This nomos bears witness to the alliance between "Sirinos" and "Pyx" (the two legends appear engraved in the centre of obverse of the coin and in the lower quadrant on the reverse respectively). The word "Sirinos" was thought at one time to be the adjective relating to Siri, the city on the Ionian coast which was well known for its wealth and which was destroyed by the coalition of Sybaris, Metapontum and Croton in the years 570-560. Paola Zancani Montuoro, however, believes that the word in question is a noun and, for a variety of reasons, argues that a city called "Sirinos" (of the Sirini, a population from Lucania of which Pliny the Elder speaks in his "Naturalis historia" III 15, 97) existed and was situated about 30 km from Policastro. It has probably been identified in the ruins of a vast inhabited area on a rocky peak which stretches along the valley of Lauria near Rivello and which is still known as "The City". Policastro Bussentino is the modern name for "Pyx" (Pyxoes), the ancient Lucanian city (on the eponymous bay of Tirreno, now known as the gulf of Policastro, in the province of Salerno). The alliance of the two cities, based on commerce, testifies to Pixunte's importance for Sybari's commercial activity in the VI century (bear in mind that literary sources date its foundation by Micitus to 471). The bull looking backwards, and the coin's weight, are typical of Sybaritic coins.

Third generation BMW's 4x4 flagship

In 2002 the third generation model was introduced which saw the model move further up-market. Initially planned and developed under BMW ownership, the new generation was planned as an AWD flagship accompaniment to the E65 7 Series saloon, sharing many components and systems (electronics, core power units etc), and initially packaged to accommodate BMW's coming V8D and V12 power units as future range-topping models, to complement their own X5 model, a smaller, more sporting SUV.

 

In a concerted effort to improve the Range Rover's on road competence, ride and handling, and at the same time to achieve more predictable crash performance, it was decided to adopt a monocoque (unibody) construction and at the same time to move to 4-wheel independent air suspension. Air suspension allowed variable ride height to suit on and off-road conditions, and the crosslinking of the suspension elements achieved similar axle articulation to that available with the previous live axled generations. This was important to retain the off road excellence and the desired on-road improvements that were core to the marketing position of the new product.[4] [5] [6]

 

By the time of the launch, Land Rover was had been sold to Ford, after they purchased from BMW in 2000, as part of the splitting up of the Rover Group. As a result, these further engine derivatives were not included in the sale.

 

The initial years of Range Rover production came with the BMW M62 V8 petrol with 282 bhp (210 kW) and 6-cylinder diesel engines, although only the V8 gasoline was offered in North America.

  

Jaguar-based V8 power units

 

Conscious of the need for more power to keep up with the Range Rover's competitors, and reluctant to keep relying on BMW for power plants, Ford presided over the adaptation of engines from Jaguar (also Ford-owned) for Land Rover use. A 4.4-litre, 305 hp (227 kW) version of the Jaguar 4.2-litre V8 was developed and first used in the new 2005 Discovery/LR3 model, temporarily giving it more power than the Range Rover. At the 2005 Detroit Motor Show, a major update of the Range Rover was unveiled, with the base model using the LR3/Discovery 3 engine, and a premium model using a supercharged version of the Jaguar 4.2-litre V8 developing 400 hp (300 kW)—the same engine slated for the new Range Rover Sport (the RRS model uses a detuned variant making a total of 389 bhp), scheduled for introduction about the same time (mid 2005) as the updated Range Rover.

 

Both engines are lightweight aluminium alloy units, with advanced torque-based engine management systems that, together with drive-by-wire throttle control and variable camshaft phasing (on the 4.4-litre version), continually adjust the engine to deliver optimum performance. Both the engines are specially adapted by Land Rover for better low speed torque characteristics (important in off-road driving), the ability to run at the extreme angles encountered off road, improved protection from dust and rocks, and improved sealing needed for wading.

  

Model year & facelift activity

 

The Range Rover's exterior was updated for 2006 along with the BMW V8 replaced with a Ford unit. The new engine choices were Jaguar's AJ-V8, with 4.4 L 300 hp (227 kW) or 4.2 L 400 hp (298 kW) supercharged variants. This new Range Rover was officially presented at the 2005 North American International Auto Show and released in summer 2005.

 

From the Diesel engine of the 2006 model (at this time still the BMW 6 cylinder unit) to the supercharged V8, the car could reach 60 mph (97 km/h) from 14.8 seconds or as little as 6.5 seconds and has a top speed from 110 mph (180 km/h) to approximately130 mph (210 km/h) (governed), respectively.

 

In addition to the engine change, the 2006 Range Rover is equipped with an updated "infotainment" system. This includes a touch screen with on and off-road navigation, radio, CD, Satellite Radio (US), telephone, rear view camera, a wireless video camera system and other additional features all accessed via the same user interface. The audio system is Harman Kardon Logic7 surround sound. Also available is a DVD rear seat entertainment which is fully integrated.

 

This system is linked by an industry-standard fibre optic network known as Media Oriented Systems Transport or MOST and an electronic network system known as CAN. A similar system is also used on Land Rover Discovery and Range Rover Sport.

 

Suppliers for the 2006 Range Rover's components include Continental Automotive for the complete cockpit module which incorporates the DENSO Corporation touch screen navigation unit. Continental also supply the centre console unit. Other suppliers include Alpine car audio for integrated head unit rear seat entertainment. Connaught Electronics Limited (CEL) provides the rear view camera (RVC) and wireless camera (VentureCam) systems and PTI telephone capabilities are provided by Nokia.

 

Most importantly the audio system is has been co-developed with Harmon Kardon. The premium offering gives a 720W, 14-speaker system and was the first OEM vehicle to use the discrete Logic 7 surround algorthim.

 

For 2007, all of the Range Rover's changes were mechanical or interior. On the inside, the hidden folding cup holder that popped out of the centre console in previous models was replaced by a simpler and more durable in-console design with sliding covers — similar in concept, but higher quality, to those in the Range Rover Sport. The ignition switch was moved from the lower-part of the centre console up to the dashboard, next to the steering wheel and the Range Rover received the Range Rover Sport / LR3's Terrain Response system as well as a redesigned four-wheel drive control panel. The handbrake is now electronic. Additionally, the seats differ from the old style, slightly resembling the new Range Rover Sport with cooling fans optional on the HSE and standard on the Supercharged. Heated seats are standard across the board and the premium seats from the BMW era are no longer available. The HVAC system was also updated with more vents and quieter operation. That, along with the acoustic laminated windscreen will lower driving noise. An increase in interior storage is mainly attributed to the new split-dual glovebox. And then in a return to original Range Rover styling, more wood inserts have been added to the doors and centre console. Mid-way through production of the 2007 model (around production date of January 2007) the style of the key was changed from the BMW design to Land Rover's current "switchblade" type.

 

The 3-litre BMW I6 diesel engine was replaced for 2007 with Ford's new 3.6 L AJD-V8. This engine develops 272 hp (203 kW), far more than the 177 hp (132 kW) of the previous engine, and so is better capable to deal with the weighty vehicle. Other changes for 2007 include better brakes, a revised suspension, and Land Rover's Terrain Response system. Supercharged Range Rovers will also use an electronic rear differential. The interior was also refined, with optional cooled front seats and more cargo capacity.

Our History...

Albany Steel & Brass Corporation was founded in 1918 by Eugene "Jake" Lebovitz, a Hungarian born immigrant. He sought refuge in America to escape both religious persecution and the life of poverty in which his family had existed. Today, Albany Steel is one of Chicago's oldest and most progressive family businesses, distributing fastening products, construction and industrial supplies. Albany is presently managed by the third generation of this family, David Lebovitz. However, many things that originally made this business successful still remain the same today. True dedication to provide its customers with high quality products, promptly delivered at competitive price levels, are the principles on which this 79-year-old business continues to operate. While originally a "ma and pa" hardware store catering to the local neighborhood residents, Albany's markets include OEM, MRO and construction in addition to wholesaling a rather unique line of tapping screws, special wing nuts, thumb screws and the nation’s largest inventory of Swageform® thread rolling screws. Customer managed inventories, along with special customized reporting, are becoming part of Albany’s everyday business. Gone are the days of cutting and threading pipe, glazing window sash, and cutting keys - - - but the service and customer interest still remain keen and attentive. Phone lines that open at 7:00 A.M. and a service counter that operates 6 days a week, coupled with a fully integrated computer system offering EDI and remote customer order entry, allow efficiencies necessary to serve the ever increasing demands of today's customer.

 

David Lebovitz, the grandson of the founder, proudly relates the history of how his grandfather borrowed $250.00 in 1918 to purchase the store front operation from a retiring neighboring retailer. Thus, sprung Lebovitz Brothers Hardware. David's grandfather had learned a trade as a youngster in Hungary and was eager to own his own business and be his own boss. He worked in the Chicago Stockyards for several years as a "tinner" making specialized sheet metal products for this then thriving industry. He grew progressively disenchanted with the long 12 hour days and low wages and yearned for the opportunity that this new land had promised. After all, if you had to walk 6 miles to work to save five cents for the streetcar, you may as well do what you do best for yourself. With the savings of his wife Fanny, a self-employed seamstress and Jake's only "real" boss (a small lady, 4' 10" who was the only person ever to strike fear in his heart), this entrepreneurial venture commenced in 1918. The hours continued to be long, twelve hours a day, seven days a week. Living above the store, it was not unusual to receive "after hours" requests. A big day was $30.00 - - no credit cards, mainly cash but "running" charge tickets were begun in the late 1920's for the "industrial" accounts. Some original sales journals have endured through the years as well as the original receipt for the purchase of the business from a Mr. J. C. Wirths. This memorabilia, as well as several scrapbooks, is often shown to visitors and guests who have an opportunity to visit the corporate headquarters.

 

Feeling that the success of their children would depend strongly on education, Eugene and his wife insisted that their children's education lead to college degrees. The oldest child, a son Alexander, attended Northwestern University and later John Marshall Law School, passing the Illinois State Bar only to have his professional career interrupted by World War II. "Al" had always enjoyed the hardware business, especially the industrial aspect and had hopes of making his father's business more of an industrial mill supply. This opportunity came following a 3-1/2 year tour of duty overseas with the U. S. Army.

 

The return to a peaceful post-war economy brought all kinds of renewed demand for industrial products. Housing, automobiles and durable goods were needed to provide a whole new lifestyle for the victorious U.S. The factories surrounding the environs of Lebovitz Bros. Hardware were no exception to this onslaught of orders. Tools, fasteners and shop supplies were necessary for all businesses. Meanwhile, the local families improved their residences with newly painted rooms, improved wiring and plumbing.

