Illegal Shot?

Today we took the subway system to taste of Buffalo. I parked at the college and when I tried to take pictures of the neon lights on the ceiling in the station a police officer told me it was illegal to take pictures in a subway station. I asked him why and he said because of 9-11. The 9-11 card seems to trump anything you can say because if you say anything after that your like a commie left wing nut or something. Seriously though my whole day was ruined and I didn't shoot anything at taste of Buffalo because I was thinking I never got the newsletter about how I lost my right to photograph in public places. OK, so because the Govt./military failed horribly on 9-11 and apparently we have no air defense because a group of terrorists managed to pull of a military style attack. - I can't take pictures of the Buffalo Subway Station and also it's illegal. I can't wait to see what other things are illegal soon. I curse the subway to urbex future. I will take pictures of it in 20 years when it's an urbex gold mine.

    Note section 1050.9 (part C) on mta.info/nyct/rules/rules.htm (NYC subway) - and if that's NYC, I'm sure Buffalo is no different.

    Wow this is a great picture...

    yeah... I can definitely see the policemans point. It starts with taking just some nice pictures but it inevitably always ends with a big desastrous explosion - I think this guy saw too much bad movies!

    9-11 was allowed to happen by the govt. while they already had info that shit was going to happen. The facts are all there, but you don't hear about this on 'FAUX'-News or NBC... Sadly i don't even make this up either.

    It must have been just too damn convenient for them and a nice way to finally push through all this homeland security bullshit on us and slowly turn everything in a police state. Nowadays 9-11 is the perfect excuse to get away with anything.

    Authorities love to abuse their power and intimidate people. And Jeff is right, you will win from them eventually since most often their threats are based on false pretend. But since almost no one wants to go through all that hassle they get away with it. Intimidation works and they know it.

    I don't think that Photographers Rights sheet will do any good in most cases. It's completely vague and doesn't give you any rights at all. We bring it with us too, but I wonder why. It's only giving you some advices what might be smart to do and what not. Plus it's very outdated. On a daily basis more and more bills are passed that take away our freedoms. Things have changed a lot since this sheet was published.

    For instance (irrelevant to photography though, but still something that not many are fully aware of...) evesdropping on phonelines of every American citizen can now be legally done by authorities without a proper court order. It just passed very recently. So who's to decide you're a suspect and who's going to monitor the people that monitor us? It's too damn easy to abuse this and use it for other purposes than to 'fight terrorism'. Big Brother already exists for decades and it getting stronger every day. Only most people don't seem to give a shit about it and love to live in ignorance. People that don't value their freedom don't deserve to be free.

    And also Obama is a supporter of all this wiretaping. So our future looks great... Regardless if McCain or Obama wins, the loss of freedoms, rights and privacy will continue. It's the old commie-witch hunt all over again. Where do they or WE draw the line? It's matter of time till this country turns into another East-Germany where neighbors will be watching each other in a STASI-like manner. Soon it will be the most normal thing that everything we say, type or do will be constantly monitored, filed and archived and at some point used against us if they see our opinions as a threat.

    Most American's are lulled way too much into a state of apathy and acceptance, thinking it's for their own safety. Brainwashed to think that giving up your rights without question is patriotic. And you guys are right, when you speak up you're labelled as non-patriotic or you're an instant suspect. While it is actually patriotic to fight for your freedom!

    Isn't that what the whole constitution is based on? It's patriotic to question authorities since they are supposed to be our representatives, not our oppressors. Fighting for your freedom is constitutional. But the brainwashed sheep with their nonsense 'patriotic' bumper stickers and their narrow minded conventional and warmonger political views are the real danger to this country. They allow this crime against us to continue by supporting a govt that only acts in it's own best interest and starts shit with everyone. Playing world police and rubbing people the wrong way. Invading countries for the wrong reasons and leaving other more serious issues ignored. Wasting endless amounts of tax money on the war machine and in the meantime letting our whole country go to hell. Our economy is so bad that we actually borrow money from third-world countries. Again I don't make this up. What do you call a country that borrows money from a third-world country? ... I don't know but it is definitely very sad!

    Although there's still the illusion of freedom of speech, saying or typing things like this will make you end up on a black list somewhere eventually and increases the chance of you being monitored. Welcome to the Republic of Chinamerica! And yes I'm still typing this regardless because I still think there is hope when people start to wake up again and speak up. We're all caught in a downward spiral and although there's little we can do as individuals we can still do a lot in larger numbers. But i'm merely an idealist. I've witnessed the attitude of people in this country now for years that' i'm here and I'm afraid things will not improve but only get worse. People that monitor us for things I just wrote should seriously question their own morals and their loyalty to what the USA is really about. I've been only here relatively short, but I seem to care more about this country's state of affairs than most born and raised 'Americans' do. Shame on them!

    Sorry for my manic manifesto. I don't think my ranting will have any impact at all, but still it feels good to get it off my chest now and then :) I get these moment's occasionally and this EXCELLENT photo plus caption triggered that again ;) I'm glad you brought this subject up. It deserves to be discussed more than anything! People need to question more what's going on these days.

    I think he's completely full of shit and indeed there's nothing anywhere that states you cannot take photos in or of the subway. but yeah, it's such a grey area these days that you don't know what can or cannot be done anymore. And i think they even like to keep things as vague as possible so they can make up rules on the spot and enforce it on people even if it's bullshit. It helps if you wear a uniform, people will obey too easily.

    People with SLRs are just a more easy target to harrass since it's so obvious they are taking photos. What about the millions of cellphones out there with camera capabilities... or all the point and shoot cameras that are getting smaller everyday and often already have more megapixels than the average SLR? There's no stopping in people taking photos of everything these days anymore and I don't see how pictures like these can form any danger. If someone would want to blow up a subway or any other public place you think they wouldn't walk around with a huge camera drawing all attention to them?

    Google Earth or Windows Live are many times more dangerous than any of our pictures can ever be and that's even outdated technology compared to the realtime high definition satelite capabilities more serious people have access to. Do our cameras really make them that uncomfortable? What about the spy satelite that Iran launched several months ago? Or all those Chinese hackers (hired by their government) getting in US networks on a daily basis? They're focusing on the wrong people and should leave us alone letting us live our damn lives instead of turning everything into a prison for us. The land of the free is no more. It has miserably failed.

    Homeland security is a total farce. If people would plan attacks they will just do so and there's little all these false security measurements can do to prevent that. It's only there to give people a false sense of security. Who the hell are they fooling? It's nothing but an excuse to keep us in fear so we easily and happily give up more and more rights every day. It makes me sick!

    That asshole you ran into should just stick to eating donuts. That's the only thing most cops are good at.

    We pay that guy to harass photographers every day and he goes home and feels satisfied that he is serving the public. We should go tell him what we think.

    Well I called the NFTA Police and told them what happened. He said that NFTA is privately owned and if they don't want me shooting in there he is well within his rights to ask me to leave.

    Okay, I didn't know it is privately owned. That indeed changes everything. I'm glad you still managed to walk away with these shots. Almost the exact same thing happened to me at Schiphol Airport in Amsterdam last year, but that was of course to be expected at an airport when you walk around with an SLR with hooded wide-angle lens ;) I still got away with some shots. But stuff like this can really be a bummer. I wish we could all go back to the old days when things were still fun and less demotivating.. :/
