"I Will Break Your Fucking Camera" by Troy Holden.
A couple of days ago, Stuart and I decided to walk through the Financial District for lunch.

I had heard that the security guards at 555 California were unappreciative of photography. I mentioned this to Stuart and we agreed that these types of rules were silly and served no real purpose.

So we decided to check it out and within a few moments several security guards greeted us with wagging fingers and walkie-talkies.

No photography, they stated clearly. Why, we responded. Safety, they said.

I decided to challenge this statement and the older of the bunch (left) asked me if I wanted to be punched in the face. No, I replied, I have to go back to work and a black eye would make things awkward for me. He then asked me how I would feel if he broke my camera. I told him I would be bummed, but that I needed an upgrade and if he touched me or my camera I would seek monetary legal action to the extent of a brand new Canon 5D Mark II.

Shortly after, my internal voice of reason set in and I decided to leave. The conversation was going no where and a definition of "safety" was unable to be produced.

I wonder what the fear is all about? There are currently 1096 images of 555 California on Flickr, and not one of them indicates a compromise of security. It just doesn't make any sense.

UPDATE: I received an email from Fatima Vegas who works on the security team for Vornado Reality, who manages the property:

"Thank you for your e-mail. I just received information from the incident within the past hour. I am investigating the matter. This is not typical of our security team at 555 California St. If our investigation results in the officer behaving in an unprofessional manner, he will be disciplined accordingly. We do not tolerate that sort of behavior from any of our service providers."

UPDATE #2: I was put in touch with the ACLU via my friend Thomas Hawk yesterday afternoon. Each one clarified a couple of things about "Private Property" such as the plaza in front of this building:

The plaza where the photography was taking place in was a *public* area on private property. These areas are treated differently than other a citizen's private property (such as your home). In order to prevent a public easement of the property and losing their private property distinction, property owners will install little plaques denoting the area as giving the public a right to pass under California Civil Code 1009 typically. While this notification preserves their ultimate property right, it also reduces the control that they have over that area.

Specifically, the code states: “After taking any of the actions set forth in paragraph (1), (2), or (3), and during the time such action is effective, the owner shall not prevent any public use which is appropriate under the permission granted pursuant to such paragraphs by physical obstruction, notice, or otherwise.” Restricting photography from the plaza in front of 555 California violates the public use clause in California Civil Code 1009.

In any event, even if this is not a Privately Owned Public Space, nothing in California law makes it a crime for a person to be on non-residential property that is open to the public unless one is interfering with the owner’s business activities, and taking a photo is not.

In defense of building security guards, I was shooting the front of The Ritz-Carlton Club and Residences on Market Street this afternoon, and with my headphones blasting while setting up the shot, I saw a security guard approach me. I ignored him until I got the shot, and then I removed one earbud and said, "What's up?" He was pleasant and asked, "are you taking pictures for personal use?" I said yes, and he responded with, "okay just making sure," and he walked away. Some of them aren't dicks! Who knew? (I still don't know what difference it would make if I weren't shooting for personal use.)

I didn't want to argue the legal issue with them, so I just said I had been hired to take photos for the company which did the stone work on the building (which was the case) and they said it was fine

Pictures have not been allowed at 555 Cal, and most high rise buildings since 9/11. Security guards are instructed to inform anyone taking pictures about the policy. The policy actually comes from building management who are concerned that the photos may be sold for monetary gain and Vornado won't get their cut of the cash. Vornado may give you lip service about guards misbehaving or what not, but it's their policy and the guards are simply the messengers. Also, these security guards are more like bellhops and customer service reps. So I find it hard to believe that there were any threats made (why you and now after eight years of this policy being in place)...

*My comment was not about how CA law pertains to the situation. I was pointing out that the building policy has been in place since 9/11 (Shorenstein policy originally), and is not about "safety" it's about money (greed). Unfortunately the security officers are always the ones to have to deliver the bad news and usually receive a lot of verbal abuse from the general public.

Anyway, please let me know how/where I can see the footage. Hopefully we can get this resloved. Take care bro!

If your union and I am assuming it is SEI, has a lawyer, that is who you need to talk to about dealing with photographers. As long as the photographer is on the curb or public part of the sidewalk, he can walk around the building a million times looking for UFO's to photograph if he wants.

The going rate for camera smashing (Kanye West's specialty) or false arrest (NY Transit's specialty) is $20,000 to $50,000. Security guards do not need to end up in jail or bankrupt over that.

Personally, if I want a photo of a building I will almost always do it from across the street or a block away so that I can fit it in the picture. In that situation there is not the slightest possibility of a valid trespassing complaint and the building owner has no say off of his property.

My dad worked across the street in the Federal bldg for years, sad to think those guards had it together more than these idiots.

the company who employs and dictates what these guards have to do should have been on their game it is obvious from the photo they were not being very friendly and if they were better informed and trained about the laws and how to deal with people this problem could have been avoided all together hopefully troys photo will help this process out and in the future other buildings and guards wont be so quick to get angry at their own lack of knowledge and training

Good point. You really do not know where that video might go and who it might be used against including yourself. The union shop steward is representing the people that you are having a problem with and his objective would be to get his people off the hook with the employer or law enforcement.

If the union really wants the video, they can always have their lawyer try and file a court order for it.

I still do not understand, even when operating on improper directives, where these guards get off threatening to seize personal property, threatening to smash personal property, and threatening to viciously assault members of the public.

These are not questions of directives, nor training, but of dangerous persons in the wrong job. Guard at a rough road house bar? Maybe. Security guard for an office building hosting financial institutions, in the middle of a cosmopolitan setting, interacting with the public on a regular basis? Not quite.

I think the point that needs to be made here is that building policy does not supersede the law, in fact just the opposite. What happens if building policy is amended to include "take candy away from any small children passing in close proximity to the building". Of course you wouldn't do this (I hope), it's obvious that such an action would be against the law. It may be less obvious, but no less a fact, that stopping people from taking pictures is equally against the law.

Maybe the right answer would have been to tell the security guards that you were going to call the police since they were threatening you. If their company is instructing them to interfere with members of the public who are not in any way acting unlawfully then perhaps they might be inviting a law suit as well. I think the reason they get away with this type of nonsense is that most people, when confronted, will just walk away rather than contesting the action.

A friend and I just walked by here. There was a guy standing in the plaza, shooting the sculpture. We watched him for a while while waiting for lights to change, and even stopped and watched him take photos, so we could get some good shots when the guards came out and gave him the ol' tazer treatment.

But nobody bugged him. Maybe you've scared them off for a while, Troy.
