This group has been established to welcome contribution to the IOM/UNCTAD/UNHCR photo exhibition on Entrepreneurship for Migrants and Refugees.

Disclaimer and Terms & Conditions for entering the Global Photography Competition

These Terms and Conditions are applicable to any person or entity (hereinafter referred to as “Applicant” or collectively as “Applicants”) submitting an entry to the Global Photography Competition (hereinafter referred to as “the Competition”)co-organized by UNCTAD; UNHCR and IOM (hereinafter referred to as “the Agencies”). The Applicants entry may consist of photographs, captions, titles and any other related material (hereinafter referred to as “Submission” or “Entry”).

General

The competition is open to individuals who meet all the following conditions:
•You are above the age of 18
•You are the owner of the material submitted by way of an Entry and all rights thereof
•The Entry is an original one and does not involve any manner of plagiarism
•The Entry captures any consent required for material submitted including IP, ownership of data, privacy, subject consent, ethical norms etc.

By entering the Competition, the applicants:

1.Acknowledge that they have read and understood these terms and conditions
2.Agree to be bound by the Competition rules; agree that the decisions of the Jury are final and binding with respect to all matters relating to the Competition;
3.Agree that the Agencies may use the selected photographs and each applicant’s name and photograph in any publicity relating to the Competition or future noncommercial events without the need for compensation or prior approval.
4.Acknowledge and warrant that the submitted entry is an original work created by the Applicant, that the entry does not infringe on the copyrights, trademarks, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity, and that no other party has any right, title, claim or interest in the photograph.
5.Grant an irrevocable, perpetual, worldwide non-exclusive license to the Agencies to reproduce, distribute, display and create derivative works of the entries (along with a name credit) in any media now or hereafter known, including, but not limited to: display at a potential exhibition of winners; publication of a book featuring select entries in the Competition; publication on online and offline platforms of the Agencies and of the Competition’s partners.
6.Agree to release, discharge, and hold harmless the Agencies from any claims, losses and damages arising out of participation in the Competition or Competition-related activities.
7.Indemnify the Agencies against any and all claims, losses, costs, damages, liability and/or expenses arising out of the applicant breach of any of the rules outlined hereby.
8.Agree that only the selected photos will be displayed at the United Nations Office in Geneva, from 18 to 22 November during the Global Entrepreneurship week.
9.Agree that if an Applicant is dissatisfied with any of the terms and conditions governing the Competition their exclusive remedy is to discontinue their Submission.
10.Agree that the Agencies at their sole discretion can remove an Entry from the Competition that infringes upon the conditions set out herein.

Content

The Applicant is responsible for the truthfulness, accuracy, reliability of the Entry. The Applicant undertakes not to provide material, which is unlawful, obscene, discriminatory or abusive or promote such actions that maybe considered illegal.

Ownership
The Applicant guarantees the authenticity and ownership of the Entry, including but not limited to photographs, texts, documents, logos, designs, visual materials, photographs etc. The Applicant guarantees that the Entry is not an infringement on the rights, ownership or otherwise of any 3rd party.

Intellectual Property, Data and Privacy considerations

The Applicant undertakes that the Entry does not:
•violate intellectual property rights of other persons or entities
•violate privacy or other data legislation of any country or persons

The Applicant permits the Agencies, to use and modify the Entry for noncommercial purposes only, in any manner deemed fit, without requiring the Applicant’s explicit prior written permission. This includes usage for online and offline purposes including reprint, redistribution, display etc.

Personal Information

The Applicant accepts to provide true and accurate information as required relating to themselves and the Entry such as name, gender, place of origin and residence.

The Applicant agrees that their personal data may be processed, shared and otherwise used for the purposes and within the context of the Competition and any other purposes outlined in these terms and conditions. The data may also be used by the Agencies to verify the participant’s identity and eligibility to participate in the Competition.

Participants have the right to access, review, rectify, or cancel any personal data held by Agencies by writing to empretec@unctad.org

Personal data will be used exclusively for the purposes stated herein.

Right to Cancel or Suspend the Competition

If for any reason the Competition is not capable of running as planned due to causes beyond the control of the Agencies that affect the administration, security, fairness, integrity or proper conduct of the Competition, the Agencies reserve the right, at its sole discretion, to cancel, terminate, modify or suspend the Competition, and to disqualify any individual(s) who tamper with the entry process.

None of the Agencies shall be liable for any inaccuracy, error, omission, interruption, timeliness, incompleteness, deletion, defect, failure of performance, computer virus, communication line failure, alteration, regardless of cause, or for any damages resulting therefrom.
Nothing in these terms and conditions affects the privileges and immunities enjoyed by the Agencies as intergovernmental organizations.
