HELP!! (please read)

PLEASE NOTE THIS CASE IS BEING RESOLVED BY A US LAWYER AND HAS BEEN SINCE LAST YEAR. I HAVE LEFT THIS UP TO SHOW PEOPLE THE STORY AND HOPEFULLY TO MAKE PEOPLE AWARE OF ONLINE COPYRIGHT THEFT.


Yeah, that's right. My image is being used for a pornographic movie called 'Body Magic'.
Did they have permission? Did they hell.
This happened a few months back (well, since I found out). Somebody noted me saying this company was using one of my pictures.. actually let me get this straight - a SELF PORTRAIT that I took at the age of FOURTEEN.
I don't know if you can see the descriptions too well but it is qouted as 'Hustlers Highest Rated' and a 'pleasure to watch'. The back of the cover was disgusting.
I looked it up on the internet and found out that Hustler.com was stocking it and a range of other dirty video websites that took pleasure in this.. what I ALSO found was that there was a note on the back
saying 'Everyone associated with this DVD is 18 or over'. 18 or over? yeah right.
I contacted hustler and they gave me the name of the company - TVX Films. After doing some good old fashioned research I found that the company makes new covers for the dvds and that the movie was actually pretty old!
As soon as I'd found out relevant information and I send a long and 'friendly' letter to TVX Films - to my suprise I got an abrupt e-mail back from the owner who claimed that 'his company does NOT steal pictures off the internet and he recieved it from a company they've been in business with for 25 years'.
I found it hilarious, since I still remember taking that photograph back in 2004, I even have one of the first prints at my local walmart store with the date on! AND my small watermark on the dress which had been removed on the dvd cover..
After a few e-mails I found it obvious that I wasn't getting anywhere and that the owner was definately a sleaze himself. This is what he said in reply to me, in big bold capital letters to make a statement -

"I’M SURE BY THE END OF THE MONTH YOUR FACE WILL BE HISTORY. WE HAVE STOPPED SELLING THE DVD UNTIL COVER IS REPLACED. WE HAVE FURTHER CHECKED OUT YOUR NAME AND ITS NOT LIKE IT’S A HOUSE WHOLE NAME. ACTUALLY, REMOVING YOUR IMAGE WILL HELP IMPROVE THE SELL OF THE DVD….. SO FAR IT BOMBED.".


He also claimed I was 'scheming' and had set him up - placing the image on a public domain so companies can steal it and I can sue them... er, what? I actually had this image on only one website for a few years until I joined flickr - just DeviantART and it was clear that wasn't a public domain when underneath each of my picture there is a disclaimer CLEARLY stating the obvious (that's it's copyright)... and ALSO i had a bloody © symbol and my name written across my dress!!! Isn't that enough to warn anyone off anyway?
When I asked for compensation he said "AS FOR COMPSENSATION;YOUR SILLY!". and this was one of the end comments he made -

"THEY ARE REMAKING THE COVER AS WE SPEAK SO YOUR TEN SECONDS OF FAME WILL SOON COME TO AN END."

My so called ten seconds of fame was from a porno dvd? No thanks.


I've contacted about three solictors near to where I live - they all say they cannot do anything because the company is based in Texas, USA. I've tried contacting lawyers over in America but not a lot of them will reply, a few lawyers that have told me I need at least £50,000 to take it on. I've even tried contacting the news but absolutely no reply from them either.
I feel like Im wasting my time, my image hasn't been removed, they sent me another cover claiming they'd removed it in the end.. I researched in on the net and they'd just shown me the cover that was originally on in the 80s.

Hi Lara - I am horrified. You should be able to get legal representation for an hour for free. I would strongly suggest you do this and see what the options are. I am a professional rock photographer and I have had my images used a couple of times without being asked..mainly abroad too. They seem to think if they are in another country you won't find out about it! I really hope you manage to get something sorted. They sound like foul people to deal with.

It's disgusting that things like this happen - and happen as often as they do - and it's even worse when not only is your artwork stolen but then used to advertise porn. Sleazy fuckers will do anything for a buck. It's appalling and offensive - as was their response to you. The problem is that there doesn't seem to be much of a system in place to protect the artist. Companies like this know they can get away with it because the average person won't be able to fight it. I'm angered on your behalf and hope that help comes your way.