 

It was in the early 1950's that Al Lebovitz recognized the increasing demand for threaded fasteners. At the time, the domestic fastener industry was flourishing and many manufacturers sold through selective distributorships. Many of Lebovitz's customers manufactured metal related products and the need for Types "A" and "Z" (now called type B) was extremely high.

 

Coincidentally and contrary to the economy, Albany Steel & Brass Corporation, a Parker-Kalon distributor, had fallen upon hard times due to an aging management with no apparent heirs. Despite Albany Steel being on the verge of bankruptcy, Lebovitz Bros. purchased all the assets and the liabilities with the understanding that all old debt would be retired with a 2% cash discount applying even to the mostly overdue invoices. Among Albany Steel's suppliers was Parker-Kalon, the originator of the sheet metal screw. (Incidentally, Albany Steel had been Parker-Kalon's first distributor and remains today as one of its oldest and largest distributors.) In the days when Parker-Kalon manufactured all kinds of fasteners including socket screws, thumbscrews, wing nuts, wing screws, screwnails and pipe plugs, Albany was known to stock "every size in the book." Most of these items continue to be stocked today; many continue to be made by Parker-Kalon.

 

Albany's current inventory consists of over 25,000 sizes ranging from 00 through 2" diameter in all materials including exotic metals. All items are fully lot traceable. Unlike the quarter or eighth keg quantities that have been developed based on what fit in the box, all products are sold in quantities as requested by the customer. The entire inventory is maintained in a 30,000 square foot warehouse. Plans are being made for a Winter groundbreaking that will add an additional 27,000 square feet of warehouse, showroom and parking. This will allow Albany to even better serve its ever growing list of industrial, construction and MRO customers.

 

While all companies must establish and maintain a strong balance sheet, the present management under the direction of President David Lebovitz, (son of the former Chairman Alexander who passed away in 1987) believes the company's greatest assets lie within its employees, customers and suppliers. "We have a wonderful group of experienced and dedicated people. Our management team is very experienced and energetic with a mean age in the mid forties. Over 200 years have been accumulated among our top managers alone. Our customer base has a lower than average turnover. Each customer, as is each employee, is welcomed with the thought that they have made a lifetime decision". Albany still has its very first charge customer who has done business with all three generations.

 

"We are a very informal company", says David Lebovitz whose normal attire is blue jeans and sneakers. "We are functional not fancy. The products we sell often require demonstrations. We encounter all kinds of conditions in the various factories and construction sites upon which we call. We want our customers to know that we're here to do a job for them - - - not just talk about it".

 

"Systems selling" remains a priority for this unique distributorship. Albany currently belongs to two major trade associations, STAFDA (Specialty Tools & Fasteners Distributors Association) and NFDA (National Fastener Distributors Association). In addition to these two (2) leading associations, Albany has been welcomed as one of only two (2) Chicago companies to become a member of the Evergreen Marketing Group. This premiere organization consists of less than 100 industrial/construction suppliers. It is recognized as the industry leader in promoting total customer satisfaction and extremely close partnerships with all of its business partners. Membership is by invitation and only extended to a select group demonstrating customer commitment and a strong financial backbone. This tells both their customers and suppliers that turnkey service is always provided. Situations where a fastener problem implicates an incorrect installation tool are easily remedied. Similarly, the proper anchor or insert can easily be suggested to match an existing installation tool. The customer is provided with TOTAL support and soon develops complete confidence in ALBANY'S ability to service all of their fastening requirements.

 

The caption on their catalog says it all; "We are a customer oriented distribution center for high quality fastening products and related items". This certainly describes Albany's operational style! They only know how to do things for their customers with a sense of total commitment. "Whether the sale requires engineering, blanket orders, bin programs and managed inventory, contract pricing, or a structured finance plan for a capital piece of equipment, we are willing to listen and implement a solution totally satisfactory to our customer. "Just in time" has been in our company for 79 years" says David Lebovitz. Too much rhetoric has been devoted to just an old fashioned simple concept of taking care of the customer. Our customers are simply used to calling, faxing or now through EDI, entering an order for immediate pick-up or next day delivery."

 

While David Lebovitz candidly admits he somewhat misses some of the aura of the old local hardware store, he cannot be disappointed with the fine position his company has taken in the Chicago market. He still remembers where the roots of his company were planted and continues to manage along the principles of people working with other people. While David's 21 year old son, Andy, continues to pursue his doctorate in Chemical Engineering, there is much hope that Albany Steel & Brass will continue to prosper under the direction of the fourth generation!!

 

Some history on Bright Star Battery Co.....

 

An immigrant from Odessa, Russia by the name of Isadore (Israel) Koretzky, the founding father of Bright Star, arrived at Ellis Island some time prior to 1909 and shortly thereafter obtained a job with the Manhattan Electric Company, a manufacturer of dry cell batteries. Their battery products were marketed under the trade name, Red Seal. In his spare time Isadore developed some battery improvements in the basement of the tenement house in which he lived on Brite Street in New York City. As was not uncommon in that era he decided to break away from his employer and founded his own battery making operation in 1909.

 

Koretzky fabricated the name of his company from a combination of the name of his street and a saying that his batteries produced a light like a star from heaven. Therefore he named the company, The Bright Star Battery Company. Legend has it that he would manufacture a batch of batteries one night, test them the next night, cull out the bad ones, then the third night put the good ones in a push cart and sell them to the shop keepers in the area of his small basement factory.

 

Bright Star pioneered the high impact injection molded flashlight in the late 1930s, played a prominent role in the creation of the MX type military flashlight and spearheaded the development of standards for explosion proof handheld lighting products. During World War I and World War II the company enjoyed a large volume of government business in both flashlights and batteries. After World War II Bright Star expanded its flashlight business to become a worldwide leader in the production of industrial flashlights and lanterns. Over the same period, its battery business continued to grow, as Bright Star became a full-line supplier of high-quality carbon-zinc industrial batteries.

 

In recognition of Bright Stars accomplishments in the area of export, it has received the U.S. Department of Commerces highest award for export excellence by American companies. In 1961, the President of the United States created the E award to afford recognition to companies that contribute significantly in the effort to increase U.S. exports. In 1974 Bright Star received the E award and in 1986 it received the E Star award for continuing export excellence.

These are the guts of the awesome new computer I built last month.

 

For the past few years I've been using a discarded computer from work, which was a 3 GHz HyperThreaded Pentium 4 with 1 GB of DDR RAM. I think it was manufactured in 2004, maybe as early as 2003. Ouch. 18 months ago I built myself a SageTV HTPC, and 18 months before that my Ubuntu VMware Server (and now VirtualBox) "server", but my own workstation has been neglected. It finally came to a point where I just couldn't take it any more, suffering through all the slowness and not having enough memory to run many applications at once (I couldn't even have Winamp open while I worked, RAM was so scarce!), so it was time to build myself a proper workstation. The last two computers I've built I suppose could be classified as "budget PCs", though they do their job well and still incorporate quality components, it's just I don't see the need to blow $1000 on a computer when a $500 one will do (you pay quite a premium when you insist on the "latest and greatest"). This time, though, I wanted something better, partly because I want the system to last a while but mostly because I think the extra horsepower is entirely justified and deserved (computers are my life, after all).

 

Knowing that pretty much any reasonably modern system I'd build would blow my old one out of the water, I am very happy with what I was able to come up with. I think it bumps it's head on the "if you spent any more on this you wouldn't be getting your money's worth" ceiling, I was able to get great components at good value without paying for more than I need, and even I am surprised at how fast it is. It's absolutely amazing to be able to have Pidgin, RSSOwl, Thunderbird, numerous tabs in Firefox, (Azureus) Vuze, and Visual Studio 2010 on one monitor while VideoLAN Client is de-interlacing 1080i video on the other monitor, and all with barely noticeable processor usage. Well done, self!

620W SeaSonic S12II ($79.99 @ NewEgg):

This might be my favorite purchase, aside from the processor. My other two computers use SeaSonic S12s (SS-550HT), and I've been very happy with them; they seem to be high quality units and I especially like the energy efficiency. I wanted to get an 80 Plus Silver power supply, but that would have cost me 50% more. This is an 80 Plus Bronze unit, which is still more efficient than the two I have. The price is great, it got sparkling reviews, and it features a veritable Medusa of power connections.

GIGABYTE GA-P55A-UD3 ($139.99 - $10 mail-in rebate @ NewEgg):

My least favorite purchase. I figured I might as well get a motherboard with USB 3.0 and SATA 3.0, and there just weren't many in my price range to choose from. It also would be nice if it included Firewire or eSATA ports, and I do not understand why a modern motherboard needs three PCI slots; I'd rather trade one of those for another PCI-Express slot. This is my third GIGABYTE motherboard and I've never had any issues with them and they seem to pretty good in terms of quality, so I guess it's alright.

Antec Nine Hundred:

GIGABYTE GV-N240D5-512I ($89.99 - $20 mail-in rebate @ NewEgg):

I knew going into this that I did not want to spend more than $100 on a video card, let alone $300. I almost went with an ATI card that had decent performance and low power consumption, but then I found this one that cost less, was slightly less perfomant, and had even lower power consumption (the lowest of any modern card on the market, in fact).

2 × 2 GB G.SKILL ECO Series DDR3-1600 CL8 SDRAM ($119.99 @ NewEgg):

This is pretty cool. It's special RAM that's designed to run at lower voltages than normal (ie 1.35V instead 1.5V or higher). I did the math and figured this could save me about $5 a year in energy costs, and I paid an extra $15 for it...but I don't really care. Reviews put its performance on par with special "gaming" RAM and it's energy efficient, so I don't mind chipping in a little more for that.

64-bit Windows 7 Professional ($124.99 @ NewEgg):

This is an OEM license, though that doesn't really mean anything for me other than the fact that it costs about a third less than retail. This is the first computer I've built that will be *cough* legal from the very start, and it's so nice to not have to worry about using activation cracks or anything like that.

Intel Core i7 860 ($199.99 + ~$20 Cook County tax @ MicroCenter):

First I had to decide between this and the Core i7 930; the 930 costs the same, has the same clock speed and cache, would have required a much more expensive motherboard, and reviews consistently showed consumed more power while providing worse performance, so that was an easy choice. Then it came down to this and the Core i5 750, which was slightly slower, had slightly less aggressive TurboBoost, cost $50 less, and lacked HyperThreading; the hard part was figuring out if HyperThreading was worth the added expense.

