About Say Cheese, Buffalo! Photo Contest

This is a photo contest sponsored by the Buffalo Niagara Convention & Visitors Bureau to showcase the beautiful sights of the Buffalo Niagara area. Each photo submitted has the chance to be used in various BNCVB publications and on its website, to promote the Buffalo Niagara area as a fun and exciting place for out-of-town visitors and locals. An entry form must be submitted with each photo. So grab your camera and help capture the beauty of Buffalo Niagara.

WHO IS ELIGIBLE

The Buffalo Niagara Convention & Visitors Bureau, Inc. (“BNCVB”) Say Cheese, Buffalo! Photo Contest is open to ALL photographers worldwide of all ages, except employees and directors of The Buffalo Niagara Convention & Visitors Bureau, Inc. (“BNCVB”), their immediate families and individuals living in the same household as such employees. BNCVB reserves the right to verify, in its sole judgment, winner eligibility.

WHEN TO ENTER

The contest is on-going and has seasonal periods of entry:

SUMMER: July 1, 2009 – September 30, 2009
AUTUMN: October 1, 2009 – December 31, 2009
WINTER: January 1, 2010 – March 31, 2010
SPRING: April 1, 2010 – June 30, 2010

Judging will take place shortly after the ending date of each contest. We would prefer that seasonal shots be turned into the appropriate category. Each of the contests will have a 1st place $100 winner.

Photos & entry form may be submitted in three ways:

PHOTO HINTS/TIPS

Submitted photos should include people enjoying all there is to see and do in Buffalo Niagara including, but not limited to, attractions, sporting activities, shopping, dining, wine tasting, arts & entertainment and more. We are looking for people interacting in order to give the photo context.

Contest Rules: By entering this contest you agree to these entry rules and the following legal conditions.


CONTEST RULES

1.) Photos must be taken in Erie or Niagara Counties.
2.) Either digital images or prints may be submitted. A minimum 4” x 6” size is required. Digital images must be at least 300 dpi in TIFF or JPEG submitted via CD, DVD or email.
3.) Entries submitted through Flickr must include the tag saycheesebuffalo09
4.) All entries become the property of the BNCVB and will not be returned.
5.) Photo credit will be given for all uses of image by BNCVB
6.) The BNCVB assumes no responsibility for loss or damage to submitted photographs.
7.) Each photo must be submitted with an entry form, which includes a publicity release / permission to reprint form. All accepted photos may be used in various media formats for an unlimited amount of time and at no cost to the BNCVB.
8.) Any person recognizable in the photo must sign a model release form and this must be submitted with photo submission.

9.) Contest entrants agree to all the rules and regulations set forth and by the decisions made by the judges.
10.) Judges decisions are final.
11.) The BNCVB is not responsible for any inaccurate or incorrect information.
12.) The BNCVB reserves the right to suspend or cancel the contest without notice.

By entering, participants warrant that his or her entry materials are original, do not infringe on any third party’s rights, and that participant has obtained any necessary permissions from any third party if a third party or third party’s property appears in the photograph. BNCVB reserves the right to disqualify any entry if it finds in its sole discretion that any of the foregoing warranties are not true. Decisions of BNCVB shall be final and binding.

Participants shall retain all ownership rights in the Submission. However, by entering the Submission, Participant hereby grants to the Promotion Entities a universal, non-exclusive, non-expiring, royalty-free, sub-licensable and transferable license to use, reproduce, distribute, prepare derivative works of, display, adapt, reformat, translate, and otherwise exploit and perform all or any portion of the Submission for any purpose whatsoever, including, without limitation, in connection with the Promotion Entities network of Internet websites, wireless applications, interactive television, video on demand and any other media or technology (including, without limitation, Internet protocol, wireless or interactive platforms or interfaces) through which Promotion Entities distribute content to end users, whether now existing or hereafter developed (the "Platforms"), in any and all media formats and through any and all media distribution and advertising and promotional purposes, without accounting, notification, credit or other obligation to the Participant. For the avoidance of doubt, without limiting the generality of the rights granted to the Promotion Entities, these rights include, without limitation, the absolute right to edit and/or alter any Submission distribute and synchronize all or any portion of the Submission in timed relation to any other visual elements; to web cast, pod cast, re-publish, re-broadcast, re-platform, port, syndicate, route, and link to and from all or any portion of the Submission; to encrypt, encode and decode, and compress and decompress all or any portion of the Submission; to edit, mix, combine, merge, distort, superimpose, create or add special effects, illusions and/or other material to or of all or any portion of the Submission; to create composite, stunt, comic or unusual photographs, videos, animations, motion pictures and/or voice reproductions from all or a portion of the Submission; and to excerpt and/or extract portions of the Submission in order to host, store, index, categorize and display the Submission on or through the Platforms. The Promotion Entities reserve the right to use (or not use) the Submission at all and/or as little of the Submission as they so choose.

By entering, participants release and hold harmless BNCVB, its affiliated organizations, and each of their directors, officers, employees, attorneys, agents and representatives (collectively, the “Companies”) from any and all liability for any injuries, loss, claim, action, demand or damage of any kind arising from or related to the BNCVB, any prize won, any use of the entry materials by BNCVB, the warranties participants make, any misuse or malfunction of any prize awarded, participation in any BNCVB-related activity, or participation in the BNCVB.

By submitting the photo or information to the BNCVB, you hereby represent and warrant that the submitted photo or information does not and shall not infringe on any copyright, any rights of privacy or publicity of any person, or any other right of any third party, and you have the right to grant any and all rights and licenses granted to the BNCVB herein, including but not limited to all necessary rights under copyright, free and clear of any claims or encumbrances.
