Someone liked my design so much, that he decided he could use it on his own site.

I found out because he was stupid enough to leave my statistics code on the footer.
Then he added me on MSN to congratulate me for my design.

I asked him to remove it on Sep 8th, 2008. It's still up. (at Sep 13th)

First - BEAUTIFUL design! Very unique, I love it!

Second - I'm so sorry you got ripped off. It happened to me too (and I found it because they left my portfolio links and name, etc in the source code... they tried to cover it up with a comment tag that they forgot to close. So it showed in some web browsers (not all) - but google caught it, so I found it on a search of myself.

Have you tried to send a cease and desist letter? That worked for me very quickly. I'd be happy to send you a copy of the letter that worked for me if you want...