 

While I was chewing on that, AMD released their hexa-core Phenom II X6 "Thuban" processors. As much as I was salivating over a quad-core processor, hexa-core would seem even better, right? Well, perhaps not. The 1090T cost $75-100 more than the Intel 750/860, consumed more power, and featured 50% more cores all clocked 500 MHz faster...and, yet, reviews showed it was not markedly faster or actually even slower than the Intel 750/860. And then consider that I wouldn't have bought a 1090T but rather a 1050T, which meant it would have been even slower still all the while costing about the same as the 750/860. The one thing I was unsure about was whether the Thuban just had disappointing performance or the benchmarks simply weren't able to take advantage of all of its cores...but, in the end, Intel looked like the better choice and I figured I might as well spring for the Core i7. This decision was made even easier when I discovered a local retailer called MicroCenter that had processors much, much cheaper than NewEgg (which almost never happens), and even with sales tax it still came out a lot less. Good deal! (The other thing I'd add is that next highest model - the Core i7 870 - cost twice as money for an additional 133 MHz of clock speed. So, 100% more money for 4.75% more performance. That's when you know you're getting the most bang for your buck!)

 

Including tax, shipping, and rebates, the total for all the hardware comes to $620. Including the Windows 7 license that's $745. I could have used an old case from work, but if you count the one I did use that's another $60, so $805. I already had a mouse, keyboard, monitors, speakers, hard drives, and removeable drives, but that'd probably have been at least another $200 if I needed those components. The processor, it turns out, was free, as it was an unannounced birthday gift; three weeks belated, yes, but for a gift of that size I can't complain (and it certainly makes me glad I opted for the more expensive processor!).

"Maybe I was unlucky, and just got a bad one, but results from this Sigma 18-35 were very poor. Full aperture tests were very, very soft - especially at the wide end. Stopped well down performance was just about OK, but not nearly as good as most Sigmas I’ve owned. Build quality is fairly lightweight, lots of plastic, but perfectly useable. Sigma make lots of excellent lenses, but it appears this just isn’t one of them.

 

In short I’d say the Sigma 18-35mm f3.5-4.5 is best avoided. As a cheap wide option the Tokina 19-35 is much better.

I bought the second version of this lens (18-35 /f3.5-4.5) in 1994 and I absolutely love it. The lens is lightweight, sharp as a tack, covers a very useful range of focal lengths, and is one of the very best "travel photography" lenses that I have ever used. I recently had the opportunity to try out the newer third version Sigma 17-35/f2.8-4.0 EX Aspherical and it is an even better lens. The first version was a 21-35/f3.5-4.2 (available in the U. S. in 1992) weighed 19 ounces, and was a super performer. The latest version weighs 14 ounces (which is four ounces more than my lens) but the half an f-stop speed gain and the 1mm addition at the wide end easily account for this moderate additional weight. Both the second and third versions of this lens (I never had the opportunity to use the first version) produce some of the sharpest slides I have ever seen from a zoom. Viewed under a 6x Schneider loupe the images are tack sharp with virtually no linear distortion or color fringing. The performance of this lens equals the performance of similar OEM lenses, and at a significant discount.

 

The lens has depth of field scales (a valuable feature in computing hyper focal distance, and one that is missing from almost all AF lenses) the focus and zoom rings are large and well damped, manual focus is easy and smooth as silk. The AF is fast, accurate, and quiet. Optimum aperture appears to be f8. A small caveat here, this lens is a super performer throughout its range, however like most wide angle zooms there is some loss of image quality at the smallest apertures. I wouldn’t use the lens at f32, but from f2.8 through f22 images are sharp, contrasty, and color balance is superb. "

 

" I used the second version of this lens to shoot a photography job for AAFES (Army & Air Force Exchange System) in Japan. AAFES was trying to get funding to expand one of their PX's in Okinawa. They had a great written proposal with all the facts laid out beautifully, but they wanted some some slides to show the congressional appropriations committee. The Regional Manager asked me if I could somehow make the store look smaller, in the photographs, which would improve their chances of getting the expansion funded. I used the Sigma 17-35 to exaggerate perspective, in some of the images, I shot PX employees at work from a low viewpoint making them seem larger and the store behind them seem smaller. In the warehouse area I shot from a higher viewpoint (standing on a step ladder) with the plane of focus absolutely level, to exaggerate the sense of crowding and lack of space (it appeared that the area was filled floor to roof) by shooting from a higher perspective the passageways appeared dark, clautrophobis, and very narrow. Everyone liked the pictures and AAFES ended getting three million bucks to expand the PX.

 

I have recommended the earlier version of this lens to my workshop students since 1994, I have no qualms about recommending this newer version as well. The Sigma 17-35/f2.8-4.0 is best suited for general photography use by professional and advanced amateur photographers. This is a fantastic travel photography lens, with a fast maximum aperture, lightweight, a wide “useful” zoom range, great ergonomics, and excellent resolution. The AF is quiet, fast, responsive, and accurate. It is unlikely that you will find a better lens in this range for the price ($450-$500) The only downside to the lens is the fact that after market lenses (those made by someone other than the "Original Equipment Manufacturers....Nikon, Canon, Minolta, and Pentax)don't retain their value when it comes time to trade or sell.

Knowing that pretty much any reasonably modern system I'd build would blow my old one out of the water, I am very happy with what I was able to come up with. I think it bumps it's head on the "if you spent any more on this you wouldn't be getting your money's worth" ceiling, I was able to get great components at good value without paying for more than I need, and even I am surprised at how fast it is. It's absolutely amazing to be able to have Pidgin, RSSOwl, Thunderbird, numerous tabs in Firefox, (Azureus) Vuze, and Visual Studio 2010 on one monitor while VideoLAN Client is de-interlacing 1080i video on the other monitor, and all with barely noticeable processor usage. Well done, self!

620W SeaSonic S12II ($79.99 @ NewEgg):

This might be my favorite purchase, aside from the processor. My other two computers use SeaSonic S12s (SS-550HT), and I've been very happy with them; they seem to be high quality units and I especially like the energy efficiency. I wanted to get an 80 Plus Silver power supply, but that would have cost me 50% more. This is an 80 Plus Bronze unit, which is still more efficient than the two I have. The price is great, it got sparkling reviews, and it features a veritable Medusa of power connections.

GIGABYTE GA-P55A-UD3 ($139.99 - $10 mail-in rebate @ NewEgg):

My least favorite purchase. I figured I might as well get a motherboard with USB 3.0 and SATA 3.0, and there just weren't many in my price range to choose from. It also would be nice if it included Firewire or eSATA ports, and I do not understand why a modern motherboard needs three PCI slots; I'd rather trade one of those for another PCI-Express slot. This is my third GIGABYTE motherboard and I've never had any issues with them and they seem to pretty good in terms of quality, so I guess it's alright.

I actually purchased this last year, so I'm not including it here!

GIGABYTE GV-N240D5-512I ($89.99 - $20 mail-in rebate @ NewEgg):

I knew going into this that I did not want to spend more than $100 on a video card, let alone $300. I almost went with an ATI card that had decent performance and low power consumption, but then I found this one that cost less, was slightly less perfomant, and had even lower power consumption (the lowest of any modern card on the market, in fact).

2 × 2 GB G.SKILL ECO Series DDR3-1600 CL8 SDRAM ($119.99 @ NewEgg):

This is pretty cool. It's special RAM that's designed to run at lower voltages than normal (ie 1.35V instead 1.5V or higher). I did the math and figured this could save me about $5 a year in energy costs, and I paid an extra $15 for it...but I don't really care. Reviews put its performance on par with special "gaming" RAM and it's energy efficient, so I don't mind chipping in a little more for that.

64-bit Windows 7 Professional ($124.99 @ NewEgg):

This is an OEM license, though that doesn't really mean anything for me other than the fact that it costs about a third less than retail. This is the first computer I've built that will be *cough* legal from the very start, and it's so nice to not have to worry about using activation cracks or anything like that.

Intel Core i7 860 ($199.99 + ~$20 Cook County tax @ MicroCenter):

First I had to decide between this and the Core i7 930; the 930 costs the same, has the same clock speed and cache, would have required a much more expensive motherboard, and reviews consistently showed consumed more power while providing worse performance, so that was an easy choice. Then it came down to this and the Core i5 750, which was slightly slower, had slightly less aggressive TurboBoost, cost $50 less, and lacked HyperThreading; the hard part was figuring out if HyperThreading was worth the added expense.

 

While I was chewing on that, AMD released their hexa-core Phenom II X6 "Thuban" processors. As much as I was salivating over a quad-core processor, hexa-core would seem even better, right? Well, perhaps not. The 1090T cost $75-100 more than the Intel 750/860, consumed more power, and featured 50% more cores all clocked 500 MHz faster...and, yet, reviews showed it was not markedly faster or actually even slower than the Intel 750/860. And then consider that I wouldn't have bought a 1090T but rather a 1050T, which meant it would have been even slower still all the while costing about the same as the 750/860. The one thing I was unsure about was whether the Thuban just had disappointing performance or the benchmarks simply weren't able to take advantage of all of its cores...but, in the end, Intel looked like the better choice and I figured I might as well spring for the Core i7. This decision was made even easier when I discovered a local retailer called MicroCenter that had processors much, much cheaper than NewEgg (which almost never happens), and even with sales tax it still came out a lot less. Good deal! (The other thing I'd add is that next highest model - the Core i7 870 - cost twice as money for an additional 133 MHz of clock speed. So, 100% more money for 4.75% more performance. That's when you know you're getting the most bang for your buck!)

 

Including tax, shipping, and rebates, the total for all the hardware comes to $620. Including the Windows 7 license that's $745. I could have used an old case from work, but if you count the one I did use that's another $60, so $805. I already had a mouse, keyboard, monitors, speakers, hard drives, and removeable drives, but that'd probably have been at least another $200 if I needed those components. The processor, it turns out, was free, as it was an unannounced birthday gift; three weeks belated, yes, but for a gift of that size I can't complain (and it certainly makes me glad I opted for the more expensive processor!).

Here’s the latest transcript of the motivating interview with Director of Operations at Morgan Motor Company, Britain’s sole surviving car manufacturer.

 

Steve has a wonderful personal attachment to Morgan, having started as an Apprentice on the production line, before pushing on to becoming to his current role as one of the Directors for the organisation.

Welcome back to episode 23 of the Maximise Potential Podcast and our second instalment from the Morgan Motor Company. Following on from our interview with Head Designer Matt Humphries featured on episode 21 we now have the pleasure of interviewing Director of Operations Steve Morris. Steve has a wonderful personal attachment to Morgan having started as an apprentice on the production line before pushing on to his current role as one of the Directors for the organisation. He has seen as he calls it an evolution at Morgan that has witnessed every corner of the business being radically overhauled throughout the last decade propelling it to become one of the most innovative independent car producers on the globe.

