Needed: advice on stolen work.

On the left is my original design and photos. On the right is a stolen copy posted on Etsy.

I have been in contact with the young woman who owns this shop. She has denied any wrong doing, except using my photos. She maintains that since she did not have to pay money for my design, that it is hers to sell as she wishes. Her last email stated that she even plans to make more of them this fall, and "there's nothing I can do about it!" She goes on to accuse me of harassment and "acting like a child." Hmmmm....

I found out about it through another designer who was also a victim. Turns out there were at least four of us she stole from.

I have contacted Etsy, and am waiting for their reply. I have also been advised to contact my state's Attorney General.

I'm not sure how far I want to take it. While I'm a bit flattered that she liked my scarf enough to steal, it really burns me that she has been so blatant and so rude about it. I probably would have let it go with just an, "Oops, sorry."

I'm curious if any of you have had this happen. How did you handle it? What was the outcome? Any great advice?

You have contacted Etsy which is good. Keep her emails too, to forward to them if you need to (I would quote one in your email to them) to show that she is aware that she could be infringing and has said she won't stop making them.

How much a design costs is irelevent if you originally stated that it was for personal use only. If she just copied it from the screen, then there's no question.

One slightly unhelpful comment, however - since we can't see her actual scarf we can't see if it's actually identical. This design isn't uncommon and I have made similar things without reference to a pattern because I've crochetted flowers for so many years, so it is possible she may get away with it on those grounds if she stops using your photograph. :( (I have never sold my pieces though, they're just for me)

She's clearly ripping people off and you are doing the right thing. As you say an innocent slip-up is one thing but she is an example of exactly what those protection laws are there for.

Be sure to keep a back-up of your conversations with her and all your images.

Whether or not she's copying your scarf we don't know since we can't see hers, but your images are copyrighted, not just your work. By using them she's not only breaking copyright there, but I would imagine is in some kind of breach of advertising by using an image of someone else's work as a representation of her own.

It'd be like me saying 'I make bags' then showing one of Prada's!

I hope you get it sorted and do persue it, you're helping all reputable makers by doing so as well as protecting your own work. Stick at it and lots of luck.

I am so sorry to hear that you are dealing with this. We all hope as artists that our designs are our own, but sometimes that is not the case. Unless she used the same exact yarn, stitches, number of petals, size of piece, ect. as far as I have understood it, it is not a protected design. I would have major issues however with the use of your own pictures. I liked that you were willing to just chalk this up to someone flattering you by using your design. However, I could understand and relate to reacting the way you have due to someone else's unwillingness to at least admit that stealing your picture and idea are not good business practices. I am a knitter and I worry about this myself. Good luck and just know that you have supporters out there!

Keep all the emails because her language sounds shady, especially if she admits that she stole pictures, etc. Also, keep in contact with the other victims, because evidence of a pattern of this behavior (no pun intended) will be useful in the future when dealing with etsy, the law, etc. Hopefully you can get proof if she is truly copying your scarf. She sounds really annoying to deal with!

There's not a whole lot you can do about her selling the design unfortunately, but since she did use your photo, you actually have grounds to sue for that.

It's your photo so you retain the copyright to them. It would just depend on how far you want to take it.

So sorry that you have to deal with this! It does happen on Etsy often, Etsy has said "if you don't want people to copy you, then you shouldn't make anything." Hopefully Etsy will be a little more supportive with you! You can contact the web-host, that her website is using, and then from there it's just a matter of filling out and submitting NOI forms (notice of infringement). I keep the forms under favorites because photo stealing seems to be so popular right now.

I am so sorry too for your unfortunate situation... It's just not right to use someone's picture without asking permission, even worst to copy your designs and works. I can feel the pain as an artist.

If I were you I would keep all the communications and also would make screen shot of her listing... for future reference. If you'd like to go further, actually you can catch her by law for copyright. If this is a very serious thing for you, ask for an advice from legal person.

To be honest a flower scarf is pretty common - I mean it's one of the first projects in the happy hooker and they're all over the place.

But just stealing someone's picture and claiming you made it?! That's low - I can't believe people can be so shameless... is the other photo on her listing yours too?

I'm pretty sure you're only allowed to use someone's photos on your website if they've allowed them to be used in the public domain and you credit them. You have that on your side and I hope etsy think that way too.

There's another case of this kind of thing (sort of) happening on Etsy. There's an Etsy shopowner who buys art glass from artists, and then resells it saying that SHE made it! Etsy has been contacted MANY times by the numerous artists this has happened to, to no avail.

making a watermark depends on what pp software you use...i made mine in photoshop elements...

do a search on Flickr for watermarks and the type of programme you have (elements, corel, gimp, photoshop, cs2, cs3, etc)...it should give you some threads to go on...

