      might be slightly earlier; the man is well-heeled well equipped & tidy, probably had enough money for a reasonably contemporary weapon, yet holds a sidelock (flint fired muzzle loading rifle). By the 1870's the latest in cartridge loaded rifles and carbines were on the market - 1873 Winchester being a most famous model. Or perhaps he was a nostalgia freak! He may of course, by the scenery, just been hunting and thus using shot instead of bullets, but even then, cartridge loading shotguns would have been available and far more convenient to use.