 

Here is Steve to tell you the complete story in his own words.

 

So Steve we are sitting today in this wonderful almost 100 year old Morgan factory and we are going to talk about a whole range of subjects to do with managing, producing Morgan’s and the challenges, and I will call them challenges, that you have and the balancing act that you have to achieve overseeing the whole production which you do. But lets start off by maybe dispelling a few myths about Morgan because there are still a lot of people when I talk to them about Morgan’s that they still remember six and seven year waiting lists and various other things. So it would be really handy I think if you could just go over some of those points and help people understand what Morgan Motor Company is now as an entity and maybe we will see where the discussion goes from there.

 

Steve: As you say there are a number of myths with Morgan and the waiting list is probably the biggest myth, the biggest single myth. I think if you look back over 10 years, 10 years ago we would have had an average of 100 cars work in progress at any one time with something like nine cars a week manufactured, six year waiting list was the myth, it was never quite that wait anyway. That was always, it was market specific to start with. It was geographical; it was dealer specific for instance back in those days you could get a car in Europe quicker than you could in certain parts of the UK. Interestingly enough if you went to what would have been our local dealer he was quoting the longest waiting list. And it was really all based on the number of cars they were allocated and the number of sales they had. However we looked at it and I say Charles really one of his key drivers was taking what were we loosing at a business. Because it was a myth we were probably loosing as much as we were gaining on sales. So I think we really attacked it and said okay what do we need to do to get this right. So we looked at the structure of the way the cars were being sold, we looked at how we were building and really took a demand profile from that and just gentle organic growth over the last few years. To achieve that there needed to be a lot of things looked at certainly the way we were building the car, the way it was all set up, the work in progress levels.

 

Actually the complete infrastructure of the way the guys were being paid so we were at that time we were on a piece work system. So if you look at any Japanese manufacture and the way they set up is on a pull system, so you pull the products and the parts you want at the right time. Piece work is a typical push system so you are just pushing in lots and lots of product but is it the right product. Nine times out of ten no it is not you are taking, if a job is deemed to be a good job from a financial point of view to the individual you might be making lots of those but if something you need is not such a good job financially you wouldn’t be making lots of those. So we even went through to looking at the wage system and the way we were rewarding people in the factory. Which had a massive impact on what we were gaining from a car point of view. So we were making the right parts at the right time in the right quantity.

 

Kevin: And how long did that process take you I mean because that must have been a hell of a project?

 

Steve: It was and to be honest with you where we were at that point it was just an evolution, low staff turnover, a slightly aging workforce therefore you had the guys almost dictating the pace. Well they were dictating the pace of the factory. I mean when I was serving my apprenticeship it was a known thing you, the workforce dictated the number of cars which is today in today’s modern environment just seems a really odd thing to talk about but I am sure there is a lot of businesses that have been through the same issues.

 

Kevin: And I suppose the nature of your business as well because I mean you know I refer to the people that build Morgan’s they are all craftsman because you are working with such traditional materials and there is so much, you know so much of a bespoke nature to your products. So I guess you can understand why it wasn’t just seen as just a standard workforce and that people are being seen as they are creating a piece of art far more than just a commercial product.

 

Steve: Yeah very much so and I think 10 – 15 years ago we were seen by the world as just a very much a craft based business. It was very craft orientated, very, very clever, very skilled which it still is. The difference today is you have got a lot more technology applied with the craft. But it was interesting that that was one of the biggest issues we had to tackle. When you are looking at any system was the black art and all of the craft side of things to try as with any business you cant manage what you don’t measure so you have to measure it to manage it to understand what your cost of sales are going to be and how you are going to get to that end product.

 

That was one of the big issues and big culturally I mean that took, that really took probably a couple of years, two years from concept through to execution of that system took a couple of years whilst we were looking at levels of work in progress, the way the car was being built, the way the product flows through the factory. At the same time it sounds quite bizarre but at the same time we were also improving materials in the vehicle, the quality of the vehicle so there was a lot. It has been a busy sort of 10 years.

 

Kevin: You touched on the factory there and when I look at Morgan’s factory or factories and you know the overall plant this is about as far removed from a Honda or a Toyota or a Nissan that you could ever imagine. Morgan’s strength is its history but I also imagine that with that is its weakness as well because I mean you are still operating from the original sort of factories, individual factories that were built and added on one at a time over the last 100 years so you are dealing with an environment that must be extremely difficult to actually manage that flow and that process within. I mean how have you coped with that?

 

Steve: It is, it has been difficult. I mean as you look at the factory now we have built another whole department for the area, we have built a new paint shop but if you just put that to the side for one moment taking the main factory 10 – 15 years ago the car was built in, if I replicated to you today what we were doing 10 years ago you would look at it and think we were completely mad. Yet as I say it was just that evolution of just the way the whole thing had evolved over previous sort of 90 years and when I think today what we were doing, how we were moving cars, how we were moving parts it is just a massive difference to what we do today. If you started with a blank canvas would you do it the way we do it – no you certainly wouldn’t you would streamline again and have different line side structures and different bonded warehouse structures which would drive the flow of the cars different. But we have got today we have used. We are on a hill, we have used gravity as the feeder for the line so you start off with a, you know either an aluminium tub for the Aero Super sport or Aero range products. Or you start off with a galvanised chassis for the classic cars. You then end up with a rolling chassis and it rolls downhill. 10 years ago the car used to start at the bottom of the factory push up the hill then roll down to one shop and then push back up to another. We did a ball of string exercise and that probably as simple as you could be with it yet as effective as you need to be. So if you just roll a ball of string out and then measure how far you are moving the car which is quite a raw way of doing it but it just proves a point.

 

Kevin: But I guess it gets you as efficiently as possible from A – B to C – D.

 

Steve: Yeah and like the stocking of components. If you think there are 1000s and 1000s of components going to each vehicle it is a planning nightmare to try and make sure you plan your systems around your vehicles. And we used to learn, I learn every day, I look at the way the factory is laid out, look at some of the things we do and you learn something, you look at something on a daily basis and think um I could perhaps lets just try that that way and we are constantly changing which I think is probably a good thing because I think change means you are always looking at it and always questioning where you are and what you have done.

 

Kevin: With regards to constantly changing and constantly challenging yourself to improve it even further I guess the staff pay a huge part in that because you know they are the guys actually fitting the car, putting it together. So would you say a big chunk of the orientation of how you push stuff is very much consultative and very much just staying in touch with the team, talking with them and gaining their experience and their hands on approach. I mean how does it work?

 

Steve: Very much like you just said. I did an apprenticeship so I worked my way through the shop floor and understand how the car goes together and spend high parts of my day and week and year in the workshops looking at how the jobs have been done and I very much work personally with the whole team at Morgan very much along the lines of I am prepared to muck in and have a go and understand what their challenges are on a daily basis. How it happens, what problems they might have, what benefits they would have if I looked at it their way. So it is very, very consultative and we very, very rarely have to impose anything because we, I would like to think that we have got a workforce that if I ask for something to be done in a certain way they understand why we are asking, why myself or one of the Directors of Management Team would be asking to do it that way. So we always work together. Very rarely you know I wouldn’t sit here and say we never fall out because of course we fall out but we always work on the basis that, my starting point is if I make their life easier they are more productive and that is a benefit for all of us. And from their point of view they know that if I can make their life easier to make them more productive financially it is a win for all stakeholders everybody wins.

 

Kevin: No I can see that.

 

Steve: The thing that is, in the market and the environment we are in it is very important to take everything with a quality view looking at the quality of what the end product has to be and ensuring that everybody that works on the shop floor, ladies and gentleman that work on the shop floor understand end users are paying you know the expectations of us as consumers now are far outstretched. You know every year the gate goes up a little bit higher, the barrier goes up higher sorry and to run behind that is always extremely difficult so everything we do the starting point is quality and then we look at if can we improve it and make it better that should ultimately sell more vehicles, please more customers and it is repeat it just goes round and round and round.

 

Kevin: Well you have hit nicely on to where I was actually going to go with my next question which is quality is your driver yet the way the product, the way production is set up it almost works completely against that because if I were to say to a Japanese manufacturer about how they can ensure quality they would say well great what we do is we automate as much of it and therefore it is within a completely controlled environment etc, etc. Whereas what we have got within Morgan is a bespoke product which is individually tailored pretty much every single time although you have still got the base chassis but so much, this is one of your strengths is the fact that you just tailor the product all the time linked with so many individual craftsman that all put their own identity and input within the product. How do you manage to still focus on quality and keep all of that tight when there is so many variables within the production process?

 

Steve: It’s a challenge. As with I am sure anybody who is making, anybody who is manufacturing anything in today’s world would say it is a challenge. I am a firm believer that systems underpin a lot of your end results. So if you have a system in place for something it is not to say that it is not going to go wrong or it doesn’t go wrong but what it should say is that you can look at root causes for system for any problems that you may have. So I would say the start, the driver, the start is ensure there is a system in place to help the crafts men and women to put that through. But it is a challenge for a number of reasons. One you are never going to have the levels of investment that one of the major OEMs would have to put into a product so you know if you were looking at a car platform for anybody else they are looking at you know hundreds of millions to set the system up you know it is just never going to happen with a small vehicle manufacturer. But I think pride takes over with a lot I think the guys; you know we are not a company where we have got staff walking in and walking out. We don’t have lots of temps and that is not to say that is wrong for certain businesses or certain products. What we always say here the way we are as a business is the glue that holds us together but sometimes it can hold you back as well. So it is a fine line between the two.

 

Kevin: So systems but then linked with that so you have got your base framework but then linked with that, that is where the personality comes around there but again it is trained, invested in and I like what you said about pride it is almost like, I am assuming almost like the John Lewis Partnership approach where they try and make everybody a stakeholder within their organisation so that they are not dealing with casuals so there is that desire to go the extra mile, to take personal care and attention as if it is your own product.

 

Steve: It is interesting I think one of the greatest bits of feedback we constantly get at Morgan you know we have invested in the Visitor Centre to bring people through the business and it is quite interesting because for people to walk round the factory that is making a car seeing it from nothing through to the finished product and we are getting 2000 people a month through at the moment. And the best bits of feedback we get are just how people think how enthusiastic and positive the workforce are and it has not always been that way. It really hasn’t always been that way, it is a constant battle and it has been a challenge for us to get everybody on side and going through what we talked about earlier about the wage structure, about the piece work about the changes, in any business change is a scary thing for all of us at times and sometimes you look at change and it if you have been, you know I always take a view that if you have got a chap who has been working on the shop floor for 15 – 20 years and then all of a sudden you want to change something you have to approach it in the right way. You have to ensure they understand why and get their feedback for it. It has been a cultural change for us and you touched earlier on the bespoke and the way we do all of that, yet again another challenge, another challenge for everybody who works for us to make sure that you know everything is being built right to the right quality, the right time and that comes back to the system again. You put the system in to enable them to bespoke the car and do what’s right and we are learning. We are always learning but it works, it does work for us.