Lower than low! The picture is obviously copied and if she did that, no doubt she is copying the scarf too. Probably will now alter 1 row so she can say she didn't, but this is terrible! I would report it to the attorney general & see what could be done. Did she buy a pattern or scarf from you? If so, did you mail it to her? If yes, the def. talk to your Atty. general. Also, talk to an attorney. If you can't/don't want to afford one, check into legal aid or some artist guild type. Most def. send her a cease & desist letter w/ a copy to Etsy. Etsy may not do much of anything, because they don't like to be involved in "disputes between crafters", especially if you do not have a trademark, patent, or registered copyright. If you do, send copies to them w/ the cease & desist letter.
I hope you can get this resolved & I am sorry that someone, especially an Etsy someone, has done this to you!

Update: I got a form letter from Etsy asking for the documentation of the issue. I will go ahead and send it in. As I said before, I was willing to let it slide, but now that I'm seeing more and more of this happening, I'm feeling a bit like a pioneer. I see the need to move forward on behalf of us all. I'll keep you posted.

Yes you can make a watermark with any photo editor by typing your name in white then remove most of the white , then add a bevel adjusting the layer level and that is it. Photobucket has a pretty good photo editor these days and it is free!

i've been watching that some items, patterns & handmade, are copied...i'm kind of hopeless seeing those...i don't know anymore what is the purpose of etsy...

some friends in etsy forum said that copying happens...can't really avoid that...but really, that seller is very-very lazy, i think...just stole the pictures like that...very-very lazy...

As a job seeker for next 4 years, I put a lot of hope into things like etsy etc... My family tries to its best to help me in order I have something to do from my days (stuffs are expensive so), in order staying like that waiting someone calls me for a job where we live, what never happens, unfortunately, as firms close & close & close more & more for more 20 years here, as professionnal always want people with an exact diploma very special I never have etc.... but so.

So I imagine how much it hurts when such things happens, as it is a lot of efforts we put in etsy etc work,

With so much hats on our head, we make a lot of different tasks that can attract people who don't have the desire to work so much, & so prefer to make "copy & paste" on other, it is so much easy than to work for real.

Once time, I met such people via internet.

One of them told me : "why do you want I work, as it is so easy to copy & paste the work of other people for free and so obtain things so quickly without any efforts???". I was totally stuck.

I was more young, knew nothing about internet, was a kind innocent.
As my family gave me an education which consist to help others, to be kind, to be honest, to respect other & their work, etc... to have moral values, I didn't see the things happen.

My work has been noticed by magazines in France in 2005/2006.
As you can imagine, some people became bad to me by jealousy as my work has been published a lot of times everywhere very often,
& other became fake, they did as if they were very nice for false with me, by interest. As a result, I get absolutely no job nowhere, when every newspapers called me several times per year to publish my work.

To sum up, in front of me they were very nice & sugared, but behind, they told to everyone (magazines included) that nobody have to talk to me,
took my ideas, & told to the magazines it was theirs, & took the job promised to me by the magazine.

So when I wanted to give workshops, nobody came. When I've got 6 years of professionnal experience into this job.

The job center counsellor advised me to make a letter about it, but it did nothing. It was worst.

A house of edition contacted me in 2006 to write a book for them, always made me work without any signed contract, or wage,
what began to fed up me a lot,
after it has been told me that I had to make the whole creations of the book on my own, by buying all the stuff by myself, when the people knew I was a job seeker in a bad financial situation,
so I began to find it a bit exagerated (you work for free, and after you pay for the work you do),
at a final point, after several appointments, the edition contact mentioned several strange clauses,
inside one which mentioned I'd have to let my entire work to the edition house, who'll keep the right to replace my name by the name of someone else!!!

So in fact, after a dream of long years, & long years of work,
& after having spent all the family's money,
they dare to ask you to let your entire work to the benefit of a stranger!!!

What else???
(the other clauses were to be paid (not a lot of money moreover) next to more 2 years after the book having be sold ; that the books which have been distributed freely to journalists & teachers you can't be paid on at all (and it was a lot of them distributed freely on the whole, I didn't understood why distributed to teachers as here advert in schools is forbidden) ; & every books resold in cheap stores you earn nothing too on it at all (what is a lot of books too), what means in fact you spent more on energy & stuffs that you earn in wage ; & if you want to take back your book to put it into another way etc, it is impossible, it is the edition house property forever etc...).

So I said no. If I have got to work & realize my dreams, it is not for a stranger's name appears on my own work. Don't you find???

