content for your site, or working a regular job for money to be used on legitimate, targeted advertising.MLMMLM is a business model running off franchising. If someone sends you a letter back, containing a self-addressed envelope and asking for more information, you send it to the company and they send you back $x. Privacy as an Afterthought: ICANN’s Response to the GDPR

Almost three years ago, the global domain name authority ICANN chartered a working group to consider how to build a replacement for the WHOIS database, a publicly-accessible record of registered domain names. Because it includes the personal information of millions of domain name registrants with no built-in protections for their privacy, the legacy WHOIS system exposes registrants to the risk that their information will be misused by spammers, identity thieves, doxxers, and censors.

But at the same time, the public availability of the information contained in the WHOIS database has become taken for granted, not only by its regular users, but by a secondary industry that repackages and sells access to its data, providing services like bulk searches and reverse lookups for clients as diverse as marketers, anti-abuse experts, trademark attorneys, and law enforcement authorities.

The working group tasked with replacing this outdated system, formally known as the Next Generation gTLD RDS to Replace WHOIS PDP Working Group did not get far. Despite holding 90 minute weekly working meetings for more than two years, deep divisions within the group have resulted in glacial progress, even as the urgency of its work has increased. A key privacy advocate within that Working Group, EFF Pioneer Award winner Stephanie Perrin, ended up resigning from the group in frustration this March, saying “I believe this process is fundamentally flawed and does not reflect well on the multi-stakeholder model.”

With the impending commencement of Europe’s General Data Protection Regulation or GDPR on May 25, which will make the continued operation of the existing WHOIS system illegal under European law, ICANN’s board has been forced to step in. On April 3, members of the Working Group were informed that it had been “decided to suspend WG meetings until further notice while we await guidance from the Board regarding how this WG will be affected by the GDPR compliance efforts.”

ICANN Board Cookbook

With this, the Board has floated its own interim solution aimed at bringing the legacy WHOIS system into compliance with the GDPR. The ingredients of this so-called “Cookbook” proposal [PDF] are drawn from responses to a call for public submissions, to which EFF contributed [PDF]. In short, it would make the following changes to the WHOIS regime:

Although full contact information of domain name registrants will still be collected, most of this information will become hidden from public view, unless the registrant affirmatively “opts in” to displaying that information publicly. A tiered access model will be put in place to ensure that only parties who have a “legitimate interest” in obtaining access to a registrant’s address, phone number, or email address, will be able to do so.

Although email addresses will not be displayed in the public WHOIS data record, they will be replaced by a contact form or anonymized email address, which would still allow members of the public to make contact with a domain owner if they need to. (This idea is one of those that EFF had suggested in our submission, with the additional suggestion that the contact form be protected by a CAPTCHA to minimize the potential for misuse.)

No differentiation is attempted to be made between domains registered to individuals, and those registered to companies. This makes sense, because many company domain records do include personal contact information for individuals who act as the administrative or technical contacts for the domain. In practical terms, it would be impossible to weed out the entries that do contain such personal information from those that don’t.

The board proposal is an improvement on the status quo, but doesn’t go as far in protecting privacy as we would like it to. For example, it leaves it up to individual registrars as to whether they should apply these privacy protections to all domain owners worldwide, or attempt to limit them to those within the European Economic Area. It also contains a too expansive suggested list of acceptable purposes for the collection and processing of WHOIS personal data, including “to address issues involving domain name registrations, including but not limited to: consumer protection, investigation of cybercrime, DNS abuse, and intellectual property protection.”

The ICANN board’s Cookbook proposal was submitted to the European Data Protection Authorities, who come together in a group called the Article 29 Working Party, for consideration at its next meeting which took place on April 10-11. The board had hoped to receive [PDF] the group’s agreement to a moratorium of enforcement of the GDPR over WHOIS until ICANN is able to get its act together and establish its interim accreditation program. But the Working Party’s reply of April 11 [PDF] offers no such moratorium, and instead affirms that the purposes for data collection listed by the board are too broad and will require further work if they are to comply with the GDPR.

Another fundamental limitation of the Cookbook proposal is that while it sets up the idea that there should be an accreditation program for “legitimate” users, it leaves unanswered key questions about how that accreditation program should operate in practice, and in particular how it would assess the legitimacy of claimants seeking access to user data. Since there is not enough time to develop an accreditation system before May 25, the board floats the option of an interim self-accreditation process, which somewhat undermines the purposes of limiting access. The other option is that, by default, access to WHOIS data would “go dark” for all users, until a suitable accreditation system was in place.

Business and IP Constituencies Accreditation and Access Model

This prospect has disturbed stakeholders accustomed to receiving free access to registrant data; one goes so far as to describe the Cookbook proposal as “the most serious threat to the open and public Internet for decades.” ICANN’s Business and Intellectual Property constituencies have responded by proposing an accreditation and access model [PDF] aimed at keeping the WHOIS door open for three loosely-defined categories of actors: cybersecurity and opsec investigators, intellectual property rights holders and their agents, and law enforcement and other government agencies. It attempts to fill in the gaps of the Board’s proposal by suggesting how these users might be accredited.

The biggest problem with the Business and IP constituencies’ proposal is that the bar for accreditation to access full registrant data would be set so low that it would become essentially meaningless, while still managing to exclude the wider public and keep them in the dark about who might be viewing their personal data. For example, it would allow anyone who has registered a trademark to enjoy carte blanche access to the entire WHOIS database. In a token effort to prevent misuse of WHOIS access there would be random audits, but penalties for misuse might be limited to de-accreditation.

The proposal would structurally elevate the financial interests of intellectual property owners above the privacy and access rights of ordinary users. While the GDPR does allow data sharing that is necessary for the purposes of legitimate interests of third parties, these interests must be balanced with and can be overridden by the interests, rights or freedoms of the domain name registrant. This proposed accreditation and access model doesn’t even attempt to strike such a balance.

Although EFF would have preferred a model requiring a court order or warrant for access to such personal information, it seems inevitable that tiered access will be based on some kind of ICANN-administered accreditation system. Community discussions on what that accreditation program should look like continue on a new ICANN discussion list, using the Business and IP constituencies’ proposal as a starting point. But this is work that should have been finished long ago. The commencement date of the GDPR has been known since the rule was adopted on April 27, 2016. Although its edges will be difficult for ICANN to navigate, its basic outlines are not rocket science; it has been obvious for over two years that more would need to be done to secure the personal information of domain name registrants.

Unfortunately, ICANN’s version of a multi-stakeholder process has broken down over this contentious issue of registrant data privacy. It therefore falls to ICANN’s board to make the interim changes necessary to ensure that the WHOIS system is brought into compliance with European Union law. While this interim model may be replaced by a community-based access model in the future, institutional inertia is likely to see to it that the Board’s “interim” policy constrains the outlines of that future model. This makes it all the more important that the ICANN Board listens to all segments of its community, and to the advice of the Article 29 Working Party, in order to ensure that the solutions developed strike an appropriate balance between stakeholders’ competing interests, and that the human rights of users are put first.
