how to stop someone publishing pictures of me??

The laws depend on the country, I think, but in the US you're allowed to publish photos of a person taken in a public place. IANAL, but I doubt that you're allowed to post photos of someone in a private place, for example their own home. Feel free to correct me.

I'm afraid it's not very easy to answer both questions. I think generally the pictures you take are yours (subject to some arcane issues like "work for hire"), and you may do with them as you wish in the privacy of your own home.

As for doing what you want with them in the public arena, things get fuzzy. You don't, for example, say what country you're in. If you're in the US, you don't say what state you're in. America has no federal laws on privacy. Privacy issues are based on what the various states say, and they all say different things. Some states have specific statutes on privacy, California has a right to privacy in its constitution, and some states rely on the Restatement of Torts, a version of English common law from the days of the colonies. Some states have a right of publicity which governs how photos may be used, in addition to a right to privacy.

As a result, you can have the same set of facts and get completely different results depending on what state's laws apply to the allegedly offensive use of the photo.

Whether the photos are 'nudes' is not a key issue in what you can do with them, by the way. I post photos of naked people on my other web site all the time. The issues revolve around whether you have violated someone's right to privacy -- and that's not a black or white issue, I'm sorry to say. The fact that someone objects is not sufficient to win a court case, by the way. Many people who sue for violating their privacy lose.

:-> How could what be. I suspect you're confusing your ownership rights in a photo with my rights to privacy. If you sneak into my house and take my photo while I'm asleep, you may have full ownership rights in the image, but you may also have violated my right to privacy or my right of publicity (this depends on state law). Publishing the photo may expose you to some liability for damages if I decide to sue.

All your rights to the intellectual property in the image are still yours, but your public use of the photo may cause me some harm.

Copyrights and rights of privacy are not related. Is that the confusion?

i would contact the person, ask them to remove them. the thing is if the photo doesn't have you as the main subject, it may be out of your hands. this is one of the reasons model release contracts came about. i actually have model releases for animals in my "pets" set. i did it as a precaution.