Quickly, I received thrills & hard words on my private e-mail, blog, internet gallery, & at the begining phone, during months, ordering me to go away or... the person used the sentence : "I'll erase you from the scrapbooking area".

My account from forum has been closed without any valuable reason given when it was other people who let thrills & injures on it.

I had to clean my computer everyday from these messages several times per day.

The juridic organism from our region advised us to register every of that and to send it to them.

The name of my blog has been given to me as a nickname on internet by american people because I'm french (The french touch), months after, I noticed it has been took by craft brand as a name of brand without asking if I was ok,
when I used it for months for my blog, my etsy, my dawanda, & my art/crafts worhshops here.

On a forum, we had to post our etsy links everyday like you do here to know us eachother. Once time, I noticed an etsian made an entire copy & paste of everything I wrote on my profile about my shipping & products mentions!!!
As we don't have the same kind of way to write & express ourselves, & as I translate myself in english what I tell (so suppose I've got my personal mistakes into your language), I immediatly saw the copy!!!

I sent her a private message, but she dared like for your case, to pretend it was a "hasard" we had the exactly same text (and the cow is pink with green dots too, lol), but curiously, some minutes after, she changed her text... If you don't have to reproach yourself things, it's a fun way to prove it.

But since then, nobody let messages on my blog, even if it is read everyday, & I can't post any pictures, as I noticed a lot of similarities between pictures of work I posted on internet galleries, blog etc, & those published for commercial reasons months after with expensive brands products for a commercial purpose.

So, people don't want to engage me (what put my family & me into a very serious financial situation), when a lot fo people made congrats about my work & my resume, but it doesn't disturb them anymore to copy my work. Beautiful mentality.

These 4 years of my life, never anyone could be able to give me back anymore. It's time lost.

As you know, even if it is difficult to invent something nowadays, we all have habbits, a style, so a kinda personal signature, "manies" as we say in french, & when people make copy & paste without making their mind of what you have the habbit to do for years, you see it immediatly.

You know, since the beginnings I put copyright & intellectual property mentions everywhere, but it seems it isn't enough.

That some few people, stores, firms, workshops or magazines don't want to give us jobs with wages & pay us for the job we do with so much energy & efforts, it's a thing, if the budget isn't big enough ok,

but make a copy & past of what we do without our allowance & signed authorisation as the laws forcast, for what such people do, work & earn a lot of money with, I'm not ok.

It means that our work isn't so bad like that & deserves a job with a wage.

So, when you say we can be happy in a kind of way to see our work copied because it means it is a good work,
maybe I could say yes in the past.
Now, through the situation I lived & I'm living : I say now.

Our work, our efforts deserve to be protected.

It gives people who earn a lot of money through copying our work easily without any regret, by not respecting the rules.

So why don't we earn a correct wage,
by working honestly, just simply???

i agree with you...i saw so many "simple" pattern but i don't know how... it's just a special handmade in the end...and i just knew it, it's one of a kind...this thing is one of my main thought in struggling again in etsy...
i think i know how to make quick sales in etsy but that's not the point...i always want to be a designer and i want to be acknowledged and appreciated for my crafts...

I just wanted to have friends when I began to surf on the web,
& beside find a job thanks my creative abilities.
But I didn't always fall on good ones for the start, unfortunately.
It is difficult, after the experience I had, to make trust in people.

I believed that it could give me happiness, like I felt by doing it,
like I felt by learning it,
moreover when the woman who taught me it in stores told me I was made for such job. Children smiled so much, when I gave them art workshops, during my 6 years professionnal experience!!! ;o)

But when I arrived in the crafts area, wow!!!

Like you say, it was tough. Met some strange people for who the glory, their pic on magazine's cover & money was more important than the passion itself. Some did crafts only for that, without having any passion for that.

I don't live in teddybear land, lol, I don't take myself for Candy, rotfl,
but it is a gap between being human, respecting people,
being honest & respecting the rules,
whatever the area we are,

and how hard people were to me (& to other people I suppose, as it is the theme here) just for free, just for fun,
just to play.

Or like you said, just because they are lazy. It's an education question.

To me, I prefer to be poor like now but respected & honest,
than full of money & not respected, not honest.
It makes me more happy!!!

She must be just plain lazy! Everyone is correct! Keep everything, all emails, all correspondence about this. Write down dates and note times. I'm glad to see that you are moving forward with this. Keep strong and don't back down. A message needs to be sent to thieves like her! If people don't take any action, the thieves win. So, don't let her win! I wish you luck and hope you will let us know what happens.

I have heard about the lady in Italy buying handmade lampwork beads and selling them on Etsy making it look like she made them herself. I hope she gets the boot real soon! I'm sure legal action is being put into the works. I've purchased handmade lampwork beads from very talented artisans on Etsy, and when I include them in my jewelry pieces, I note in my descriptions that they are genuine and announce the glass artist's Etsy shop. It's just terrible that people will sink so low as to steal someone's hard work!

