According to the Sac Bee of 6/21/2002, "The sign will be placed in storage for renovation and then will be displayed for the public in a museum site, said James Henley of the Sacramento Archives and Museum Collection Center."

You must email them and tell them to give you credit, or remove it! Or, ask for a payment for the photo's use. When AutoWeek used my 76 picture without my permission, they ended up sending me a check!

I don't know that my situation is quite the same as Allen's. AutoWeek did not own the trademark of the sign photographed, as Shakey's does of this sign. But I'll check into it.

Copyright infringement is a serious issue that tends to peeve photographers to no end. I really wanted to know about this issue (photographing trademarks) so I did some research on copyrights and trademarks. First, to avoid a copyright infringement myself, let me attribute the following paragraph as information from cafepress.com at cafepress.com

I took the photo, so I can use it however I want.
FALSE. Simply taking a photo of a person, company, brand, logo or the like does not afford you the right to sell merchandise featuring that photograph. There are two distinct intellectual property rights in a photograph: (1) the rights in the photograph itself and (2) the rights in the subject of the picture, such as the product or person shown in it. For example, if you take a photo of a celebrity, you only own the rights to the photo, but not the right to use the photo of a celebrity for merchandise sale. In order to sell merchandise with the image, you will need to obtain explicit permission from the celebrity.”

Here’s my understanding. The photographer owns the rights to the photo regardless of whether there is a trademark in it or not. The photographer may sell copies of the photo, or the rights to use the photo. The photographer does not own the right to, say, print the image of the Shakey’s logo on pizza pans and sell that merchandise without explicit approval from the trademark owner. In turn the trademark owner cannot use the photo in any way that is not authorized by the photographer.

Tom (tspauld) posted his image of the Shakey’s sign with a “creative commons license” that authorizes some use of his image, but the license he granted to everyone specified that it was not to be used commercially. Shakey’s has posted his image on their website, a commercial format. From my interpretation and understanding of the laws, Shakey’s has used Tom’s (tspauld’s) image unlawfully.

No problem. I am interested too. Here's what I think will happen if you contact them.

Once a business infringes upon a photo copyright, it never fails that:

1. The company will claim no prior knowledge of the issue.
2. The company will claim that the photo is not yours … merely a similar image. In my opinion, you should make a legal copy (by photograph if necessary) of the webpage(s) to prove your photo’s use before you notify them of the infringement. If you have the software to do it, take your photo and make it translucent, resizing it and laying it over theirs to prove or disprove that the photo is yours beyond a doubt. Don’t bother sending comparisons to them, just stick to your guns in claiming that it is yours if you know that it is.
3. The company will claim that the photo is not in commercial use since they are not receiving money for it. Their website is an advertisement. Businesses receive money as a result of advertising, so the photo is in commercial use.
4. The company will claim that no infringement has been made, even when they know they are wrong. To admit their wrong and put it into writing would hold them to the highest penalties.
5. If they discuss any potential of wrongdoing or if they know they have been caught, they will undoubtedly blame a “low level staffer” or “outside contractor”. They will state that, IF they are in the wrong, their infringement is essentially void since the management was not aware. The company is responsible for the content of their advertising regardless of who created it for them; there might be additional liability for any “outsider” who contributed. If you had unwittingly infringed upon their trademark, they would give you no mercy. They would not simply hold you to the value of whatever gain you had in using it, they would also seek damages in harming their business.
6. They will stall you and ignore you since they know you don’t have the resources to fight them. Since this is a corporation and not just some individual, consult with an attorney and/or use the power to the internet to convince them that they need to deal with the issue. Don’t settle for the value of the photo as an advertisement. Get damages for infringement too. If you allow them to continue using it, make sure that they attribute the photo to you!

What Encouragement wrote above is so true! AutoWeek asked to see the "Copyright Registration" of my picture. When I sent them the link to my picture, I received no response. My situation was blogged on a Saturday after not hearing from AutoWeek for nearly three weeks. I received a phone call from the art director on Monday, apologising for the situation and if my request for $100 was still acceptable. The blame was placed on an intern that didn't know what they were doing.

I used to go to the Shakey's Pizza after every home hockey game (berkeley) we played when I was a kid. The location was the one in the Rockridge Center in Oakland on the border of Piedmont. They used to play old fashion movies in Black and White, It was awesome! Wish there more like them today.

I lso use to frequent the one in Marin (Terra Linda) before they closed.

years ago, Wolfman Jack often answered the phone of his Radio Show by saying..."Shakeys Pizza, go ahead.
I have a copy of it on tape and it is halirous as I often thought he was making it up and was not aware that there really was a Shakeys.

Dang! We had one in Maryland (Langley Park, or thereabouts) -- had endless fun, as a kid watching those lunatics throw pizza dough in the air, through a giant plate-glass window... Not much else to do in the suburbs. Great dose of nostalgia there...

Funny reading all the memories this photo evoked. I too remember going to the Shakey's in Burien, Washington, and sitting at the long tables. They had the best pizza!! I had forgotten about them...and I just checked their Web site and I see there's still one not far away from me. I think I'll have to go pay them a visit soon!

sassybead, I made the trek from downtown Seattle to the Shakey's in Renton several years ago. It has changed since we were kids. Better to just order Jet City or Pagliacci.

My note will likely get lost in the chain, but I moved to Sacramento in 1957, lived in River Park ,worked at CSUS..... and dined at Shakey's more often than I like to admit, from 1957until it closed. Later, we moved to Carmichael and began dining at Seritella's..... when it was under its original ownership. They specialized in Italian dinners, and also had pizza on the menu.

Shakey’s is so nostalgic for me. I grew up a block away from the one on San Juan Ave. in Fair Oaks and went there all the time. Went to this one photographed shortly before it closed – I didn’t know it had closed due to a fire, how sad. I loved Shakey’s Pizza and am sad that they are no longer in the Sacramento area. Glad to see this sign wasn’t destroyed though, and on flickr!

i am 45 years old. when i was about 7 0r so, i remember going to a pizza place called Shakey's. i also remember being able to watch the men behind a glass window making and spinning the pizzas. it was great! i also remember getting a balloon shaped like a man and had card board feet attached to the bottom so it would stand. was this the same Shakey's we are talking about? it is no longer in San Antonio Texas! that i know of!!! does anyone know of a closer one now?

You can check shakeys.com, but there aren't any in Texas now. And the newer ones, like the one I visited in Bakersfield 6 weeks ago, aren't anything like what you remember, except for the logo and the pizza.

The one in Oroville, CA, on the other hand, looks inside just the way the one I grew up with did in the 1970s.

I live in MN and many of us remember the Original Shakey's pizza(which looks like the picture listed here). They all closed in MN sometime around 1990. I have been reading there is a "Shakey's pizza chain" that is located around the country, however by looking at the pictures and reading the reviews it is NOT the same Shakey's pizza we all knew and loved. One thing many remember is their small circle pepperoni's:), always crispy on the edges and filled with grease:).

Do you know where or if there is any Original Shakey's pizza's left in the US?
