I put it in the Consumerist flickr pool so Consumerist and other blogs can use it when they want a Comcast image.

I've presented it here under a Creative Commons license. You can use it but you need to present a photo credit and shouldn't go photoshopping it into something else or use it to sell something.

The attribution can simply be a text photo credit that is a hyperlink back here - that's what Gawker Media sites do for the pictures they use from their flickr pools.

You should not copy this to other photo sharing sites (like photobucket) to use it in a blog posting - use the images as they are served here by flickr or imbed it within your own blog. Copying it to other photo sharing sites can lead to others finding it out of context and not being able to identify the license.

This photo is a derivative work of a photo previously used by other Gawker Media outlets via the Consumerist Flickr Pool.

This particular use of my photo is an unlicensed derivative work contrary to the Creative Commons Attribution No Derivatives license. It also lacks the required attribution.

Please remove this derivative work and the copies of the images from your media resource libraries.

Has a cropped version of an image from the Crunchgear article that originated the image (http://www.crunchgear.com/2008/05/15/comcast -vans-cause-crash-while-street-racing-3-year- old-in-hospital/).

Crunchgear improperly used my photo without proper attribution and created an out of license derivative work. Several other media outlets have referenced Crunchgear's picture.

I have already sent a request to Crunchgear requesting that they remove the derivative work.

Please remove the Crunchgear derivative Comcast Van photo from this leftlanenews article.

Feel free to use, with attribution, the original image presented on flickr at www.flickr.com/photos/cubicleman/393788467/

You may also feel free to crop and store on your own servers, but please avoid situations where others looking for media to use in future articles are, if they find the picture, able to identify the image license.

On June 1st, 2009 I changed this image's license from the creative commons: "Attribution, non-commercial, no derivatives" license to the "Attribution, no derivatives" license to permit those intended media outlets who restrict themselves to stringent observance of the non-commercial exclusion to use this image, so long as they provide attribution and do not create derivative works.

Lets go with some explicit guidelines.

Photo credits must include a text reference to my flickr account name or my name such as "Photo courtesy cubicleman", "photo credit: flickr/cubicleman", or "photo courtesy Tyler Yip" with the text reference being a hyperlink to this photo's flickr page.

Images themselves must be either direct image links to flickr as described in the flickr terms of service, copies on your web servers themselves, or on your content distribution networks. No 3rd party photo sharing sites or closed copies on flickr as those present the images in the absence of references to the license, leading to confusion.

If the image in your article is clickable it should go either to flickr here, to your copy of the image itself, or to your article's individual page where the photo credit is presented.

You may crop or resize the image. Under no circumstances should you otherwise alter the image as that would result in a derivative work.