I am SO sorry you had to deal with someone so harsh, cruel, ignorant and PROUD of placing this on you.
I wish that this may be corrected and put in proper place as quickly as possible-as we are ALL artists and work hard with our hands and have to maintain SOME sort of integrity in our work!!

sadly, a very under-used word in this world...

I am getting copies of all my correspondence together, along with screen shots of both sites (mine and hers). I also have the publishing dates from Ravelry to show mine was up well before her posting. (Obviously, it had to be in order for her to swipe my photos, right?!)

My brother is an attorney, but does not work in this area. He's ready to give me referrals if I want to go that far. At this point, I just wanted to run it by him to make sure I'm on the right track. He was also very encouraging.

Yes...This happened right after I contacted her. Both her shop and her blog are down. At first I thought this might be a good sign, but her most recent email indicates her intentions are to continue her behavior.

if your designs and pictures are copyrighted then that person just commited a crime....however if your work is not then i suggest you start taking measure to protect your work. I havent been able to do that with my stuff either but you should place your website or logo on each of your pictures so no one can just take it without having your original logo on it. Also i heard there is a way on photoshop to make ti so people cant just right click and steal your pictures i'm not sure how to do it myself though. I've seen people post other cases where someone has stolen their ideas from etsy I hope etsy helps you out and doesnt just ignore the situation and hope it goes away.

The story I explained to you happened on a period of 2 years, so being a job seeker, you can imagine all the consequences.
Not only to me, but to my family too.

As like I earned no money thanks to all the efforts, energy & work I put to find students & rooms for my workshops/demo... (I wrote to every crafts firms & magazines I found in France as in USA to find a craft job) etc, I couldn't reimburce my family, pay my phone bills, the gas to my fiancé each time we moved to search a place to work, so no money to pay new stuffs to create etsy products & earn new money, etc...

I even stopped the practice of scrapbooking, in order such bad things stop too, so much I felt bored & disgusted by so much bad behaviour (is it correct verb? bored?).

For me, scrapbooking was the representation of keeping souvenirs alive, maintain life & family for next generations, a way to de-stress & be more cool, more strong in front of bad moments of life, as I lived it for my case.
It was this I wanted to share with people in my region, through the workshops I'd wanted to organise, but found no rooms to welcome me, no students to take my courses.

And it is what I shared with children in 2004-2005, when I could teach american scrapbooking for the first time, & offered them an amaerican scrapbooking end of the year package gift, by collecting sponsors supplies gifts for the children of the northern suburbs of Paris in sensible zone, of the school where I worked there (camera of one use, stickers, pencils, papers, glue, etc, for an amount of 90€ per child, they were next to 25 children of my workshop to receive these gifts).

If you have could saw their happiness on their face : it was my most beautiful reward of my life : to give happiness. They kissed me, they told me it was X-mas!!! I never saw so much very opened eyes from my whole life.

Not a way to become rich & fame in 5 seconds only.

I worked so long & so hard I felt disgusted always seeing never efforts rewarded. Moreover seeing my family put so much hope into me, & so much money these last years (for gas, crafts supplies, computer, internet connexion...), in order I can have my own part-time job at home, waiting to find a real job where we live.

It would have been so easy for me to stay at home & do nothing of my 4 years of job seeking, waiting a job fall me on the head.
Easy & without any efforts.

Instead of that,
like all of you here,
I fight of all of my strenghts to earn my money by myself,
by working thanks to my creative abilities because it's the only thing I do know of my life,
to be independant financially,
to be happy,
to put money away for my future,
to help my family & not be a weight for them by always asking them money for this, money for that...
to pay my bills on my own.

So nobody have to forbid me anything, like it has been done in the past in scrapbooking area when some people forbid me to practice scrapbooking by thrilling me & my family through bad words on internet during months,
because french & american medias look at my work into their newspapers & magazines,

I work very hard for this,
it didn't happened by luck, by chance.

It happened because I worked very very hard for years, without stopping.

So nobody have got to make copy & paste of our works too.

Because it we let this happen,
it's an open door to anything not correct,
not integrity,
not good,
not fair,
not honest.

To me,
I think we didn't work all of us,
worked so hard,
so long,
& all of our families
& friends,
&neighboors
etc
didn't support us during bad as good moments
into our creative projects,
for we give up so near of the goal,
by letting anyone making copy & paste,
stealing our works,
or thrilling us like under people.

We worked hard.
We are allowed to defend the fruits of our efforts.

Voilà.
