      Freakin' ijits. There's no trademark infringement because you're not selling anything. You could be diluting their trademark, but that only happens if it's already a well-known trademark. People know what "pepsi" is, but do they uniquely identify "SPIN Magazine" when they hear the word "spin"? HAR, HAR! The judge is going to laugh that out of court, with prejudice, and he's going to invite you to counter-sue for barratry.

      The easiest solution here is for you to offer a settlement: They acknowledge that @spin does not infringe their trademark; you agree that you will never use @spin to advertise any magazine that they consider to be their competition (listing them), and you will issue a tweet saying "@spin is not @spinmagazine."

      Considering SpinMagazine has over 82k followers vs. your 4k I'm going to say people aren't confusing the two of you, they just can't remember NOT to type spaces when using the interwebs.       I wonder if Matt Spindler ( twitter.com/mspin ) has received one of these, also. They might have a case against twitter.com/spinsider under Twitter's namesquatting rules in the TOS.

      As far as I recall, Eric has never misrepresented himself as being SPIN magazine, (which would put him in violation of twitter's TOS), nor sold printed goods or clothing using the @spin name.

      jakeludington brings up a good point -- "spin" is a fairly generic word unlike, say, Pepsi, or Debian or Linux. You should suggest in your reply that you will seek to have "spin" declared generic (not trademarkable) unless they immediately drop their C&D. Surely they know that their trademark is fairly weak, and they can't know how much resources you have available to you.

      how could it be could it be trademark infringement if their followers cannot type or spell? Their entire argument comes down to the claim that people who read and follow them don't know what they are doing.
