Opera House, Dawn

Opera House, Dawn by webmink.
Crazy info: I tried to add this great picture to my portfolio over on iStockPhoto. They rejected it, telling me that Sydney Opera House asserts copyright to all images of the Opera House.

Update: As documented on my blog I've entered this in their photo contest to get some visibility for the issue, please vote it up before July 30, 2008.

Sorry Simon, but the Opera House is not alone. It's a pesky problem for photographers in general - many modern buildings assert ownership of their architectural image.

One other notable structure that asserts bizarre copyright ownership is the Eiffel Tower - but only when lit at night. It's old enough that they couldn't assert rights for it in the day :-P

Wonderful photo.

@netdance: It's actually a different case, as I understand it. The Eiffel Tower is displaying an artwork on its surface and the artist asserts copyright, probably correctly. It's OK to take photos of the tower when the lights aren't flickering (several times each hour, see below for example) and as you say it's also OK in the day time.

Personally I think the artist should be more flexible but I can understand the position much more and was willing to wait for a gap in the lightshow to take my photo.

Eiffel on Orange

By contrast, SOH assert trademark rights and despite no indication that any such rights are being breached by my photograph or any other like it, have put in place a policy that results in stock services declining submissions rather than risking litigation. This is not guesswork on my part - SOH actually asserted their claims in a comment on my blog. A local expert suggests their claims may not have a lot of merit but I'm advised that proving that in court would likely be expensive.
