La violencia sexual es una de las forma más críticas de la violencia contra las mujeres y las niñas y los niños. Es una forma de ejercicio de poder y una expresión de desigualdades entre sexos y generaciones, que afecta en mayor proporción a las mujeres jóvenes y a las niñas, atenta contra la dignidad y la libertad sexual de las personas, vulnerando sus derechos sexuales o reproductivos mediante el uso de la fuerza o la amenaza de usarla, la intimidación, la coerción, chantaje, presión indebida, soborno, manipulación o cualquier otro mecanismo que anule, limite la voluntad personal de decidir acerca de la sexualidad y de la reproducción.
Según el Ministerio del Interior, de enero a agosto del 2007 se registraron 4910 casos de violación sexual, los mayores porcentajes están en Lima 38.2% (1740 casos), Arequipa 7.5% (342 casos) y Cuzco 6.8% (311 casos). En el 93% (4551) de los casos las víctimas son mujeres. Las jóvenes entre los 14 y 17 años son las principales afectadas por violencia sexual (44% de los casos). Según el Ministerio del Interior cada 4 horas 3 personas son víctimas de violencia sexual.
Asimismo, de acuerdo a los servicios prestados por el Instituto de Medicina Legal, durante el primer semestre del 2007 se reportaron 13 mil 057 exámenes de integridad sexual (Violencia Sexual) a nivel nacional.
