Early in 2007, the Pennsylvania Supreme Court reversed the lower court and held that the URA could take by condemnation the New Garden Theatre, the last movie theatre in Pittsburgh showing pornographic movies. Consequently, the theatre was taken by the URA and put on the market, to be sold in tandem with a massive effort to renew the Federal Street corridor on Pittsburgh's Northside neighborhood.
