Keep this in mind guys. Although I'm not sure who owns the rights to On The Road today, at least the document was left by Jack to his third wife Stella. Ok fair enough. Stella dies and leaves it to her brother John. Uh, ok, I suppose he has a right to profit too. John dies and leaves it to his son Tony who doesn't put it on display, keeps it for himself until he can auction it off with Christies for $2.2 million.
And now the copyright holder of On the Road (or at least per the tour coordinator) has a problem with me fair use shooting the document?
So some third time beneficiary gets $2.2 million off Jack's scroll and I can't shoot it?
The inheiritance laws in this country need to be changed. The words of On the Road deserve to be in the public domain. Sure, I can see letting someone leave an important work to their spouse or even their kids or maybe if they are not married or have children a good friend. But after the intial beneficiary and/or a spouse and kids are dead we as a society lose by letting important works like this be locked up. It's not right and it should be changed.
Irrespective though I broke no laws in shooting the scroll. My snippets are fair use and while I broke a "rule" by the library and tour coordinator I don't really feel that bad about it and I don't fell the copyright owner (whoever he may be at this point) is damaged by my sharing these photos with the rest of the world.

I don't much like the 'keep Mickey Mouse in copyright forever' laws either, but (a) that's not inheritance law and (b) as you say, the law isn't a problem here anyway. "Fair use" is all you ever needed to say to these assclowns.

When I was there last weekend, there was absolutely no one around enforcing the "no photography" "rule". Per that post on BoingBoing, I photograph books at the SF Public Library all the time. It's way cheaper than their copiers.

I'm planing on taking photos of the scroll when it comes back to Indianapolis May 1.
I've been looking forward to seeing it and taking pictures ever since the On the Road tour started in 2004.
