i am for hire and available for custom art work/commissions, portraits/headshot sessions, events and whatever else you can come up with that needs to be photographed. please contact me by email with the details of your assignment or proposal.

notice and terms of use: as of april 22, 2008

like many photographers online, i get lots of emails asking to use my photos for various purposes. i've also found people out there using my photos without permission or any notice. i do not wish to remove my photos from public view, so i am setting out some official guidelines to be followed.

1 all photos in my flickr stream are copyrighted "all rights reserved" to me, stephen gray.
1.1 i do support the "fair use" of media, but make sure you understand the meaning of "fair use" before using it as your defense.
1.2 there are no (0) creative commons licensed photos in this stream. (sorry. i like the idea of it, but it needs more work and legal precedence.)
2 please do not use any photos in this stream without my permission.
2.1 if you wish to use a photo from this stream, please ask.
2.2 blogging exception: i do allow blogging of my photos without prior permission, as long as credit and link-back to the source are provided. also, if you let me know that you've blogged my photo, i will add a link to your blog from that photo. it's a win-win.
3 most photos in this stream are available for sale or license. contact me for details.
3.1 if you wish to use one of my photos for commercial purposes, you will have to contact me to work out a licensing agreement.
3.2 note: in most cases, i am no longer "giving away" photos for commercial purposes in return for "exposure". this includes most "non-news" editorial publication as well. of course you can still ask--who knows? just be prepared to quantify what "exposure" means and be able to verify what you promise to deliver. to me this kind of trade means that i'm in effect buying advertising in your publication or website. so just as with any advertiser--if you tell me 10,000 people will see my photo at the top of your website each week, then i'll need to see your metrics and see some kind of bump in my own stats as well.
3.2 i am still open to donating ($0 licensing) of photos to worthy non-profit organizations, public radio/television stations, or truly independent art/media projects (including open source news). please contact me for permissions and details.
3.3 usage agreements made before the initial publication date for these terms (april 22, 2008) are still in effect, however, i reserve the right to review, request changes, or end any previous non-binding agreement at any time, if i feel it is no longer equitable. (non-binding = we don't have a contract or license agreement in force.)
4 all portrait sessions will require an applicable release to be signed.

    Simplicity of a viewed language of image, a coherent lingua franca of photographic intent, is a most difficult thing to attain.
