very strong case , File a RTI against them and send a legal notice. There is no chance you can lose this one .Ask for royalty either one time or no. of days it is displayed. This is a serious crime and they ought to be taught a lesson.i was also at receiving end once but my case perhaps wasnot as strong as yours

@Mridul: yes; i just saw that one yesterday; but don't have a pic of it yet..
have updated this thread with few more pics of ads from around the city..
as per this there should be 30-40 outdoor hoardings in the city; so my image may be used in at least 50% of those

@everyone: I have a update on this; I received written reply yesterday from 'The bengaluru pages / azuremedia';
".. the creatives for our hoarding were done out of Mumbai with the advertising done by Idea Domain, a Mumbai based advertising agency. Please direct all your queries to Idea Domain regarding the photograph..."
apparently they purchased my image from Idea Domain advertising agency in Mumbai.
Mr. Rajendra Mohoni of Idea Domain, had called me some time back in this regard; and said his company was ready to pay for the image; I asked them that I would need them to send me in a written apology and only then I would send them a bill for my image. After this the response from there side has been bad and they have not responded to my phone calls. I have sent them a letter in writing asking them to reply back in 7 days; failing this I would be initiating legal action on them.

If they are based out of Bombay, how did they get hold of ur pics? Via Flickr? Coz previously you had stated that the lab too could have been a source- it is a valid point, and it almost puts me off printing my images!!!!! :)

I dont think azuremedia can absolve themselves of all responsibility ... send copies of all correspondence to them too .... but first things first, get yourself a good lawyer or someone who can advise you on that aspect ..... try www.firstappeal.com
there are bodies which are supposed to keep on the ethics and practices of the media so check with them too ... like bodies related to press and advertising
You can complain to the presscouncil.nic.in about unethical pratices by the press since this is a magazine
You can also complain to the Advertising Standards Council of India about the ad itself at www.ascionline.org/regulation/howtocomplain.htm
Copyright infringement being a criminal offence, you can give a police complaint, raid their premises and seize the offending material. Check with the commisioners offiice in bangalore about how you can pursue such legal matters in bombay since you were a victim in bangalore
This was the inaugral issue of the magazine and they surely dont want negative publicity. All these steps should make them sit up and take notice. Try and contact the highest authority of the organisation since its a big group running a lot of media like radio, tv and magazines.

Image stolen by Two different Agency

This navratri image has been stolen by two different agency and they have picked up my image thru flickr.
I am gonna go after these guys...had talk with divyesh also..there is no response from both agency they are taking things lightly. Will definately take compensation. will keep you guys updated on this :)

1. they have responded to Akshat's correspondance and given him the source of the theft. I personally feel that it is sign that the magazine has taken this seriously
2. If the objective to milk money, go ahead and file a suit. If the objective is to get an apology, i think Idea Domain will be happy to send him one.
3. I think the anger should be now directed at the source of the theft than the publisher, assuming there has been theft!
4. I myself am an amateur photographer (like to call myself one) and i have sent across the pics i have taken to agencies. And if you read the fine print, all unsolicited material sent to agencies can be used by the agency. but if it has been flicked from flickr, then u have a valid point.

@ajay garg: I am thinking they downloaded it from flickr. I give my prints mostly at a reputed lab; so that is not likely the source. I have been told by few of my friends in ad industry that they do regularly use flickr. I feel flickr needs to be banned in all ad agency companies. Also I have now disable large size to every one other than my contacts in flickr and watermarked all my model shoots hope this helps.
@Rajiv: yes Rajiv; the azuremedia would also be responsible as they are also involved in-directly (looks like) and all legal action would be jointly addressed and I would cc them copy. This would also help in pressurizing the ad agency. Thanks for the links man; they are very helpful. Will try and see how I can use them.
@paren: sorry to hear about this. Please do take action on them and do get in touch with us if you need any help on this.
@Jeevez: not sure who you are, but thanks for your support here. Feel Idea Domain need to first respond back responsibly and not ignore. They have not picked my calls for days now. This will get tough and costly for them if they continue this. I have not sent any of my images to any Indian agency till date; I am still working with one of the newer international agency but not published most of my images. Secondly an agency can't just use an image they get without buying or having got right for the image in the first place.

Well Jeevez, this is a case of obvious theft and it was acknowledged only when caught :o) They havent got back with anything constructive. The name of the media agency could be got from anywhere and not necessarily from them. Azure media has done nothing but deny ownership of the issue.
The publisher shared equal responsibility in matters related to copyright, plagiarism, etc. They cannot wash their hands off saying, I didnt steal it, I just bought stolen stuff. The fact that they didnt know that it was stolen doesnt stop them from taking action against the agency now. But they have not taken the responsibility to do so nor are they helping akshath in getting justice. I am pretty sure they are still using the services of this unethical agency ( I have checked with people I know in azuremedia myself )
In any business, its our responsibility to check the credentials of suppliers and vendors. Check any business ethics/ practices and you will see the same thing listed. Besides it also has legal implications. Distribution of infringed material carries the same punishment as the infringement itself ... just like possession things stolen from somewhere in your home makes you as guilty as the thief.
I am sure, if people running azure media knows anything about the business they are running, are aware of this. Iin effect, a police complaint could actually be lodged against them and their premises raided too.
The problem we face is not have adequate rules, but the delay in getting them enforced. Along with some business themselves not having ethical practices. This is a perfect example of that