On a side note - I hope this doesn't sound insensitive, but that picture is beautiful. God, it's beautiful. I'm sorry to see it cheapened.

I don't want to make you upset more.. but I remember I've seen one of your pictures that you posted in DeviantART was used here in flickr.. the picture name was Crimson or Crimpson.. I can't recall the name sorry..

but I've noticed something in your page in DeviantART.. you put your photos in large size.. which makes it so easy for bad people to use it illegally.. try to re-size it before uploading it.. also you can put some "noise" in the picture.. so now you got a small sized photo with noise in it.. I don't think it can be used as an advertisment..

the bottom line is...
Lara.. you are a very talented photographer.. otherwise you wouldn't have been stolen a couple of times.. think of it differently..

I know how you feel as one of my old photos was stolen.. it's a terrible feeling..

That is terrible, Lara! Thye should take responsability for their actions. Maybe you should contact a news station over in the US? I'm not sure. My uncle is a laywer, who does patents, iventions, etc but I'm sure he must have a friend that could contact you.
I really hope it works out for you, this could have hurt your career and they should give you compensation!!!!!!!!!!!!!

Lara you have my deepest sympathies, this is an absolute nightmare for any reputable photographer. I also hate to say you should admit defeat but, unless you are prepared for a very long, drawn out and expensive battle, I would recommend you move on. It repulses me that these slugs (no offense to our animal friends) will get away this, but this is justice in America today. Unless you can afford it, you can't get it. I would also recommend against the revenge tactics being suggested by some as these can easily backfire and cause you additional insult to the injury you have already sustained. Please know that there are many out here who will support you, no matter what your decision. Best of luck on getting beyond this.

But I wouldn't expect anything else from people working in porn business. It might be difficult to fight them, but I believe that there is some way to win it.
And don't fell like You shouldn't display this amazing photo - it would be like they won 'cause You gave up. I think every one have to be ready for such things, especially someone with talent - like You. But even If You will never get apologize and money for those bastards, You should be proud of that photo. Don't care about some morons who will recognize it on their shelf with porn. And as Ahmed K says, we should all bombard them with emails. I think the solution, next down from court action etc which you can't afford, is to raise awareness as much as possible..
if you can get press coverage that would be even better... i know you have tried this, but the power of Flickr reception got Rebekka's copyright case BBC coverage.

don't let this get to you. They sound like a bunch of idiots. Do not feel scared to use this image on your site/Flickr site - it's YOUR work, anyone who has seen the film cover and sees your work (which would be pretty unlikely) will know that they're not connected.

Get with the US copyright office and ask them about it. Also, since the dude is breaking a lot of underage laws along with copyright laws, the FBI might be good to call as well.

Wow that's amazing, and so disgusting. Have you contacted all the local press of both where you live and in Texas? Local papers would usually take more interest and could spur up more coverage of what has happened. The guy is clearly a disgusting waste of space, and should duly be reported on as so. Just keep plugging on and do as much as you can to win your case. Any of his ridiculous claims would not stand up in any form of court or legal proceedings, and evidence of the way he has spoken to you will only do him further damage.

Since you were 14 in the photo and it's on a porn DVD I'd say the quickest way to get it off shelves is to contact whatever bureau in the US that is in charge of child pornography, FBI or otherwise. Even if it's not child pornography on the cover or on the disc, you should get a reaction since those sort of things usually get a quick reaction from authorities.

That is absolutely disgusting & horrible :/ It never ceases to amaze me the levels people will stoop to. Not only did they steal your picture, which also happened to be of a then 14-year old you, they are so very rude & unapologetic, treating you as if you did something wrong!

I'm not sure if anything can be done about it, as I have no experience in that area...you probably already know this, but keep all the correspondence you have had with this person, as the fact that he first states he has rights to use the photo but then so easily decided to remove it from the cover, is clear evidence that they stole it...as anyone that PAID for the use of a photo would never so easily back down & agree to remove it.

