Plz find a copy of The Daily Ittefaq of today (15July 2008) along with its supplement "Korocha", I believe "several" BP members' photos were published here without acknowledging the original owners (in fact, under other names)...............

Hasan Bhai.......... this has happended before the wound of The Daily Star healed........... yesterday The Daily Star issued the apology for the violation in their Star Campus magazine.......... they did the same thing with our fellow photographer Monir too (Catch the Dream)........ Monir was actually proposing a meeting with The Daily Star Editor...........

going public is one thing that we can do......... to make a BUZZ........ nothing less than proper awareness campaign will heal this..........

Two things we can do.
1) We can sue them – that is very complicated because victim has to run to court – lots of harassment involved.
2) Call a “Press Conference” at National Press Club – invite media and newspapers authority. I this way we can send our voice to everyone.

some problems are there in Option 1:

you can't catch the newspaper......... they'll say that the ones uploaded the pics in Facebook are the culprits......... when you upload the pics in Facebook, you have to certify that you own the pics......... so, its actually the fault of the ppl who uploaded pics........ the newspaper would go clean and you can't catch them....... but you can tell the newspaper that they cannot just rely on the claim of some amateur individuals when they are using the things professionally.......... checking validity of these things is a part of their professionalism that you can question........

Option 2 seems more effective to me......... one sue against one newspaper is not going to solve the overall issue......... you'll continue to see these stuff in other places.......... how many can you handle?........... its a matter of lack of awareness and complete disregard for the rights of the ppl who don't have a voice or choose to stay silent or simply not privileged enough.........

I think its not just newspapers we are worried about here......... what about the other media?......... if we sit with some newspaper editors, we would miss others........ they may not be that renowned, but they do count........... and this way, you simply can't reach at the millions of ignorant violators or accomplices to violations......... and lastly, I'm not sure whether you can manage that many appointments with newspaper editors that easily......... they are busy ppl.........

Here is a reverse scenario which really happened recently.

A publishing house in New York asked very nicely to publish a photo of mine ( which was available freely in the net ) in a book.

For the benefit of everybody I am providing the whole letter.


" Hello sytoha!

My name is Eri Hamaji, and I am the graphic designer currently working on the book on James Joyce scheduled to be published from Mark Batty Publishers NYC this fall. solving this problem is not gonna be easy, I guess....... its an awareness problem and we need to be patient with it......... we shouldn't expect everyone to be as informed......... educating the violators can improve word-of-mouth, which is vital in building awareness.......... lets not go into argument with the violators from the word go......... lets try to convince them first with logic and if it doesn't work, lets try other stuff.......... remember, they already possess the images......... and you just don't know in how many places and in how many ways they can use it and make a mockery of your rights....... one violation can give birth to even more violations........... lets try to bring these ppl under our umbrella; they'll work for you in the coming days......... lets not be heavy-handed from the start.........

I received a letter from someone in a far-away land who wanted to use a pic of mine for a personal presentation.......... I mean, how on earth I would've known whether he used my pic in a private presentation or not??........... there was absolutely no way for me to find that guy!!......... still, he asked for permission!!............. I wonder how far are we from those ppl............ let there be light!!

I have no idea if any of my pictures have been plagiarised on the net or elsewhere. However, I do know that in the past few months I have had about 6 requests to use photos from my gallery for purposes ranging from using images for book-covers to using an image for a sign-board at a cemetary! Apart from two pictures which were of young family members, I said 'yes' to the others. I was also glad that they asked my permisssion and not just use the photos.

I think Hasan Bhai's Option B is more viable. It will build awarness to the press media at least as they will be there at the press conference.

If the copyright scenario is so hazy in our country then we have to defend ourselves first.
I have a few suggestions, see if they work for you

1. Go to ' Your Account ' ( In YOU, just below FLICKR, near the top of the FlickR homepage ).
Go to "Privacy and Permission", edit it so that nobody can download your photos other than you.

2. If you really don't want others to down load your photo, withdraw all creative commons license from it. Because a photo having a creative commons license is automatically downloadable ( It actually overrides your download instruction).

3. If you have a free account, then you are in a safe zone because nobody can download your original file.

4. Remember FlickR is just a showcase of your photos, so never post the original file. Make a small ( in bytes ) copy of your original photo and post it. This small sized photo wouldn't be good enough for printing or publishing. If anyone is really interested in your photo then he or she would have ask you for the original file.

These are basic self defense tips. Protect your photos first.
Next steps is to raise awareness of the media.

We all have a "Print Screen" button in our keyboards. If anyone take a screen shot to capture the image, that image resolution is good enough to print in newspaper. Also make any small prints like Desk Callender, Post Card, Web Banner etc. What about it?

some nice tips for the members........... but these precautions are not enough, you know...........

if you download the whole page, the spaceball.gif trick does not work......... the image is saved with the saved webpage......... but they will not show up in searches; so, none can find your photo in Yahoo or Google search..........

my images are not under creative commons, but they are downloaded and illegally used regularly.......... so, I don't think license is a very important tool protecting the photos........

I maintain a free account, and had been a victim many a times......

I only upload 600 pixel pics........ I heard from Monir (Catch the Dream) that he uploads only 500 pixel pics......... and you know the result.........

I've been watermarking my images since my Ekushey TV affair........ and those watermarked images haven't been used that easily without permission.......... its an ugly but mostly effective solution.......... but I can't guarantee that someone will not break that too!!

But in a country, where we are used to pirated software, pirated books, pirated music, pirated movies and pirated what not ; what did you expect ?
Our media and our editors are really sons of our soil. So i fear it will be an uphill task to really get them into copyright issues.

Most of these thefts are done by the contributors and small writers of the newspaper..... apni jodi Ittefaq er article ta dekhen taile bujhben. 3 or 4 contributor ra Facebook theke sobi mere die ei kaaj ta korse.

Ar onek photojournalist er sobi e to churi hosse. So, they should do something to build awareness....so the press conference should work, in my opinion.

but I believe it would be very difficult to publicise against the kings of publicity!!......... journalists may be willing morally, but they're still dependent on the newspapers for their work to be published........ it may not be very easy.......... but just thinking it as difficult and not doing something would be inappropriate for our overall cause......... I say lets try out some things......... even if it doesn't work, we still would have the evidence of their extent of corruption........... turning a deaf ear to our effort would be yet another document.........

and if journalists are victims of these violations, I believe that strengthens our cause even further........... and another thing, such a press conference has to be like a "showdown".......... full and wholehearted support from most BP members is of utmost importance........

Regardless of the source of the images the editor has all the responsibility that whatever published in his newspaper is clean and they have to maintain their tight control over aquisition of images and any other sort of intellectual property. The editor cannot just say it was the "contributor" or the "intern" who is at fault. If the publication policies of the newspaper is so clear and explicit about these issues then anyone who is going to contribute something illegally would think twice before sending any material to the editor.

The ugly truth is that (and I am saying from my own experience) usually it is that the executives in the media who will always suggest to their subordinates to grab something fom the internet to spice up their article. When greed and profitmaking is the only force that is playing honesty is a distant dream.

I remember there was a Joe Satriani song played at the end of a very populer TV serial.... did he ever got credit for that.....
