(probably) a preliminary for an equipment self-portrait I was asked to do to accompany the Picture Business magazine article Ms. Jane Hudson interviewed me for last month.

For those who need to know more about what you are seeing, please read the tags, I have a complete list there of all the equipment appearing here. Shot with the Tamron 28-75mm f2.8 appearing mounted on the camera.

This has to be one of the best self portraits that I have seen. Really well done. Great lines, great theme, as B said, great tones. I really like the overlay of the camera display, it makes it clear, this is you, you are an artist and photographer. There is no doubt about the message you send.

I am disappointed to report that Nerve.com decided to steal this image, of me, by me, for use in their latest e-newsletter to promote their photography competition without asking permission or giving me any credit.

It saddens me to have to reconsider posting to flickr, especially images of myself, because thoughtless people decide to ignore the words *all rights reserved* and appropriate where they see fit. While the sharing is what I love about this community, the stealing is what makes me fear and hate it. I am usually all too happy to let people use my images when they ask nicely. My self-portraits are personal explorations in ideas and feelings that I choose to share. What they are not is a resource for people to appropriate for their own means and ideas.

I thank you all for the continued kind words and faves on this image, which I am very proud of.

This morning I wrote directly to a photo editor my 'insider source' gave me... they took it off the newsletter straight away. The image appeared in an email (as an HTML newsletter), so they just changed the source code. She gave me a flaccid apology and offered to give me a premium subscription to their photography section.

Since I am not in a position to sue anybody over anything... I decided I might try to get them to scratch my back a little: I asked for them to use one of my photos, properly credited somewhere on the site. I still feel completely deflated, as I don't think I am going to hear back at all... I have been swept under their filthy shag rug.

Ugh. You're WAY to good to be treated like that. The fact that flickr consistently displays the copyright & licensing rights information with photos means they couldn't have just "not known." So they can't say "oops, we didn't realize..." 'cos it's all right there. There's nothing accidental about it. That means it was a deliberate violation of your license and rights. What they did is comparable to shoplifting. It's a shame that more can't be done about it. Stores can prosecute shoplifters even without having to pay lawyers, because shoplifting is a crime and the police will change the shoplifter. So why aren't people who shoplift images and use them illegally prosecuted in the same way? (That's not a rhetorical question; I really don't know.)

I guess the only constructive thing I could suggest is, (1) don't let the anger and/or disappointment consume your time and energy, or make you more unhappy that the experience has already made you, and (2) try (hard as it may be) to take the image theft as a sort-of compliment. If your images are worth stealing, then you're doing something right.

Also, if your photos are worth stealing, they're worth paying for. If you haven't sold any photos, I'm sure you will have the opportunity before too long.

I was wondering what is your stance towards having all your self portraits in that gallery, this one included, knowing how much grief you had with people infringing your rights and the fact that is "All rights reserved".

I feel kind of helpless currently. I am aware of the show, but the time, effort and possibly money involved in undoing certain things that have been done, have, in some ways stopped seeming worth it. I want to make photos and images. People will keep on finding means to steal them if that is what they want to do. I have taken what preventitive measures I can. No more downloads, smaller posting size, marking things all rights reserved, drastically fewer publicly visible self-portraits on the whole... but obvioulsy those things aren't enough to prevent this without removing it altogether.

I want to be asked to be a part, rather than have to ask to not be a part. At least with selfportraitr. it will be in the context of flickr pages (I guess?) and so it won't go uncredited.
I'm most sensitive to photos of myself being used. It is a most personal expression and someone taking that and advertising their sexed-up amateur photography contest, cameras, or their gallery makes me feel rather used, in every sense. If it was a photo of something else it wouldn't bother me a tenth as much.

It is a lot of energy to be angry all the time. The image is liked, I get exposure, fight it and what do I get? Not peace of mind, because there will always be a next time unless I disappear altogether, even if I do, it is already out there. All I can do is be aware and pick my fights. It is disheartening, but I am not prepared to stop creating because of the thoughtless actions of presumptuous assholes and ignoramuses.

Irina, I hope you have had some positive motions with your struggle with the Romanian newspaper. That seems far more intrusive, upsetting, and beyond control -especially as you weren't the photographer- than any of the stupidity surrounding misuse of this image. Good luck with that. Are you a part of the Pace McGill show? In the wake of the newspaper issue, how are *you* feeling about the gallery's actions?

Laura, to tell you the truth, it got me thinking ... a LOT. way too much. And I was on the verge of removing all my tags, my photostream and all my websites this morning. But as you, I chose to pick my fights and ignore the ones that are not worth a sweat. Life goes on, I saved one neuron. If I did it would have meant that I gave up to pressure and that's not who I am. But seeing other images in the gallery, that are very inappropriate for public viewing, it made me wonder if only for that reason I shouldn't opt out.

As for the newspaper, *sigh*.... I am waiting for a lawyer to give me some advice and unfortunately, a quote.

My initial reaction to each incident is rage, it does, like most pains, fade a little eventually. But some things cannot be undone. I am thinking about you and your struggle.

As for the show.... I will not fight it. Though the context forces us together... we can do the same thing sitting at our computers at home on flickr in a tag search.