 

Kevin: Where do you get your ideas from in terms of production techniques, improvements that you can do for logistics etc, etc? Do you get yourself out and about; are you fortunate that you can network with people in your own industry and other industries I mean where does it all come from?

 

Steve: That’s a really interesting question actually because do I get out and about – no not enough it is a hectic environment and when you are working for a smaller company like Morgan we are not very small and we are not very large we are right in that middle band where actually I haven’t got a Manager that will look after logistics or Manager that will look after maintenance or Manager to look after the site or you know you end up getting involved in stuff yourself so I don’t get time to get out and about. However I would like to think that I approach everything with an open mind. So we get people to bring improvements through from the shop floor as well. We promote that as an activity coming through so I would like to think that when people come along and ask me for something yes I do network with a lot of people. Where we are is a funny place to be because the nearest thing that I can think to us to get production techniques or ideas off would be someone like Rolls Royce Bespoke. Interesting Rolls Royce with a BMW backing. If you go to Goodwood and look at Rolls Royce as a facility chalk and cheese to Morgan hundreds or millions of pounds worth of investment in everything. Yet if you go to their Bespoke line which is a fraction of what we do if it is truthful, it is a fraction of the bespoking we do yet the synergy is great. There is a lot of synergy with what they do. Their Managers are fairly autonomous they can make their own decisions, whereas if you go on to the mainstream line they couldn’t make a decision without going back, way back to sort of Munich. But their bespoke line is quite good and taking a look round there, getting a few ideas from there but I think everybody who works for Morgan starting with Charles, Tim, fellow Directors right the way down through to the girls on reception. I think whenever an idea comes up we have all got ideas and we float them about and we try and, we just try and bring the best of it and as I say you never reach utopia do you with it you have just got to keep plodding on and get the best out of it.

 

Kevin: Absolutely, absolutely and speaking of getting the best out of it you have already mentioned that you guys don’t have anywhere near the size, the clout of other car makers and yet you manage to get a lot more out of suppliers than I think other companies would expect you to achieve due to your size. You know you have managed to engage companies that have never even touched automotive manufacturing before and you have got them suddenly on board with the moulding and the pressing and you are bringing techniques into car manufacturing that nobody else has done worldwide. How have you managed to do that because obviously you’re hugely responsible for managing all of these external partners and how do you leverage that value?

 

Steve: We have got brand buying power, we have got very little volume buying power when it comes to, especially when you talk about automotive I mean when you go to somebody and say oh we are going to make 1000 cars next year and they are doing BMW or Vauxwagon or Audio or Mercedes stuff you know it is sort of a drop in the ocean to them. But the brand carries a lot of weight and the brand helps you through those things. But interestingly enough I would like to think we have got some brilliant relationships with people, with other suppliers that will do a lot more for Morgan than they would ever do for other suppliers with a bigger purse.

 

Kevin: Do you think that is a trick that a lot of other small businesses and we will count them as small businesses have missed and maybe that’s what they haven’t harnessed as much and why so many SMEs have struggled?

 

Steve: Being honest I think, I think the brand is always a good door opener.

 

Kevin: Yeah.

 

Steve: And people want, people do want to be associated you know with something such as Morgan that is in today’s world is a success story. However I think it is an opportunity and I think negotiation skills is quite an interesting thing I always take an avid interest in how people open up discussions and deal with people on a one to one basis and I think there is a lot, and I am not saying, I certainly wouldn’t say we are the best or we are the authority on it but I think we have cracked it to a certain degree and I think the way we deal with people is, and I always encourage the guys who work for me and supply chain or even in development when we are talking to people how to deal with people and how to try and get the best out of what you can get. So it is has worked well for us and I just think that the relationship is a real key part of it and if you can strike a good relationship up with a person in the other company whether it is on the phone or face to face it is a good way forward.

 

Kevin: Something I think might be relevant to throw in here but James Khan off Dragons Den he has always said that an approach he has always taken within business is what he calls the ‘Win Win’ approach when he is dealing with suppliers or whoever he is communicating with – i.e. it has got to be a win for him so that he feels that he has got something out of it but also a win for the other party so that they feel that they have got something out of it so nobody is resenting the agreement and they can look long term about how they can both add value. Could you resonate with that?

 

Steve: Yeah very much, year very much. One of the terms we always try to use with people when we are setting something up it can not be in our interest for them not to be winning out of it because it would be a short term relationship. In fact it is very interesting you know without mentioning any mainstream names but I have dealt with people who have dealt with I can think of two very major one is an automotive and one is a construction company that their supply chain methodology is just go in nail, squeeze every last bit out based on down in the current volume and all of these good things. I just see it short term I can’t see, we have all got to win. If we don’t win we don’t survive and if you don’t survive you are moving on to the next supplier and its short term view because there is more work involved in building a relationship, setting up a positive way forward with another company and you know yourself if you are trying to logistically if you are trying to set everything up and infrastructure wise you don’t want to be chopping and changing, you don’t get stability, you don’t get quality you don’t get continuity all of the things that you really want to ensure you are building a quality product you don’t get if you are chopping and changing supply chain. So win, win is something we use and we do look at it like that from Morgan.

 

However at the same token I always like to explain to our suppliers that the win is part of us as well so we have got to be commercially aware of what we are doing and part of the challenge and I am sure everybody has the same thing but it is so relevant in automotive but the billing materials costs of a vehicle. For us we suffer it more. The point you first raised how do you manage in such a big commercial world yet you are only doing very few or it is very specialist. Billing materials for us is a key issue so when we go to a supplier we have to, you know our opening gambit, the starting point is this is where we have got to be and this is what we have got to do can you do it, can we all win from it and if the answer is yeah lets move on.

 

Kevin: That was very much next question I was going to ask you which is for all of the love and bespoke nature and artistic qualities that your cars bring to the world there has to be a profit in there. That is the harsh reality of business and that is the only reason that you can actually remain in business and I am very intrigued to understand the balancing act that you have to go through because you have got an awesome enthusiastic designer Matt Humphries who is bringing out incredible designs all the time and changing the brand perception and broadening the appeal to the marketplace which is complimented by Charles’s approach and he is very much revolutionising again this whole image. And you are the person in the middle who then has to deliver on all of that and also in association with Tim as well who is the Finance Director who has go to then make those numbers all add up as well. What challenges does that present itself with?

 

Steve: Well it is a massive challenge I mean the first one that springs to mind is you have got design versus manufacturing and there is a definite line in the middle that design the first thing that Matt will do is draw something and it looks great and it is just where we need to be. However you have then got to trade that along the lines of you have got to be able to make it. First of all you have got to be able to make it, then you have got to be able to make it cost effectively and geographically on the site obviously Matt and the Design Team are all, sorry Matt from a design team point of view along with John and our R&D Department are all in one location purposefully because when they sketch something up and they come up with a concept I want them to be able to literally hand it across the desk to the guys who have to then put that into reality. So you know there is a very early stage gate there to make sure that happens.

 

Taking the commercial side of it then it is always going to be a challenge because every new product that you design first of all if you take your development costs any mainstream manufacturer amatises it over you know 10s of thousands or 100s of thousands of units Morgan haven’t got that luxury you know we are looking at amatising you know and most companies want a typical payback in sort of 12 months or you know sometimes you will be able to stretch the shareholders out and a bit more long term it could be a couple of years. With Morgan we have to look at stretching that even further. However that is a strength to the business that we always take a long term view. You know we are not turning a quick turn buck and moving on we are looking at being able to take a long term view on it which then ultimately satisfies a lot of people which enables some of the things we do to be able to go forward but even with that in mind it is still a massive challenge because of the numbers involved in you know we are conforming to mainstream automotive requirements and legislation and that in itself is a big cost.

 

Kevin: That is what I was just going to ask you, I was going to ask you, you mentioned before about the challenge of obviously parts and materials but what do you see as the biggest challenge coming up say over the next five years? Is it legislation or is it safety or?

 

Steve: It is defiantly and okay this is my view and other people might say different but for me at the coal face it is definitely legislation encompassing safety and ecological green requirements, it is definitely legislation. And just safety the green and just legal requirements and so for instance any program now, any development program now, an airbag development program for us on a new vehicle is just for the one facet, just purely for the airbags is over ?1m, just for the airbags and that is not even considering any engineering, any braking any ABS, any ESP, any seat belt test, any roll over test, side impacts, frontal impacts, rear impacts and it goes on and on and on and on. It is without a question legislation.

 

Kevin: I mean how do you cope with that?

 

Steve: Interestingly enough yet again I would like to think that we are very as a Team dynamic, proactive all the buzz words that people will use but it is fact with Morgan because we haven’t got a budget behind. Recently went to one mainstream manufacturer that opened the door and there was probably 300 people behind CAD screens and I am looking at it thinking we will never have that luxury ever, ever have that luxury. Our guys are far more innovative is a good word to use the way we think through things. The other thing we do that is a great help is link in with the likes of Universities to be able to take on sort of KTP – Knowledge Transfer Partnerships which is a post graduate scheme which Matt Humphries came on.

 

Kevin: That’s right I was just going to say that is exactly how Matt came to be employed by Morgan’s.

 

Steve: And our homologation which is the technical legislative legal requirements side. Our Homologation Engineer Matt Welsh he did exactly the same thing came as a KTP. What it enables you to do is tap into the University technologies and also the knowledge that they have got. It is a Knowledge Transfer Partnership but it is both ways we are giving the graduate on the job coal face knowledge of what they are doing here by the same token we have got ability to use some of the software and some of the programs, some of the knowledge that is obviously embedded within any University so that is another way forward. But the legislation and the legal requirements it has gone passed silly really. I mean some of the laws that are coming out and I could sit and talk to you about it all night about what really is a little bit smoke and mirrors with some of the technology that is being applied by some of the mainstream manufacturers. And it is a massive industry and there is always going to be one trying to get something over the other but when all that filters down and all the water runs down to the bottom of the hill in the pond and we are in the little one at the bottom it is always going to be difficult for us but it is without question for me the biggest restriction on you know and biggest cost moving forward for a small volume manufacturer. That is why there is very few people in the game doing it at this level you so.

