Recipient Terms of Service
THE FOLLOWING TERMS AND CONDITIONS ARE APPLIED TO FLICKR GIFT REDEMPTION
- ACCEPTANCE OF TERMS
Welcome to Flickr Gift Redemption. By redeeming your Flickr Gift Certificate, Flickr Gift Card, or Flickr promotion code (each, a “Flickr Gift”), you agree to this Gift Terms of Service for the Flickr Gift (“Gift Terms”), the Flickr pro Additional Terms of Service (“ATOS”) located at http://flickr.com/atos/pro/ and the Yahoo! Terms of Service ("TOS") located at http://docs.yahoo.com/info/terms/, which are incorporated by reference, and you further agree to comply with the Flickr Community Guidelines (Community Guidelines) located at http://www.flickr.com/help/guidelines/.
These Gift Terms govern the redemption and use of your Flickr Gift. Flickr reserves the right to update and change these Gift Terms from time to time. Flickr also may periodically revise certain of the documents incorporated herein by reference. - DESCRIPTION OF FLICKR GIFT REDEMPTION
To redeem your Flickr Gift, you must obtain access to the World Wide Web, either via your PC or, if supported by the service you are purchasing, through other devices that access Web-based content. You must provide all equipment necessary to make such connection to the World Wide Web, including a computer and modem or other Internet access device, and it is your sole responsibility to pay any fees associated with such access.
- ELIGIBILITY
You are eligible to redeem your Yahoo! Gift only if you are above the age of 13. Flickr reserves the right to restrict the availability of a Flickr Gift to residents of certain U.S. states, with or without notice.
A Flickr Gift is intended for use as a gift or promotion to an individual. Flickr Gifts are non-transferable, and resale of a Flickr Gift or use for unauthorized advertising, marketing, sweepstakes or other promotional purposes is strictly prohibited. You may not permit any other person to use a Flickr Gift or any unused balance that was issued to you. You agree that Yahoo has the right to suspend or terminate your account and refuse any and all current or future use of Flickr Gifts obtained or used under any of the preceding circumstances.
- AGREEMENT TO PAY
You understand that should you wish to continue using a service after your Flickr Gift is exhausted, you are solely responsible to pay to continue such service.
Unless otherwise noted, all amounts are stated in U.S. dollars.
- FEES AND CHARGES
Flickr may, upon notice required by applicable laws, at any time: (i) change the amount of, or basis for determining, any fee or charge related to any Flickr Gift, or (ii) institute new fees or charges related to a Flickr Gift.
- YAHOO! ID REQUIREMENT
In order to redeem a Flickr Gift, you must have a valid Yahoo! ID and provide your name and address. In addition, you must have registered for the service to which you wish to apply any Flickr Gift. If you do not have a Yahoo! ID you will be prompted to complete the registration process before you can redeem the Flickr Gift you have received, as described in the Additional Terms above. If you provide any information that is untrue, inaccurate, not current or incomplete, or Flickr has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, not only will Flickr have the right to suspend or terminate your account and to delete all information and content associated with such account without liability to Flickr, but Flickr may also refuse any and all current or future use of Flickr Gifts (or any portion thereof).
- NO REFUNDS
Flickr Gifts are not redeemable for cash and cannot be returned or exchanged, except where required by law. If you have questions regarding redemption or activation, please contact Flickr Customer Care.
- EXPIRATION
Flickr Gift does not expire. A Flickr Gift is accepted when the intended recipient of the gift enters the related gift code into the Flickr site and successfully applies the corresponding gift amount to their Flickr account. Flickr Gifts that are not accepted by the intended recipient within twelve (12) months of the completion of the sale of the gift to the purchaser are applied to the purchaser’s own Flickr account. There are presently no service fees for the maintenance of unaccepted Flickr Gifts.
- NO REPLACEMENT
A Flickr Gift will not be replaced if it is lost, stolen or used without the intended recipient's permission.
- SUBSCRIPTION CANCELLATIONS
You can cancel any subscription purchased by a Flickr Gift at any time; provided, however, that no refund will be given for the unused portion of your subscription.
- USING MULTIPLE GIFTS
Recipients may apply Flickr Gifts to an existing subscription and may apply multiple Flickr Gifts to a single subscription.
- 12. TERMINATION
Flickr reserves the right to close customer accounts and request alternative forms of payment if a Flickr Gift is fraudulently obtained or used on the Flickr site.
- 13. NO LIABILITY
A Flickr Gift is provided “AS-IS,” and Flickr assumes no responsibility for the timeliness, deletion, mis-delivery, misapplication or failure to store any user communications or personalization settings, or balance.
