"Mobicious" website is stealing flickr photos!

I just happen to find the website:
www.mobicious.com/
while I was doing a google search for some of my fickr photos, and I found about ten of them on their site. They offer to send them to people's cell phones for free. I did a search for some of my contact's photos and many of them were on there as well.

All of my photos have all the full rights retained and I never gave them permission to use the photos in any way.

Is anyone else aware of this? You might want to do a search to see if you photos are on the site. I have asked to have my photos removed just now in an email and I will post what the response is, if any.

Just wanted to bring this to the communities attention!
Is there anything that flicker (the company) itself do about this?

Update from Staff: Mobicious posted here letting you know these were pulled from the site. Also another update about the iframe login to the Flickr mobile site has been changed.

The other day (when I was still having 100+ photos in my stream) I noticed that several external sites were picking up the photos. I had quite unpleasant discussions with the site owners, arguing that they actually had no licence to use the works in the way they did (mostly blogs displaying RSS feeds). Very unpleasant discussions.

I also noticed several "MFA" (made-for-ads) sites using Flickr photos to display along ads, adding no value whatsoever. Not good.

I suggest that you Flickr implements a feature that gives Flickr members additional control over whether 3rd party sites may pick up the photos or not. (Or am I missing something obvious?) By default ARR content should not be picked up by external sites.

Got a mail reply from them .. they removed my images without question. Guess, you drop a line to support@ and ask them to remove you images (flickr username helps them) ..

Where on earth they have comply to Yahoo - flickr TOS??

I have the rights to know from Yahoo - flickr on how , when & why these happen, as the source of API shall recorded all the details of the transactions.

flickr Police should work on these rather than on those.............

I need both Yahoo flickr & Mobicious.com to give me an acceptable official answer & resolution within 24th hours of this notice.

Failure which, I shall proceed for the actions concerning my rights & damages due.

If they are violating your "All Rights Reserved" rights, you may want to take a screenshot of your image(s) on their site so you'll have some proof if they then delete the content.....

EDIT:
Jeff, It's difficult to take a screenshot that would document which photos they are using, since when you click on "Show All" it brings up a Search Results window, from which if you click on an image, it reveals another feature on the left side called "Related" and if you click on an image there, it moves through whatever other images of yours are on that site--namely, the ten images listed there change with each click, so I suspect it would ultimately reveal every single photo of every single photographer they're using, though I haven't had time to prove that.

A colleague just forwarded me this forum posting, and we sincerely apologize for any inconvenience this may have caused you.

When we designed the Mobicious site, we received feedback from users that they wanted to download pictures from their Flickr accounts to their mobile phones. Since anyone with Internet access can download any image from Flickr to his or her computer, we built a feature that crawls the public Internet (similar to what search engines do) and enables people to download those images to their cell phones. We do not charge for this service, and our test users said that they liked this feature and wanted us to provide it.

In order to put the image on our site, we reviewed the Flickr terms of use, and on our site, we post a thumbnail image and attribute the source of the image with a link back to the original image on Flickr.
Based on other user feedback, we sincerely believe that we are providing consumers with a valuable service, but after reading all of the posts above, we completely understand your perspective.

Our sincere apologies if this has offended anyone. Please email support@mobicious.com with the user name, and we will immediately remove your thumbnail from our search engine directory and site.

Mobicious.....what you are doing is allowing anyone to download our copyrighted images without our permission via your site.

You are the enabler of this action and that makes you liable.

This is a violation of international and USA copyright law, and you're in a mess. You haven't only "offended" us, you've broken the law.

flickr TOU prohibit you doing this. you have to check the CC license on each image.

i'm sure that staff will set you straight on this.

you may want to wipe your cache in the meantime to stop the problem.

it is your responsiblity to comply with the terms of flickr's api, not individual user's to accidentally discover that you are making money from their copyrighted images.

not too sure how well this will play out in us district court in southie, but i don't think it will go your way.