 

Kevin: I am going to actually swing this now and just actually ask you a couple of more personal questions about you because I think we have covered a great deal about Morgan. You have really given me a flavour for the issues that you have to deal with the markets and the direction the company is going but talking about yourself I mean you have openly said that you have come up through the ranks. You know serving the apprenticeship and you are now actually Ops Director one of the Senior Management Team for Morgan in probably one of the most exciting periods of Morgan’s existence right now. What I am always interested to understand from people who I do have the pleasure of talking with is what motivates you, what drives you, what has enabled you to get here? There must have been a lot of other people that started around the same time as you but you are the person that has actually come through and has become the Director of this company and I am very interested to understand maybe how you try to use the phrase but maximise your own potential.

 

Steve: I would like to think that I am positive and I always get up in the morning with a positive outlook to see how I can improve something and whether that would have been in, making the products when I was an apprentice I always wanted to improve and find a better way of doing something right the way through to looking now and just saying I always get up with a positive attitude to try and be better and make the best of life really.

 

Kevin: Did you set out with the mindset that I want to be a Director, I want to be you know one of the heads of a company or was it far more just attacking each day as a step, as a building block. How did you approach that?

 

Steve: Looking back now at the time when you are coming through, when you are living life in your earlier days I didn’t really have an ambition to be a Director. It wasn’t, I didn’t come to work and say I am going to become a Director of Morgan Motor Company. But looking back now there was definitely a point in my time when I was younger where I took a view and said actually I want to either climb the ladder within Morgan or I want to do something for myself. And I was at a real crossroads at that point and now looking, I very rarely reflect on it actually because I suppose you don’t get asked the question but now looking back at it and I can remember it quite vividly really that there was that point where I said actually I really want to improve. And thinking about it actually it is really interesting thinking about it I could see some real things that I wanted to improve within Morgan. So within Morgan I could see the opportunities I could see the things that needed improving from a business perspective.

 

Kevin: And that was just when you were working a regular guy.

 

Steve: Yeah interesting because my Foreman at the time had just gone for a hip replacement and there was an opportunity and looking at the way the business was running and as I said earlier and the way it was almost being restricted by the factory and some of the things that you just look at and improvements you could make and there was definitely a crossroads there where I said well actually I think I have got something to bring to the party or I want to do something for myself. And I was lucky that I was offered the opportunity to make that transition and I guess it is a bit of history from there really but I would like to think I am positive and that was one of my positive things was I was positively going to want to add some input and value into processing the way the whole company could run or do my own thing.

 

Kevin: There is probably a number of people that I have spoken to that have said regardless of whatever your title is at a place of work if you assume the role or position that you want to be in then people begin to see that within you. Would you say that that was very much the approach that you took?

 

Steve: That was exactly what happened with me actually because as I said my Foreman at the time and looking back now Tim and Sarah who is HR and Tim Finance Director I took that view that I would almost assume the role. I could see things wanted to be done and I started to take the role of trying to look after the shop and trying to improve a few things and put a few things in place and obviously that was seen you know and I was offered a different position within the company.

 

Kevin: And do you think that would be great advice or a single piece of advice that you would pass on to other people?

 

Steve: Definitely if you think you have got yeah I am a firm believer in that and that is where the positive attitude comes from I think. If you think you have got something to add and there is always a fine line between your own personal views and the views of others but actually if you think it and others think it the two will meet and then you know it will happen. And if you think it and other people don’t think it then obviously at some point they will tell you that as well. So but I think yeah taking the view that if you have got that positive approach and you want to try and add something you certainly should, if you have got the belief in yourself you certainly should try and do it.

 

Kevin: That is an excellent answer. I think that finishes off very nicely so Steve thanks very much for your time.

STEAM™ SUBSCRIBER AGREEMENT

 

This Steam Subscriber Agreement ("Agreement") is a legal document that explains your rights and obligations as a Subscriber. Please read it carefully.

 

1. REGISTRATION AND ACTIVATION.

 

Steam is an online service ("Steam") offered by Valve Corporation ("Valve").

 

You become a subscriber of Steam ("Subscriber") by installing the Steam client software and completing the Steam registration. Additionally, as a Subscriber you may obtain access to certain services, software and content ("Subscriptions") available to Subscribers. Conclusion of this contract between Valve and you takes place as soon as you access the Steam service after accepting this Agreement.

 

Unless you are a Licensed Cybercafe Operator (as defined below), this Agreement does not allow you to exploit the Steam Software or any of its parts for any commercial purpose including, but not limited to, use at a Cybercafe, computer gaming center or any other location-based site. A "Cybercafe" is a physical establishment in which computer stations are made available for use by customers. A "Licensed Cybercafe Operator" is a Cybercafe that has agreed to the Subscription Terms for Licensed Cybercafe Operators posted at www.steampowered.com/?area=cybercafe_agreement.

 

Each Subscription allows you access to certain services, software and other content under the terms of each such Subscription and this Agreement. Additional terms provided with each such Subscription ("Subscription Terms") may apply to the use of a given Subscription, and are incorporated into this Agreement. Further, additional terms (for example, fees and billing procedures) may be posted on www.steampowered.com or within the Steam service ("Rules of Use"), and are incorporated into this Agreement. As a Subscriber, you agree to all of the terms and conditions of the Valve Privacy Policy, which are also incorporated into this Agreement. When you complete Steam's registration process, you create a Steam account ("Account"). Your Account may also include billing information you provide to us for the purchase of Subscriptions. You are solely responsible for all activity on your Account and for the security of your computer system. You may not reveal, share or otherwise allow others to use your password or Account. You agree that you are personally responsible for the use of your password and Account and for all of the communication and activity on Steam that results from use of your login name and password. You may not sell or charge others for the right to use your Account, or otherwise transfer your Account.

2. LICENSES

 

A. License Terms.

 

Steam and your Subscription(s) require the automatic download and installation of software and other content and updates onto your computer ("Steam Software"). You may not use Steam Software for any purpose other than the permitted access to Steam and your Subscriptions. You understand that for reasons that include, without limitation, system security, stability, and multiplayer interoperability, Steam may need to automatically update, pre-load, create new versions or otherwise enhance the Steam Software and accordingly, the system requirements to use the Steam Software may change over time. You understand that neither this Agreement nor the terms associated with a particular Subscription entitles you to future updates, new versions or other enhancements of the Steam Software associated with a particular Subscription although Valve may choose to provide such updates, etc. in its sole discretion.

 

Valve hereby grants, and you accept, a limited, terminable, non-exclusive license and right to use the Steam Software for your personal use in accordance with this Agreement and the Subscription Terms. The Steam Software is licensed, not sold. Your license confers no title or ownership in the Steam Software.

 

Additionally, Valve hereby grants, and you accept, a limited, terminable, non-exclusive license (the “Installer License”) to reproduce and distribute an unlimited number of exact copies of the Steam client installation software ("Steam Installer") via online download; provided that the following conditions are met:

 

(i) you must redistribute the Steam Installer in its entirety;

(ii) you must not modify the Steam Installer in any way nor integrate or combine it with another software program;

(iii) you must redistribute the Steam Installer on a non-commercial basis (i.e. you may not charge any fee or receive any compensation for your redistribution);

(iv) you must include any Valve license agreement provided with the Steam Installer; and

(v) you must preserve in all copies of the Steam Installer all copyright and legal notices that are attached to the copy of the Steam Installer received by you.

 

B. Beta Software Terms

 

Valve may from time to time make software accessible to you via Steam prior to the general commercial release of such software ("Beta Software"). You are not required to use Beta Software, but if Valve offers it, you may elect to use it under the following terms. Beta Software will be deemed to be Steam Software, and each item of Beta Software provided will be deemed a Subscription for such Beta Software, with the following provisions specific to Beta Software:

 

(i) your right to use the Beta Software license is effective until the earlier of: (a) Valve ceases to make the Beta Software accessible to you; (b) Valve issues a final release of the software that corresponds to the Beta Software; or (c) termination by Valve pursuant to Section 13 below;

(ii) certain Beta Software may be made available to you subject to additional Subscription Terms to which you must agree as a condition of use of the Beta Software;

(iii) Valve may request or require that you provide suggestions, feedback, or data regarding your use of the Beta Software, which will be deemed User Generated Information under Section 7 below; and

(iv) in addition to the waivers and limitations of liability for all Steam Software under Section 9 below, you specifically acknowledge that Beta Software is not final and may create incompatibilities or damage to your computer, data, and/or software. If you decide to install and/or use Beta Software, it is entirely at your own risk.

  

C. Source SDK.

 

Your Subscription(s) may contain access to the Valve software development kit (the "SDK") for the computer game engine used in Half-Life 2 and other compatible Valve products (the "Source Engine"). You may use, reproduce and modify the SDK o a non-commercial basis solely to develop a modified game (a "Mod") for Half-Life 2 or other Valve products compatible with and using the Source Engine. You may reproduce and distribute the Mod in object code form, solely to licensed end users of Half-Life 2 or other compatible Valve products, provided that the Mod is made publicly available and distributed without charge on a non-commercial basis

D. Ownership.

 

All title, ownership rights and intellectual property rights in and to the Steam Software and any and all copies thereof are owned by Valve and/or its licensors. All rights reserved, except as expressly stated herein. The Steam Software is protected by the copyright laws of the United States, international copyright treaties and conventions and other laws. The Steam Software contains certain licensed materials and Valve's licensors may protect their rights in the event of any violation of this Agreement.

 

E. Restrictions.

 

Except as otherwise permitted under Section 2(C) with regard to the SDK, you may not, in whole or in part, copy, photocopy, reproduce, translate, reverse engineer, derive source code, modify, disassemble, decompile, create derivative works based on, or remove any proprietary notices or labels from the Steam Software or any software accessed via Steam without the prior consent, in writing, of Valve.

 

You are entitled to use the Steam Software for your own use, but you are not entitled to: (i) sell, grant a security interest in or transfer reproductions of the Steam Software to other parties in any way, nor to rent, lease or license the Steam Software to others without the prior written consent of Valve; (ii) host or provide matchmaking services for the Steam Software or emulate or redirect the communication protocols used by Valve in any network feature of the Steam Software, through protocol emulation, tunneling, modifying or adding components to the Steam Software, use of a utility program or any other techniques now known or hereafter developed, for any purpose including, but not limited to network play over the Internet, network play utilizing commercial or non-commercial gaming networks or as part of content aggregation networks, without the prior written consent of Valve; or (iii) exploit the Steam Software or any of its parts for any commercial purpose.

