Picture Theft - Madhyamam

Picture Theft - Madhyamam by Haree | ഹരീ.
Madhyamam daily published one of my pictures available in my Flickr album without my knowledge or permission. The photograph got published in 'Velicham', a supplement published along with Madhyamam daily.

I published the image 'NalaDamayanthi' on Sept 2, 2007 here in Flickr. I accidentally saw an advertisement on Velicham supplement, today afternoon, in Madhyamam Weekly dated March 24, 2008. I'm trying to get an original copy of the Velicham supplement. The image got published on either March 10 or March 17. More details are available in my Malayalam blog - 'ChithraChoranam - Madhyamam'. I found the image copyright infringement a little late, but still the issue is valid.

mdmblr@gmail.com - No error report till now.

Dear Sir,
Yesterday, I accidentally came across Madhyamam Weekly dated March 24, 2008. In the back-inner cover I saw an advertisement on Velicham Supplement. I was shocked to see a page featured in that advertisement. In that page, there was an image copied illegally from my Flickr Album. I am attaching the screen-shot of that page and the picture is highlighted. The original image is available here.

I would like to inform you that, whoever designed that page, used the image without my knowledge or consent. In the additional information section of that image, it's clearly stated that it's copyright protected and all rights reserved to the owner (me). I had watermarked the image using my brand-name 'newnmedia' and also Flickr set name 'Arangu'; as I always do before publishing my pictures in that set. But the watermarks have been wisely avoided in the print.

I wonder what an easy way to do, to just copy-paste the image from somebody's album and use it without giving credits and/or proper remuneration! A few of my co-bloggers/flickr members too have reported cases of Madhyamam stealing their copyrighted photos. Situation demands that we make it clear that such copyright infringement can no more be entertained.

As a responsible print medium, Madhyamam is bound to respect others intellectual property rights and their creativity. And such a feeling should be reflected in all your activities. I expressed my protest against your unlawful, shameless act of lifting images here, here and here. I expect a prompt reply for this mail and hope that the issue will be settled in a mutually amicable manner.

stop writing mails. Send a registered post with acknowledgement. They will not respond, then file a legal notice. The legal case gets stronger if they do not reply or acknowledge.

in India, flicking isnt considered as an issue by many. It is time we also sue the violators for a very hefty sum like in USA. I am least concerned about the money part but hefty fines will deter many in the future.
