DaveP, I noticed you had a couple photos on the site. I agreed with Spear at first when I saw the link backs to both the photo and your flickr homepage; however, then I noticed the license you applied to your images I was fairly cranky.

The groups responsible for that site are paid for by the city councils as a dedicated PR firm. The should understand what "All Rights Reserved" means.

Yep, they removed all the flickr photos. I think there could have been a great partnership opportunity between this flickr group and the site. I'm guessing that everyone who had a flickr photo up there would have been thrilled to have their photo selected, with permission of course.

I'd have to agree - I would have probably been a bit flattered that they wanted my picture up there. By simply asking would have saved them a lot of trouble and hassle. If someone just takes, I'm going to be mad about it. If they ask, I'd almost always say "yes", because it just is going to help me out.

Compensation is always welcome too. :)

I commented on the site that I was surprised to see the group pool there, since I was unaware of any affiliation. I mean, the least they could've done was post here about it. I learned about the site via a TV commercial.

Either way, Weber Shandwick (the PR firm) deserves a spanking. And if you go check their website, it would seem (contrary to Souch's piece) that they're a New York firm.

As the Pace commercial said, "New York City?! Get a rope!"

While we absolutely want to observe each user’s Creative Commons settings, our programmers didn’t realize all rights reserved photos still appear in the pool’s RSS feed. We apologize.

It was not okay for us to pipe that content in without asking permission, and while it was our intention to reach out to you before going live, it didn't happen.

I was going to post something earlier today, but our programmers were trying to see if they could isolate "open" photos vs. the others. They can't, and that's why we've disabled that portion of the site.

If it’s not too late, we would love to start a discussion about using your photos with attribution and links back to Flickr. Yes, we're a little slow, but we humbly ask you to give us a chance.

The entire concept of the site is to showcase the unique, creative assets of Minneapolis St. Paul, and we identified this pool because it epitomizes the campaign’s mission.

Some of you know me from my Mpls music blog and from Metroblogging Minneapolis -- I had no idea this was happening until today and want to my best to make this right with you.

Thanks for trying to do it the right way! Probably the the best thing to do would be to create a brand new group, More to Life in MSP or whatever, and then clearly spell out in the group description that photos added to that pool will be put on your site, regardless of license. I've seen this done with lots of other websites, like the Consumerist.com pool and the HotelChatter pool. Then advertise your new flickr group here and in other Twin-cities related groups.

I was reading this thread rather belatedly and had to chuckle about the language in their contest rules.

A photo "acquaintance" of mine just had a large-scale advert customer come back to him with similar usage language in their photo contract -- apparently no one pays for usage and copyrights anymore! Although this type of language appears to be the norm for "photo contests".

Its also disheartening that advertising folks raised and educated dealing with copyrights and public image would be so quick to grab images otherwise copyrighted without permission -- then backpedal when caught. I have a sneaking suspicion that the Napster and Limewire style of usage rights has permeated the industry now that the "Download Generation" has come of age.

Why pay for a copyright -- we can just download the image for free!

I'll have to agree with what smcgee said - you should create your own group, post the rules for the group, stating what you will be doing with the images (RSS feed to your site), and let people put images in the group.

I don't think you'll have much of a problem with having people join, unless you have that crazy OWNERSHIP/RULES OF ENTRY applied to the images in there too.

I see "more to life"'s former move as akin to somebody (let's sat, me) walking in to a museum, stock on their coffee, use their phones for international long distance, and their break room to get my lunch from their fridge, and their fountain to wash my clothes. Oh, and help myself to some frames for that redecoration I've been meaning to do. I mean, it's right there for ready use, isn't it?

Now, I'm sure they (the museum) would really appreciate it if they were asked.
