Palm Warbler, winter plumage.

The rusty-capped Palm Warbler can be most easily recognized by the tail-wagging habit that shows off its yellow undertail: www.allaboutbirds.org/guide/Palm_Warbler/id

Palm Warbler as well, although we can't see the rump. Undertail coverts are yellow in palm, white in Yellow-rumped. From this angle note the strong supercilium and dark eyeline. Also obvious is the thin malar streaks from the base of the bill. "Myrtle" Yellow-rumped Warbler (I assume this is the primary YR in your area- I have mainly Audubon's but see many Myrtles as well) lacks this malar mark in non-breeding plumage. It should also have yellow on the upper sides of the breast right at the bend of the wing which would be apparent even on this frontal-facing shot. Superficially similar to YR at this angle, but overall this bird has strong facial features which separate it from Myrtle Warbler.

See this photo of Myrtle which is close to the same frontal angle as your bird:

I like this pose, he's staring and standing erect...

Thank you all, you nice people, for commenting! Hahah, I never analyzed why the pose is so comical (to me), but you're right, Prairiedog, perhaps rather than being cute and funny, he's stretching to better observe and show his large, threatening size. Eeks! He could be hearing the loud Nikon camera shutter, responsible for many funny looks from birds.