I'm sorry to hear this has happened to you. I read about a similar thing happening to another here a couple of weeks ago. I guess scum gets everywhere :( It's no excuse but it's a great picture and great things are always going to attract the wrong (as well as the right) sort of attention. Maybe a previous comment was correct and you should somehow cripple your posts - it's a shame for the rest of us but you have to protect your work.

lara, i suggest you contact some kind of a consumer protection organisation. the least they might be able to do is refer you to another org where they could help you more.

Grizzly! gave you an excellent tip, let us know how these autorities reacted. apart from that, i googled "intellectual property usa" and found various organizations who are dealing with these issues (e.g. WIPO, CIPP, etc.) i don't really know what their scope is, but it's worth a shot, just as pishee's suggestion to contact thomas hawk is, i think.

i feel really outraged and feel for you very much, just like everyone who's commented here already. i hope you get this solved in no time ;(

First off I can't believe that they'd do that. They should have a written consent form for any models used in any advertising/covers/ect. Ask him where he purchased the image, since he seemed to say that he got it from a person he's dealt with for 25 years. They are the people that you should be going after.
There are some free legal aids out there, you just have to know where to look. There is even a lawyer guru website that lets you post a question and random lawyers will come by and give you their two cents.

Second, it's really sad that us artists have to cover our butts with HUGE ugly watermarks just to keep theives from ripping us off. My mom is always warning me about posting stuff on the internet, but as an artist, the internet has been a huge boost to my learning.

And third, I'm sure that nobody will associate you with the DVD, and if they do, it's a simple explanation that your artwork was stolen. I know it's still no consolation, but just know that we all have your back on this one

See if you can find a lawyer just to write a threatening letter using legal mumbo jumbo to scare them out of continuing to use the image. They don't have to know that you don't have the actual $ to sue them, if they are afraid you're going to sue them they might be scared enough to take the image off.

I'll echo softballbutterfly. The media holds the power in the US. Forward on that e-mail, photo and commentary to the major newspapers in Texas (go for Houston, Dallas, and Austin to start with) and it wouldn't hurt to try national media like the New York Times and Washington Post. You may get calls from lawyers asking to defend you, but at the very least you will put the company out of business.

you could also Flickrmail Shutterblog. She had photos stolen from her by a big company and successfully sued them (and as far as I know she's not rich so she must've had some luck getting a lawyer to represent her for a reasonable price.)

Maybe someone can help you or try to contact a student/assistant at LAW that has the right to defense in a court!!!
You have to research more and have patience, I bet time and your ambition will solve this problem.

I don't know how law firms in the States work but here in Australia, we have a couple of firms that work on a 'no win - no pay' basis. Obviously they decide which cases they will take on once they've assessed the likelihood of a win, but I would be very surprised if they have firms that work on that basis they wouldn't see a win in this instance!

I am aware of a case here where the estate of a deceased person took on a large company for using video images of her in a television campaign. Obviously they didn't have her permission (or the estate's permission) as she had been passed on for years before the images were televised but the estate sued for royalties. This may be another avenue to pursue. Obtaining royalties from a porno movie is not really something you would be proud of but at least you might feel that you have received some form compensation for their lack of morals and for stealing your image.

I can't imagine that it is even legal to put a picture of a 14 year old on a porn DVD cover - in which case, so long as you can prove you were 14 at the time of the photograph, and that it is your photograph, surely this is a criminal case as well as possible civil case?

You should contat the Police in Texas I guess, I doubt any over here in the UK could do anything about it?

It sucks big time. I'm sure you got more images of the serie to proof its yours. There must be some layers yeah that work for now win no pay kind of thing. Try contacting istockphoto.com and see how thye dealwith things like that. One of the guys on flickr.com/groups/lightsource/ works with them. Contact him or put it in the group there. Who knows they might know someoen that can help ther.

Copyright infringement of photography seems to be a growing concern in our community. Recently there have been several stories much like yours.

I assume you're working with limited financial resources (as most of us are). Consider contacting a law school in your area and speak with one of the professors. They may be able to recommend an attorney who would be interested in handling your case, or know how to generate publicity which could be helpful.