3. MERCHANDISE

 

A. General.

 

Valve may from time to time offer items other than software content and services for purchase via Steam (e.g., apparel, books, posters, etc.) ("Merchandise"). Valve may offer Merchandise together with or separate from Subscriptions, but such Merchandise is incidental to Subscriptions and the predominant purpose of Steam is and shall remain the provision of Subscriptions and services related thereto. All offers to purchase Merchandise via Steam are made and accepted subject to the terms and conditions of this Agreement. Your communications with Valve or submission of any purchase order or other similar forms containing provisions contrary to the terms of this Agreement or the terms presented by Valve during purchase of Merchandise via Steam are hereby rejected and are not binding on Valve.

 

B. Shipping & Risk of Loss

 

This is a shipment contract. All Merchandise will be shipped FOB Blaine, Washington, unless Valve designates otherwise on Steam in connection with a particular order. If you are an international customer, you acknowledge that Merchandise will be shipped from the United States and that you are responsible for any applicable import duties, customs fees, and taxes. Valve's liability as to delivery ceases, and title and risk of loss for the Merchandise will pass upon Valve's delivery of the Merchandise to a transportation carrier at the designated shipping point. If you pick up the Merchandise from Valve's place of business, title to and risk of loss will pass to you when Merchandise is placed at your disposal.

 

C. Acceptance/Rejection/Returns

 

The terms of this Section 3.C do not apply to European Union consumers. You will have a period of thirty (30) days after the date of receipt of any Merchandise to examine the Merchandise to confirm that it conforms to this Agreement and the offer for such Merchandise presented to you at Steam. If the Merchandise does not conform to this Agreement and the offer for such Merchandise presented to you via Steam, you may reject the Merchandise by returning it to Valve (at your expense) along with a copy of the receipt or other proof of purchase. Additional policies and instructions for returning defective merchandise to Valve can be found at storehelp.valvesoftware.com. After Valve has received your valid return, Valve will, within a reasonable time and in Valve's sole discretion: repair the Merchandise, replace the Merchandise with an equivalent item, credit to the credit card used to pay for the product an amount equal to the value of the Merchandise (as determined by Valve in its reasonable discretion), or provide another remedy that Valve determines in good faith is appropriate in the circumstances. All claims whether based on contract, negligence, strict liability or otherwise are waived unless made in writing and received by Valve within thirty (30) days after your receipt of Merchandise.

4. BILLING, PAYMENT AND OTHER SUBSCRIPTIONS

 

Valve offers some Subscriptions for free, and some for a Subscription fee. All fees are stated in U.S. dollars unless otherwise specified.

 

A. Payment by Credit Card.

 

When you provide credit card information to Valve, you represent to Valve that you are the authorized user of the credit card that is used to pay for Merchandise or Subscription or other fees and authorize Valve to charge your credit card for any Merchandise or Subscription or other fees incurred by you. For recurring monthly Subscriptions, each month that you use such Subscription(s), you agree and reaffirm that Valve is authorized to charge your credit card for the Subscription fee. You agree to notify Valve promptly of any changes to your credit card account number, its expiration date and/or your billing address, and you agree to notify Valve promptly if your credit card expires or is canceled for any reason.

 

B. Charges to Your Credit Card.

 

ALL STEAM FEES ARE PAYABLE IN ADVANCE AND ARE NOT REFUNDABLE IN WHOLE OR IN PART. Valve reserves the right to change our fees or billing methods at any time and Valve will provide notice of any such change at least thirty (30) days advance. All changes will be posted as amendments to this Agreement or in the Rules of Use and you are responsible for reviewing the billing section of Steam to obtain timely notice of such changes. Your non-cancellation of your Account or an affected Subscription thirty (30) days after posting of the changes on Steam means that you accept such changes. If any change is unacceptable to you, you may cancel your Account or a particular Subscription at any time as described below, but Valve will not refund any fees that may have accrued to your Account before cancellation of your Account or Subscription, and Valve will not prorate fees for any cancellation. If your use of Steam is subject to any type of use or sales tax, then Valve may also charge you for any such taxes, in addition to the Subscription or other fees published in the Rules of Use. The European Union VAT (“VAT”) tax amounts collected by Valve reflect VAT due on the value of any Steam Software or Subscription as well as import VAT collected which is to be paid to the tax authorities for the importation of Merchandise.

 

As the Account holder, you are responsible for all charges incurred, including applicable taxes, and all purchases made by you or anyone that uses your Account, including your family or friends. Information on how to cancel your Account or a particular Subscription can be found at www.steampowered.com/. Valve reserves the right to collect fees, surcharges or costs incurred before you cancel your Account or a particular Subscription. In the event that your Account or a particular subscription is terminated or canceled, no refund, including any Subscription fees, will be granted. Any delinquent or unpaid Accounts must be settled before Valve will allow you to register again.

 

C. Retail Purchase.

 

Valve may offer or require a Subscription for purchasers of retail packaged product versions or OEM versions of Valve products. The "CD-Key" or "Product Key" accompanying such versions is used to activate your Subscription.

 

D. Steam Authorized Resellers.

 

You may purchase a Subscription through an authorized reseller of Valve. The "Product Key" accompanying such purchase will be used to activate your Subscription. If you purchase a Subscription from an authorized reseller of Valve, you agree to direct all questions regarding the Product Key to that reseller.

 

E. Free Subscriptions.

 

In some cases, Valve may offer a free Subscription to certain services, software and content. As with all Subscriptions, you are always responsible for any Internet service provider, telephone, and other connection fees that you may incur when using Steam, even when Valve offers a free Subscription.

 

F. Third Party Sites.

 

Steam may provide links to other third party sites. Some of these sites may charge separate fees, which are not included in and are in addition to any Subscription or other fees that you may pay to Valve. Steam may also provide access to third-party vendors, who provide content, goods and/or services on Steam or the Internet. Any separate charges or obligations you incur in your dealings with these third parties are your responsibility. Valve makes no representations or warranties, either express or implied, regarding any such third party site.

 

G. Pricing and Payment for Merchandise.

 

In addition to the above, the following terms apply to pricing of and payment for Merchandise. The prices for Merchandise displayed on Steam are subject to change at any time without notice. Charges for shipping, handling and tax may not be included in displayed prices for Merchandise but will be displayed during the purchase process, although such displayed prices may not include all taxes, duties, and other fees that you may be obligated to pay to applicable government authorities. Shipping and handling charges displayed on Steam may or may not reflect the actual charges paid by Valve. All war-risk, marine, or other insurance; harbor charges; tolls; wharfage; demurrage; wharf handling; duties, or warehousing charges are excluded from Merchandise prices displayed on Steam and are your responsibility. You may be obligated under applicable local law to pay additional import duties and fees.

 

You must pay all applicable sales and use taxes, value added taxes and other taxes levied on you by any taxing authority on any Merchandise purchase in any country where such transactions are otherwise subject to tax, regardless of the method of delivery. Any taxes owed by you (i) as a result of purchasing Merchandise or the payment of any fee, (ii) that are required or permitted to be collected from you by Valve under applicable law, and (iii) that are based upon the amounts payable under this Agreement, must be remitted by you to Valve. Failure on Valve's part to invoice you for any such taxes does not relieve you of the liability to pay such taxes. You will promptly reimburse Valve for all taxes or other charges imposed upon Valve by any national, state or municipal government upon the sale, use, production, or transportation of Merchandise.

  

5. ONLINE CONDUCT, CHEATING AND ILLEGAL BEHAVIOR

 

You agree that you will be personally responsible for the use of your Account and for all of the communication and activity on Steam that results from use of your Account. Your online conduct and interaction with other subscribers should be guided by common sense and basic etiquette. Specific requirements may also be found in the Steam Online Conduct rules at steampowered.com/index.php?area=online_conduct, other Rules of Use, the Subscription Terms, or in terms of use required by third parties who host particular games or other services.

 

Steam and the Steam Software may include functionality designed to identify software or hardware processes or functionality that may give a player an unfair competitive advantage when playing multiplayer versions of any Steam Software, other Valve products, or modifications thereof ("Cheats"). You agree that you will not create or assist third parties in any way to create Cheats. You agree that you will not directly or indirectly disable, circumvent, or otherwise interfere with the operation of software designed to prevent or report the use of Cheats. You acknowledge and agree that either Valve or any online multiplayer host may refuse to allow you to participate in certain online multiplayer games if you use Cheats in connection with Steam or the Steam Software. Further, you acknowledge and agree that an online multiplayer host may report your use of Cheats to Valve, and Valve may communicate your history of use of Cheats to other online multiplayer hosts for Valve products. Valve may terminate your Account or a particular Subscription for any conduct or activity that Valve believes is illegal, constitutes a Cheat, or which otherwise negatively affects the enjoyment of Steam by other Subscribers. You acknowledge that Valve is not required to provide you notice before terminating your Subscriptions(s) and/or Account, but it may choose to do so.

  

6. THIRD PARTY CONTENT

 

"Third Party Content" means software and other content provided by third parties, other than Valve, that is designed to work in conjunction with the Steam Software (e.g. mods of Valve game products). In regard to all Third Party Content, Valve acts merely as an intermediary service provider. Valve does not screen Third Party Content available on Steam or through other sources. Valve does not assume any responsibility or liability for Third Party Content.

  

7. USER GENERATED INFORMATION

 

"User Generated Information" means any information made available to other users through your use of multi-user features of Steam or to Valve through your use of the Steam Software. User Generated Information may include, but is not limited to, chat, forum posts, screen names, game selections, player performances, usage data, suggestions about Valve products or services, and error notifications. Subject to the Valve privacy policy referenced in Section 1 above, as applicable, you expressly grant Valve the complete and irrevocable right to use, reproduce, modify, create derivative works from, distribute, transmit, broadcast, and otherwise communicate, and publicly display and perform the User Generated Information and derivative works thereof in any form, anywhere, with or without attribution to you, and without any notice or compensation to you of any kind.

8. DEDICATED SERVER

 

Your Subscription(s) may contain access to the Valve Dedicated Server software. You may use the Valve Dedicated Server software on an unlimited number of computers for the purpose of hosting online multiplayer games of Valve products. If you wish to operate the Valve Dedicated Server software, you will be solely responsible for procuring any Internet access, bandwidth, or hardware for such activities and will bear all costs associated therewith.

