poor glory has been defining herself on flickr conversationally since april of last year. without a camera. (poor me!) however ---and gents and dolls, this is a mighty great *however* --- a camera is almost within reach. we're talking two weeks tops, here.

YAY for that. YAY a HUNDRED MILLION TIMES. i am so freaking excited. wee!

so. it's a great time to begin a journal. this way i get to chronical my anticipation from the very beginning to its delightful finish -- complete with what i hope will be awe-inspiring digital images. i dearly love inspiring myself and i look so very cute with my jaw dropped open and my eyes all sparkling and everything. wait and see! xoxo

bub
dear diary,

it's night 2 of babysitting overnight. i think i may have to do this thursday night too. my cousin is a single mom who bartends. her overnight sitter is out of town and i'm her back up's back up. i cannot be her number one since i do, after all, have single mom responsibilities of my own. and a dog. anyway, here we are. the kids are eating popcorn and watching a movie. i offered to play games but nope. they want a movie. tsk

i remember begging my parents to play with me. it makes me feel a little proud that my own kids are so very accustomed to receiving personal attention from their old mom that it's not a Must Have all the time.

my cousin and i have been talking about moving in together again. one of my favorite parts of my week is sitting at the kitchen table with her when she comes home from work at 4am, just as i'm waking up. i get to listen to her talk about the mini dramas that make up the night life, even on the average thursday. i'm not naive enough to believe that such conversational utopia would be a likelihood in the long term. but still... it's so tempting...

thanks sunni! i'm glad you like it. there's an opening at work so if you wanna change in scenery .. you can come work under me. oh. and bring your friend. and her champagne. i have strawberries. haha!!

thanks Simon! there's a wish in my heart for you that one day you too will be seated next to a light brown wall and be granted perfect creative freedom to jazz it up. huzzah.

take a nice long sip, eeland. sit back. uncross your legs. relax.

neener neener @ jonathan.

i loved the party, Rob. thanks for the compliment too. smoking and alcohol are not vices of mine, but i do have them. reading is a form of escapism i take to an extreme. once upon a chat i was hardcore addicted to yahoo chatrooms. well, one chatroom. books and literature. haha!!! there was an old joke in that room that the name of it should have been Boobs and Cliterature.

yah jallen. poor me

bella, i know you can top that story. i know you can.
I don't smoke and rarely drink; my major vice is chocolate. I love the sprite with a strawberry. Great pic. I am not big on soft drinks; but the idea of sparkling water with strawberries floating in them appeals.

Better yet all of us floating in sparkling water with strawberries would be great fun--something to think about for our next rave...

(don't go away glory in order for us to have one; we would want you here)

this is ashley. brooke and one of brooke's little friends were playing hopscotch behind us. i didn't watch with my eyes because they were really really awful. that little friend of brooke's was ...refined, for a 10 year old. check it:

we parked the car and our seat belts came off. brooke opened her car door and got out. ashley was sitting in the middle and slid out after brooke and shut the door. mercedes (the friend) didn't move to open her door at all. the window was cracked and so i asked her if she was okay. she said yes and sat there immobile. um.

i asked her if she wanted to come with us (outside of the car? um?) and she said yes, yes she would. then ...she folded her hands in her lap. seriously. i huffed a breath (i'm not proud of that) and asked what she was waiting for. she said i'm waiting for someone to open my door."

this cracked me up. she has a nice family, so ordinary it's extraordinary. that she's growing up with that level of courtesy in the home utterly charmed me. at the same time i wonder if her parents are human beings from this planet. i met her mom that night too. she shook my hand with limp fingers and when she left my livingroom the smell of pretty flowers lingered behind them both. beside mercedes' perfect mom i felt just a bit like a clod. but this clod can open her own door, so c'est la vie

i'm not allergic to bees. i don't even know anyone who is. still though, being stung is awful and i am happy to report i wasn't. they were swarming around my head as i took these pictures. i clicked off 26 pics before i freaked out enough to back off. only 2 came out decent enough to even consider for upload.

earlier last week, i was lying in the grass reading and felt itchy on my abdomen. i rolled to my back and craned my neck to look and i saw ANTS. omg! they were *crawling on me*. ew ew and ew. horrible ants, totally worse than bees.
Lovely image. I hope that life is treating you better than well.

I don't know about your state, but in mine, that arrangement if very illegal. And the employer can be assessed a penalty of 1 1/2 times the wages they should have paid you (OT, Saturday, etc.) until they pay you for the work you did. In my state, only management and professionals (Lawyers, some doctors and managing R.N.'s) can be salary. Everyone else has to be paid for the hours they work, with time and a half for any hours over 8 per day, or alternatively, 40 hours per week.

