@christain @ alicia : no, it is without my permission... this site uses many stolen pictures apparently. Someone wrote to me an email about, and I contacted them, their host, the flickrstaff... no results for the moment. Thanks for your message.

I'm another one of those who found this picture through Smashing Magazine and I'm quite happy that I did. I'm not so sure that it's stealing if others only show your picture without modification and link to the source properly.. I would be worse if someone took your pictures and made a blog banner or commercial from it.

But I'll have to agree that's it's really rude towards the creators if you can't contact them and have your featured photos removed.

I wouldn't say its stolen if its not taken from you. Still, its a nice thing for them to contact you. Maybe they earn money, but I don't see any ads there. I know quite a numbers of people are grateful (by their comments in their flickr page) when they are featured, and some are not so happy about it. Different strokes for different folks I guess.

Does this fall under fair use? I don't know. Lets say if I put HP logo in a page and all I do is critic/complements the logo, that would be under fair use, I believe. I'm not sure about this since every pictures in any magazine should be compensated...

I wanted to download it for use as a desktop background, but I completely understand what you dealt with. just wanted to commend you on the composition and idea.