9. DISCLAIMERS; LIMITATION OF LIABILITY; NO GUARANTEES

 

A. DISCLAIMERS.

 

THE ENTIRE RISK ARISING OUT OF USE OR PERFORMANCE OF STEAM, THE STEAM SOFTWARE, AND MERCHANDISE REMAINS WITH YOU, THE USER. VALVE EXPRESSLY DISCLAIMS (I) ANY WARRANTY FOR STEAM, THE STEAM SOFTWARE, AND THE MERCHANDISE, AND (II) ANY COMMON LAW DUTIES WITH REGARD TO STEAM, THE STEAM SOFTWARE, AND THE MERCHANDISE, INCLUDING DUTIES OF LACK OF NEGLIGENCE AND LACK OF WORKMANLIKE EFFORT. STEAM, THE STEAM SOFTWARE, THE MERCHANDISE, AND ANY INFORMATION AVAILABLE IN CONNECTION THEREWITH ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, "WITH ALL FAULTS" AND WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. ANY WARRANTY AGAINST INFRINGEMENT THAT MAY BE PROVIDED IN SECTION 2-312(3) OF THE UNIFORM COMMERCIAL CODE AND/OR IN ANY OTHER COMPARABLE STATE STATUTE IS EXPRESSLY DISCLAIMED. ALSO, THERE IS NO WARRANTY OF TITLE, INTERFERENCE WITH YOUR ENJOYMENT, OR AUTHORITY IN CONNECTION WITH STEAM, THE STEAM SOFTWARE, MERCHANDISE OR INFORMATION AVAILABLE IN CONNECTION THEREWITH. THIS SECTION WILL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

 

B. LIMITATION OF LIABILITY.

 

NEITHER VALVE, ITS LICENSORS, NOR THEIR AFFILIATES SHALL BE LIABLE IN ANY WAY FOR LOSS OR DAMAGE OF ANY KIND RESULTING FROM THE USE OR INABILITY TO USE STEAM, YOUR ACCOUNT, YOUR SUBSCRIPTIONS AND THE STEAM SOFTWARE INCLUDING, BUT NOT LIMITED TO, LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES. IN NO EVENT WILL VALVE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, EXEMPLARY DAMAGES, OR ANY OTHER DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH STEAM, STEAM SOFTWARE, MERCHANDISE THAT YOU ACQUIRE VIA STEAM, ANY INFORMATION AVAILABLE IN CONNECTION THEREWITH, OR THE DELAY OR INABILITY TO USE MERCHANDISE OR ANY INFORMATION, EVEN IN THE EVENT OF FAULT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, BREACH OF CONTRACT, OR BREACH OF VALVE'S WARRANTY AND EVEN IF VALVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THESE LIMITATIONS AND EXCLUSIONS REGARDING DAMAGES APPLY EVEN IF ANY REMEDY FAILS.

 

IF YOU ARE A RESIDENT OF A EUROPEAN UNION COUNTRY, THE ABOVE PARAGRAPH MAY NOT APPLY TO YOU.

 

C. NO GUARANTEES.

 

VALVE DOES NOT GUARANTEE CONTINUOUS, ERROR-FREE, VIRUS-FREE OR SECURE OPERATION AND ACCESS TO STEAM, THE STEAM SOFTWARE, YOUR ACCOUNT AND/OR YOUR SUBSCRIPTIONS(S). IF YOU ARE A CONSUMER WITH PRIMARY RESIDENCE IN GERMANY, ANY STATUTORY WARRANTY OR LIABILITY CLAIMS YOU MAY HAVE UNDER YOUR JURISDICTION WILL BE UNAFFECTED BY THIS CLAUSE.

10. EXCLUSIVE REMEDIES

 

A. EXCLUSIVE REMEDY -- STEAM AND STEAM SOFTWARE.

 

YOU ACKNOWLEDGE AND AGREE THAT YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISPUTE WITH VALVE WITH REGARD TO STEAM OR THE STEAM SOFTWARE IS TO DISCONTINUE USE OF STEAM AND CANCEL YOUR ACCOUNT. BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES OR JURISDICTIONS, VALVE, ITS LICENSORS, AND THEIR AFFILIATES LIABILITY SHALL BE LIMITED TO THE FULL EXTENT PERMITTED BY LAW.

 

B. EXCLUSIVE REMEDY--MERCHANDISE.

 

YOU ACKNOWLEDGE AND AGREE THAT WITH REGARD TO ANY MERCHANDISE YOU PURCHASE VIA STEAM AS YOUR EXCLUSIVE REMEDY, IN ADDITION TO THE REMEDIES EXPRESSLY SET FORTH IN SECTION 3(C), VALVE MAY INCLUDE IN ITS OPTION THE RIGHT TO PAY TO YOU THE AMOUNT OF DIRECT DAMAGES ACTUALLY INCURRED BY YOU IN REASONABLE RELIANCE ON SUCH MERCHANDISE, AS LONG AS THAT AMOUNT DOES NOT EXCEED THE AMOUNT YOU PAID VALVE FOR THE MERCHANDISE GIVING RISE TO THOSE DAMAGES.

 

THIS SECTION WILL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

11. INDEMNIFICATION

 

You agree to defend, indemnify and hold harmless Valve, its licensors and their affiliates from all liabilities, claims and expenses, including attorneys' fees, that arise from or in connection with breach of this Agreement, use of Steam or any Subscription, or any User Generated Information or Third Party Content, including, but not limited to, the creation, distribution, promotion and use of any Mods, by you or any person(s) using your Account. Valve reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In that event, you shall have no further obligation to provide indemnification to Valve in that matter. This Section regarding Indemnification shall survive termination of this Agreement.

12. AMENDMENTS TO THIS AGREEMENT

 

Valve may amend this Agreement at any time in its sole discretion. As a Subscriber, you agree that Valve may amend the terms of this Agreement. If Valve amends the Agreement, such amendment shall be effective thirty (30) days after your receiving notice of the amended Agreement, either via e-mail or as a notification within the Steam Software. You can view the Agreement at any time at www.steampowered.com/. Your failure to cancel your Account thirty (30) days after receiving notification of an amended Agreement will mean that you accept all such amendments. If you don't agree to the amendments or to any of the terms in this Agreement, your only remedy is to cancel your Account or a particular Subscription.

13. TERM AND TERMINATION

 

Either you or Valve has the right to terminate or cancel your Account or a particular Subscription at any time. You understand and agree that the cancellation of your Account or a particular Subscription is your sole right and remedy with respect to any dispute with Valve.

 

A. Term.

 

The term of this Agreement (the "Term") will be effective as of the date that you click "I Agree" below, and will continue in effect until otherwise terminated in accordance with this Agreement.

 

B. Termination by You.

 

Information on how to cancel your Account or a particular Subscription can be found at www.steampowered.com/. Valve reserves the right to collect fees, surcharges or costs incurred prior to the cancellation of your Account or a particular Subscription. In addition, you are responsible for any charges incurred to third-party vendors or content providers before your cancellation. In the event that your Account or a particular subscription is terminated or canceled by you, no refund, including any Subscription fees, will be granted. In the event that your Account or a particular Subscription is terminated or cancelled by Valve for a violation of this Agreement or improper or illegal activity, no refund, including any Subscription fees, will be granted.

 

C. Termination by Valve.

 

1. In the case of a recurring payment Subscription (e.g., a monthly subscription), in the event that Valve terminates or cancels your Account or a particular Subscription for convenience, Valve may, but is not obligated to, provide a prorated refund of any prepaid Subscription fees paid to Valve.

2. In the case of a one-time purchase of a product license (e.g., purchase of a single game) from Valve, Valve may choose to terminate or cancel your Subscription in its entirety or may terminate or cancel only a portion of the Subscription (e.g., access to the software via Steam) and Valve may, but is not obligated to, provide access (for a limited period of time) to the download of a stand-alone version of the software and content associated with such one-time purchase.

3. In the case of a free Subscription, Valve may choose to terminate or amend the terms of the Subscription as provided in the "Amendments to this Agreement" section above.

 

D. Survival of Terms.

 

Sections 2(D), 2(E), 7, 9, 10, 11, 13(D), 14, and 15 will survive any expiration or termination of this Agreement.

14. APPLICABLE LAW/JURISDICTION

 

The terms of this section may not apply to European Union consumers

  

You agree that this Agreement shall be deemed to have been made and executed in the State of Washington, and any dispute arising hereunder shall be resolved in accordance with the law of Washington. You agree that any claim asserted in any legal proceeding by you against Valve shall be commenced and maintained exclusively in any state or federal court located in King County, Washington, having subject matter jurisdiction with respect to the dispute between the parties and you hereby consent to the exclusive jurisdiction of such courts. In any dispute arising under this Agreement, the prevailing party will be entitled to attorneys' fees and expenses.

15. MISCELLANEOUS

 

In the event that any provision of this Agreement shall be held by a court or other tribunal of competent jurisdiction to be unenforceable, such provision will be enforced to the maximum extent permissible and the remaining portions of this Agreement shall remain in full force and effect. This Agreement constitutes and contains the entire agreement between the parties with respect to the subject matter hereof and supersedes any prior oral or written agreements. You agree that this Agreement is not intended to confer and does not confer any rights or remedies upon any person other than the parties to this Agreement.

 

Valve's obligations are subject to existing laws and legal process and Valve may comply with law enforcement or regulatory requests or requirements notwithstanding any contrary term.

 

You agree to comply with all applicable import/export laws and regulations of the United States and its governmental and regulatory agencies (including, without limitation, the Bureau of Export Administration and the U.S. Department of Commerce). You agree not to export the Steam Software or allow use of your Account by individuals of any terrorist supporting countries to which encryption exports are at the time of exportation restricted by the Bureau of Export Administration. You represent and warrant that you are not located in, under the control of, or a national or resident of any such prohibited country.

  

I hereby agree to be bound by the Agreement. I also acknowledge and agree that this Agreement (including the Subscription Terms, Steam Online Conduct rules and other Rules of Use, and Privacy Policy) is the complete and exclusive statement of the agreement between Valve and me, and that the Agreement supersedes any prior or contemporaneous agreement, or other communications, whether oral or written, between Valve and myself.

The DTx Sales Team were ready for the record number of attendees at the MD&M West 2012 convention. Visitors to our booth were treated to a custom chassis display, an embedded demo featuring the Windows 8 loaded UEFI Development Platform System introduced at the Microsoft Build 2011 conference, and an interactive touchscreen display that allowed visitors to play Angry Birds and win a custom t-shirt.

The second one called Windows XP Professional x64 Edition, supports the x86-64 extension of the Intel IA-32 architecture. x86-64 is implemented by AMD as "AMD64", found in AMD's Opteron and Athlon 64 chips, and implemented by Intel as "Intel 64", found in Intel's Pentium 4 and later chips.

 

Windows XP Tablet PC Edition was created for a class of specially-designed notebook/laptop computers called tablet PCs. It is well-suited with a pen-sensitive screen, supporting handwritten notes and portrait-oriented screens.

 

Still early set-up hours at the MD&M West Convention at the Anaheim Convention Center in California. Peter and the Sales team did a great job setting up for the show. We set Peter loose with his camera, and nobody was safe – especially all the OEM attendees on their way to learn that a DTx embedded computer is the only way to go!