I had forgotten about Susan, and how happy you were to get your last job because of her. I am sorry you forgot as well.

@bunaen: that's true in CA (with regards to Labor Laws). Unfortunately they exempted IT workers; which means much exploitation goes on in that field. Don't get me started :-)

Here's hoping someone slaps Susan's hands. That's not a good business practise. For one it is short-sighted - it will make recruiting new staff quite difficult, unless you're paid a fair salary. Also it is likely illegal.

yah Rick, word. she and i have *always* had issues. i can't help but laugh when someone in my world behaves as though they are threatened by me. then again... this is the lady who writes my checks so it's not entirely happy laughter in this case. once upon a time she said to me "if you take me on, you will lose." i laughed as though i thought it was a joke and said "if i were a gladiator, i would be Sapphire Storm. you could be Emerald Warrior!" ..i've had smoother conversational transitions but confrontation tends to rob me of my A game. anyway, it did what i wanted it to: she shook her head and went away

we're still enjoying our evening walks with the dog. my mom isn't speaking to me any more but she's having my sister or her girlfriend call me with demands. mostly she wants her dog back. i adopted sara because she was unwanted-- she wasn't being walked or fed or played with. with us, she's kenneled all day, that's true. but when we are home she's free and given attention.

i feel like mama taking sara back is a move intended to punish me-- which is fucked really, because it's her grandkids who'd miss that dog. i can talk to *myself* just as cheerfully and easily as i talk to sara -- this isn't even about *me* missing her. blah how can grown people behave like such children and still feel good about themselves, is what i want to know.

I work for the government in the labor/benefits field so don't try to shit me unless you've got a turd in each back pocket.

Here is what the
TN Department of Labor and Workforce Development has to say on their web site.

Questions Concerning Overtime, Minimum Wage, or Salaried Employees:

Tennessee has no wage laws concerning overtime, minimum wage, or the regulation of salaried employees. The United States Department of Labor's Wage and Hour Division enforces the Fair Labor Standards Act regulating minimum wage, overtime and salaried employees. Further information concerning these matters may be found at the WH division of the Department of Labor web site.

Okay, so there is no Tennessee law regarding work hours or overtime. All that means is you have to call the feds instead of the state. In California you can just call the state. Don't believe me?

Read what the United States Department of Labor says on their web site.

Fact Sheet #22: Hours Worked Under the Fair Labor Standards Act (FLSA)

This fact sheet provides general information concerning what constitutes compensable time under the FLSA. The Act requires that employees must receive at least the minimum wage and may not be employed for more than 40 hours in a week without receiving at least one and one-half times their regular rates of pay for the overtime hours. The amount employees should receive cannot be determined without knowing the number of hours worked.

[snip]

Typical Problems

Problems arise when employers fail to recognize and count certain hours worked as compensable hours. For example, an employee who remains at his/her desk while eating lunch and regularly answers the telephone and refers callers is working. This time must be counted and paid as compensable hours worked because the employee has not been completely relieved from duty.

Where To Obtain Additional Information

This publication is for general information and is not to be considered in the same light as official statements of position contained in the regulations.

For additional information, visit our Wage-Hour website: www.wagehour.dol.gov and/or call our Wage-Hour toll-free information and helpline, available 8am to 5pm in your time zone, 1-866-4USWAGE (1-866-487-9243).

Yeah, it is all true. The only way they could get away with not paying you by the hour, and not paying you overtime, and not paying you for Saturdays is if your PRIMARY duty is to supervise others or make policy decisions. In that case you might qualify for the executive or administrative exemption, thereby being an exempt employee (i.e. exempt from overtime rules).

From the DOL website:

To qualify for the administrative employee exemption, all of the following tests must be met:

The employee must be compensated on a salary or fee basis (as defined in the regulations) at a rate not less than $455 per week;
The employee’s primary duty must be the performance of office or non-manual work directly related to the management or general business operations of the employer or the employer’s customers; and
The employee’s primary duty includes the exercise of discretion and independent judgment with respect to matters of significance.

I think the criterion upon which the determination as to whether your duties qualify your job for an administrative exemption, lies in whether you exercise "Discretion and Independent Judgment".

And if you do, then it would have to be determined whether you exercise "Discretion and Independent Judgment" in "Matters of Significance."

Check out the following lnk for help in making this determination.
